It is intimated that the subject cited project proponent has applied for obtaining consent to establish (NOC) from pollution angle for setting up of Cattle/Poultry Feed Mill at the subject cited site. As per latest categorization the above industry falls in Orange Category.
The Project Proponent has deposited Rs. 18500/- vide online UTR No. 000144834533 dated 20/02/2024 & Rs. 3600/- vide UTR No. 952612065 dated 27/03/2024 including Rs. 500/- as FDF, which is adequate for one year period against total gross value of fixed assets worth Rs. 1092/- as per Project report submitted by the Project Proponent. The project proponent has submitted relevant documents, which are enclosed along with the application, which may kindly be pursued.
The industry was visited by the Officer of this office on 26/03/2024 and observed that the Project Proponent has not started the civil construction work at the site.
The Project Proponent has submitted report issued from DTP, Gurdaspur vide letter no. 134 dated 13/02/2024 which is reproduced as under:-
ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਅਤੇ ਹਵਾਲੇ ਤਹਿਤ ਪੱਤਰ ਅਨੁਸਾਰ ਸਾਈਟ ਦੀ ਮੋਕਾ ਰਿਪੋਰਟ ਕਰਵਾਈ ਗਈ, ਜਿਸ ਅਨਸਾਰ ਇਹ ਸਾਈਟ ਮੁਗਰਾਲਾ ਚੌਕ ਤੋ ਮੀਰਥਲ ਰੋਡ ਤੇ ਪਲ਼ਦੇ ਪਿੰਡ ਘੇਸਲ ਨੂੰ ਮੁੜਦੀ 22 ਫੁੱਟ ਚੌੜੀ ਰੈਵਿਨਿਊ ਸੜਕ ਤੇ ਉਕਤ ਮੀਰਥਲ ਰੋਡ ਤੋ ਤਕਰੀਬਨ 328 ਮੀਟਰ ਦੀ ਦੂਰੀ ਦੇ ਸੱਜੇ ਪਾਸੇ ਪਿੰਡ ਸੰਮੂ ਚੱਕ (ਹੱਦਬਸਤ ਨੰL 296) ਤਹਿਸੀਲ ਦੀਨਾਨਗਰ, fਗ਼ਲ੍ਹਾ ਗੁਰਦਾਸਪੁਰ ਦੀ ਰੈਵੀਨਿਊ ਅਸਟੇਟ ਦੇ ਖਸਰਾ ਨੰ 19/2(5-4), 3(3-11), 4(1-7), 7(8-0), 8(8-0), 9(8-0), 11(7-4), 12(8-0), 13(8-0), 14(8-0), 17/1(2-0), 17/2(2-0) 18(8-0), 19/1(1-12), 19/2(6-8), 20(7-4), 20/14(8-0), 15(8-0), 16(8-0), 17(8-0) ਕਿੱਤੇ 20 ਕੁੱਲ ਕਰਬਾ 124-10 ਦਾ 453/2490 