It is submitted that the project proponent was afforded an opportunity of personal hearing before the Chief Environmental Engineer (B) of the Board on 14.03.2024, wherein it was decided that-
1. The project proponent shall obtain consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 for the whole project immediately and shall submit the copy of the same to the Regional Office, Bathinda of the Board.
2. The project proponent shall obtain consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 for the outlets which have already been commissioned at the proposed site, immediately.
3. Directions earlier issued to the project proponent u/s 33-A of the Water (Prevention and Control of Pollution) Act, 1974 are withdrawn and the PSPCL authorities be directed to restore the electric connection temporarily for three months to the new project proponent.
4. It has been made clear to the project proponent that, in case of any violation w.r.t. the above decisions as well as under the provisions of the Water Act, 1974; Air Act, 1981 & HOWM Rules, 2016, action as deemed fit under the provisions of the said Acts shall be initiated by the Board against the project proponent without giving any further notice/opportunity.
In compliance to the decision of personal hearing, directions have been issued to the PSPCL authorities to restore the electric connection of the restaurants upto 30.06.2024……
Application applied for obtaining partial CTOs under the provisions of Water Act, 1974 & Air Act, 1981 for operating two outlts i.e KFC and McDonalds………
In view of the detail mentioned by visiting officer vide note dated 26.03.2024, if approved, CTO may be granted to the Project for operating of shop no.1 & 2 i.e. restaurants KFC & Mc Donalds with treatment of the effluent into ETP installed and final discharge onto land for plantation for 3 months (30.06.2024) i.e. upto restoration of the electric connection for 3 months with special condition that: 1. The Project shall set up ETP in alternate space/ space reserved in the complete project for installation of ETP with alternate adequate plantation area within 3 months………
2. The industry will operate its ETP regularly & scientifically and shall maintain the proper record of the effluent generated/ treated………….
3. The industry shall ensure proper availability of the land area for disposal of treated effluent at all times; will ensure no stagnation in the said plantation area at any time and will be bound to increase the same if stagnation is observed in it at any time………..
4. The industry will get its effluent samples analyzed from the Board's lab/Approved lab of the Board, within 03 months………..
5. The consent to operate is only granted for operation of two restaurants i.e. KFC and McDonalds operating shop no. 1 & 2 of the project and PP will ensure to obtain varied consent to operate under the provisions of Water Act, 1974 & Air Act, 1981 in case any expansion is executed beyond the consented capacity ………..
