It is submitted that the industry was granted Consent to Establish (NOC) vide no. CTE/Fresh/PTA/2023/21746421 dated 25/05/2023 valid up to 16/04/2024 under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention and Control of Pollution) Act, 1981 for manufacturing of Hydrochloric Acids @ 76800 MT/Year, Calcium Chloride @ 15000 MT/Year, Chorinated Paraffin @ 38400 MT/Year and Sodium Hypochlorite @ 4000 MT/Year by using HNP/NP/LNP @ 19000 MT/Year, Chlorine (Gas) @ 40320 MT/Year, Epoxy Plasticizer @ 384 MT/Year and Water @ 81000 MT/Year as raw material under red category.
It is pertinent to mention here that the industry had earlier applied fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 and the application was returned by this office due to following observations made by AEE of this office on 14.02.2024:
1. The site falls in M/s Seil Industrial Complex, Village Damanheri, Khadauli and Sardargarh and not in operation.
2. The industry has not connected the scrubber with the 12 no. colums as APCD to control the emissions generated during the reactions.
3. The industry has not installed sensor for detection of chlorine. The industry cannot be allowed to operate without sensor for detection of chlorine.
4. The industry has not installed OCEMS and not complies with the conditions of EC.
5. Domestic effluent is being collected into collection tank. The industry needs to install septic tank.
6. The industry has not provided 33% of green area and only provided 5 % of green area.
7. The industry needs to provide connection for waste effluent/HCL which will be generated from pump leaks with HCL tank. Thus, the industry is not complying with the provision of Water Act, 1974, Air Act, 1981 and compliance of EC conditions.
Now, the industry has again applied for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention and Control of Pollution) Act, 1981 for manufacturing of Hydrochloric Acids @ 76800 MT/Year and Chorinated Paraffin 38400 MT/Year by using HNP/NP/LNP @ 19000 MT/Year, Chlorine (Gas) @ 40320 MT/Year, Epoxy Plasticizer @ 384 MT/Year and Water @ 81000 MT/Year as raw material and discharge of domestic effluent @ 5.6 KLD, treated waste water through septic tank shall be used for green belt development, under red category along with requisite documents.
The industry has deposited Rs. 72000/- vide UTR no. N023242846097262 dated 23.01.2024 as water consent fee and Rs. 72000/- vide online receipt no. 519996242 dated 08.02.2024 as air consent fee against the fixed assets of Rs. 14.59 Crore as on 16.01.2024 as per CA certificate dated 19.01.2024, which is adequate upto 31.03.2026 .
The industry submitted compliance report of Consent to Establish (NOC) conditions earlier granted to it and compliance of Environmental Clearance to it.
Subsequently, the site of the industry was re-visited by the AEE of this office on 19.03.2024 and following observations were observed:-
1. The industry was not in operation and is yet to commission its plant.
2. The industry has presently installed plant and machinery for manufacturing of Hydrochloric Acids and Chlorinated Paraffin only.
3. The industry will install plant and machinery for manufacturing of sodium hypo chloride and calcium chloride in 2nd phase by using NACL and Lime as raw material.
4. The industry has installed 12 no. reactors for manufacturing of Chlorinated Paraffin. The industry has presently planned to operate only 6 no. reactors, which are now connected with wet scrubbers for manufacturing of hydrochloric acid.
5. The industry has installed 2 no. sensors for detection of chlorine in process building and in HCL. The industry has also procured one hand held chlorine gas sensor.
6. The industry is further advised to provide adequate number of chlorine gas sensors where required as per the SOPs for handling of chlorine gas.
7. The industry will not manufacture sodium hypochlorite and calcium hypochlorite in first phase, therefore, there will not process emission as the extra chlorine gas sent back to M/s Bodal Chemical in first stage. Hence, the industry is not required to provide alkali scrubber followed by stack.
8. Further, no OCEMS or Ambient Air quality station are required to be installed at this stage as there will be no process emission.
9. The industry has provided septic tanks for treatment of ddomestic effluent.
10. The industry has provided new sapling in its designated green area left as per the condition of the EC, which will be further developed in due course of time so as to maintain 33% of green area.
11. The representative has informed that they have installed leak proof non metallic pumps, which does not require any additional seal cooling and therefore will no leakage of any effluent or wastewater during transfer of effluent.
12. The industry will utilize the blow down of the cooling tower in HCL scrubbers.
13. The industry has already adopted village pond of Damanheri Rajpura as part of its additional Environmental activities as per the condition of EC and has spent approx. Rs. 6.0 lakh for rejuvenation.
14. The industry has installed 1 no. D.G set of capacity 250 KVA, which is equipped canopy and stack of adequate height.
The industry has also submitted compliance report of the conditions of Consent to Establish (NOC) conditions earlier granted to it and compliance of Environmental Clearance granted to it.
In view of the above mentioned facts, May if approved, recommendations may be sent to the Competent Authority for grant of "Consent to Operate” under the Water Act, 1974 and Air Act, 1981 upto 31.03.2026 for manufacturing of Hydrochloric Acids @ 76800 MT/Year and Chorinated Paraffin 38400 MT/Year only by using HNP/NP/LNP @ 19000 MT/Year, Chlorine (Gas) @ 40320 MT/Year, Epoxy Plasticizer @ 384 MT/Year and Water @ 81000 MT/Year as raw material with suitable conditions as per the policy of the Board and special condition that:
1. The industry shall obtain varied consent to operate under the Water Act, 1974 and the Air Act, 1981 before commissioning of the 2nd phase for manufacturing of Calcium Chloride and Sodium Hypochlorite.
2. The industry shall submit detail of the amount spent on the Environmental Management Plan as mentioned in the Environmental Clearance, within one month.
3. The industry shall submit action plan to provide 33% of green area within the premises, within one month.
4. The industry shall be bound to comply with the conditions of Environmental Clearance and NOC obtained from the Board.