ਹਿੱਸਾ 22 ਕਨਾਲ-13 ਮਰਲੇ (2.83 ਏਕੜ), ਜੋਕਿ ਸਾਝਾਂ ਖਾਤਾ ਹੈ। ਪ੍ਰਦੂਣ ਕੰਟਰੋਲ ਬੋਰਡ ਦੀ ਕੈਟਾਗਰੀ ਲਿਸਟ ਦੇ ਲੜੀ ਨੰ: 30 ਟਾਈਪ ਕੋਡ 2030 ਅਨੁਸਾਰ, ਸਾਈਟ (Fish feed, poultry feed and cattle feed) Orange Category Industry ਅਧੀਨ ਆਉਦੀ ਹੈ। ਅਮਲ਼ਡਡ ਯੂਨੀਫਾਈਡ ਗ਼ੋਨਿੰਗ ਰੈਗੂਲੇਨ ਆਫ ਮਾਸਟਰ ਪਲੈਨਜ ਦੇ ਨੁੱਕਤਾ - A, Industry in Rural and Agriculture ਦੇ ਲੜੀ ਨੰ: 3 ਅਨੁਸਾਰ ਸਾਈਟ 250 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਕੋਈ ਆਬਾਦੀ/ 50 ਪੱਕੇ ਘਰ ਨਹੀ ਪੈਦੇ ਹਨ ਅਤੇ 100 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ 15 ਪੱਕੇ ਘਰ ਨਹੀ ਪੈਦੇ ਹਨ। ਜਿਸ ਸਬੰਧੀ ਮੰਗੀ ਗਈ ਨੁੱਕਤਾਵਾਈਜ ਰਿਪੋਰਟ ਹੇਠ ਲਿਖੇ ਅਨੁਸਾਰ ਹੈ:-
1) ਉਕਤ ਸਾਈਟ ਨੋਟੀਫਾਈਡ ਲੋਕਲ ਪਲੈਨਿੰਗ ਏਰੀਆ, ਦੀਨਾਨਗਰ ਵਿੱਚ ਪੈਦੀ ਹੈ, ਜਿਸਦਾ ਮਾਸਟਰ ਪਲੈਨ ਅਜੇ ਨੋਟੀਫਾਈਡ ਨਹੀ ਹੋਇਆ ਹੈ, ਇਸ ਲਈ ਡਾਇਰੈਕਟੋਰੇਟ ਆਫ ਟਾਊਨ ਅਲ਼ਡ ਕੰਟਰੀ ਪਲੈਨਿੰਗ ਪੰਜਾਬ ਜੀ ਦੇ ਪੱਤਰ ਨੰ: 2180-2283 CTP (PB)/SP-432(Gen) dated 14/06/2023 ਅਨੁਸਾਰ ਹੇਠ ਲਿਖੇ ਅਨੁਸਾਰ ਪ੍ਰਾਰਥੀ ਪਾਸੋ ਅੰਡਰਟੇਕਿੰਗ ਡਾਈਰੈਕਟਰ ਆਫ ਫੈਕਟਰੀਜ ਪੰਜਾਬ ਦੇ ਦਫਤਰ ਵਿਖੇ ਪੇਸ਼ ਕੀਤੀ ਜਾਣੀ ਬਣਦੀ ਹੈ।
“The applicant shall be liable to abide by the provisions of Master Plan and shall also be bound to follow the provisions of section 79 along with other provisions of PRTPD Act, 1995, in case the site falls in non-conforming land use zone after the notification of Master Plan and no claim shall be demanded by the applicant from the Department”.
ਉਕਤ ਅਨੁਸਾਰ ਅੰਡਰਟੇਕਿੰਗ ਪ੍ਰਾਪਤ ਕਰਨ ਉਪਰੰਤ ਹੀ ਵਿਸ਼ੇ ਅਧੀਨ ਐਕਟੀਵਿਟੀ ਦੇ ਕੇਸ ਨੂੰ ਵਿਚਾਰਿਆ ਜਾ ਸਕਦਾ ਹੈ ਬੇਰਤੇ ਕਿ ਸਾਈਟ ਵਿਭਾਗੀ ਗਾਈਡਲਾਈਨਜ ਦੀ ਪ੍ਰਤੀ ਪੂਰਤੀ ਕਰਦੀ ਹੋਵੇ।
2) ਉਕਤ ਸਾਈਟ ਨਗਰ ਕੌਲ ਦੀਨਾਨਗਰ ਦੀ ਹਦੂਦ ਤੋ ਬਾਹਰ ਪਦੀ ਹੈ ਅਤੇ ਇਸਦੀ ਨਗਰ ਕੌਲ ਦੀਨਾਨਗਰ ਤੋ ਦੂਰੀ ਤਕਰੀਬਨ 4.08 ਕਿਲੋਮੀਟਰ ਹੈ।
3) ਇਸ ਵਿਭਾਗ ਦੀ ਨੋਟੀਫਿਕੇਨ ਨੰ: PS/PSHUD 206 ਮਿਤੀ 12/11/2021 ਅਨੁਸਾਰ ਸਟੈੱਡ ਆਲੋਨ ਇੰਡਸਟਰੀਜ ਨੂੰ ਸੀ.ਐਲ.ਯੂ./ਐਨ.ੳ.ਸੀ. ਤੋ ਛੂਟ ਦਿੱਤੀ ਗਈ ਹੈ, ਪਰੰਤੂ ਪ੍ਰਾਰਥੀ ਨੂੰ ਬਿਲਡਿੰਗ ਪਲੈਨ ਅਪਰੂਵ ਕਰਵਾਉਣੇ ਬਣਦੇ ਹਨ ਅਤੇ ਇਸ ਵਿਭਾਗ ਦੀ ਨੋਟੀਫਿਕੇਨ ਨੰL 13/41/2021-6HG2/2684 ਮਿਤੀ 19-10-2022 ਅਨੁਸਾਰ ਬਿੱਲਡਿੰਗ ਪਲੈਨ ਅਪਰੂਵ ਕਰਨ ਲਈ ਡਾਈਰੈਕਟਰ ਆਫ ਫੈਕਟਰੀਜ ਪੰਜਾਬ ਨੂੰ ਕੰਪੀਟੈਟ ਅਥਾਰਟੀ ਨਿਯੁਕਤ ਕੀ਼ਤਾ ਗਿਆ ਹੈ। ਇਸ ਲਈ ਬਿੱਲਡਿੰਗ ਪਲੈਨ ਅਪਰੂਵ ਕਰਵਾਉਣ ਲਈ ਸਿੱਧੇ ਤੋਰ ਤੇ ਉਕਤ ਨੋਟੀਫਿਕੇਸ਼ਨ ਅਨੁਸਾਰ ਡਾਈਰੈਕਟਰ ਆਫ ਫੈਕਟਰੀਜ ਪੰਜਾਬ ਦੇ ਦਫਤਰ ਵਿਖੇ ਅਪਲਾਈ ਬਣਦਾ ਹੈ।
ਇਸ ਜਾਣਕਾਰੀ ਨੂੰ ਉਕਤ ਸਾਈਟ ਦਾ ਐਨ.ੳ.ਸੀ./ਸੀ.ਐਲ.ਯੂ. ਅਤੇ ਬਿੱਲਡਿੰਗ ਪਲੈਨ ਦੀ ਮੰਨਜੂਰੀ ਨਾ ਸਮਝਿਆ ਜਾਵੇ।
The Project Proponent has submitted report issued from SDM, Dinanagar vide letter no. 286 dated 29/02/2024 which is reproduced as under:-
ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਦੇ ਸਬੰਧ ਵਿੱਚ ਹਵਾਲਾ ਅਧੀਨ ਪੱਤਰ ਰਾਹੀ ਤਹਿਸੀਲਦਾਰ ਦੀਨਾਨਗਰ ਪਾਸੋ ਰਿਪੋਰਟ ਪ੍ਰਾਪਤ ਕੀਤੀ ਗਈ ਹੈ। ਤਹਿਸੀਲਦਾਰ ਦੀਨਾਨਗਰ ਨੇ ਆਪਣੇ ਦਫਤਰ ਦੇ ਪੱਤਰ ਨੰਬਰ 1138$ਆਰHਸੀH ਮਿਤੀ 14-11-2023 ਰਾਹੀ ਆਪਣੀ ਰਿਪੋਰਟ ਵਿੱਚ ਦੱਸਿਆ ਹੈ ਕਿ ਯੂ.ਵੀ. ਫੀਡ ਮਿਲ ਬਜਰੀਆ ਪਾਟਨਰ ਅਮਰੀਸ ਕੁਮਾਰ 1/2 ਹਿੱਸਾ ਵਾ ਉਕਾਰ ਨਾਥ 1/4 ਹਿੱਸਾ ਪੁੱਤਰ ਗੰਡਾ ਮੱਲ ਵਾ ਵਿਸਵਮ ਮਹਾਜਨ 1/4 ਹਿੱਸਾ ਪੁੱਤਰ ਉਕਾਰ ਨਾਥ ਵਾਸੀਅਨ ਦੀਨਾਨਗਰ ਜੋ ਕਿ ਰਕਬਾ ਪਿੰਡ ਸਮੂਚੱਕ ਹਦਬਸਤ ਨੰਬਰ 296 ਕੁੱਲ ਰਕਬਾ (124-10) ਮਰਲੇ ਦਾ 453-2490 ਹਿੱਸਾ (22-13) ਪਿੰਡ ਸੰਮੂਚੱਕ ਲਾਲ ਲਕੀਰ ਦੀ ਦੂਰੀ 3 ਕਿਲੋਮੀਟਰ ਅਤੇ ਸਕੂਲ ਦੀ ਫਿਰਨੀ ਦੀ ਆਬਾਦੀ ਦੀ ਦੂਰੀ 3 ਕਿਲੋਮੀਟਰ ਹੈ। ਇਹ ਮਿਉਸੀਪਲ ਕਮੇਟੀ ਅਤੇ ਪੁੱਡਾ ਦੇ ਅਧੀਨ ਨਹੀ ਹੈ।
The project falls in Orange category in small scale sector, hence competency to decide the case lies with the Senior Environmental Engineer of the Board in the light of Head Office, Patiala letter no. 19650-761 dated 30/04/2013.
In view of above, it is recommended that consent to establish (NOC) from pollution angle may be granted for one year period to the project proponent for the setting up of Cattle/Poultry Feed Mill with suitable conditions.
