It is submitted that the project proponent was issued show cause notice before refusal of 'consents to operate' under the provisions of Water Act, 1974 & Air Act, 1981 with an opportunity of personal hearing before the Chief Environmental Engineer (B) of the Board on 20.03.2024. After hearing the representative of the project proponent, following decisions were taken :-
(i) The project proponent shall submit all the requisite documents to the Regional Office, Faridkot of the Board, within 2 days.
(ii) Environmental Engineer, Regional Office, Faridkot shall verify the submission / documents submitted by the project proponent and process the applications under the provisions of Water Act, 1974 & Air Act, 1981.
In compliance to the hearing decision, the industry has following documents in the Regional Office:-
The industry has submitted building plan approved by the competent authority.
The industry has submitted NOC issued by the Board earlier.
The project was again visited by undersigned (AEE) on 28.03.2024 and it was observed as under:-
1) ETP installed by the project proponent was in operationable condition and was under stabilization.
2) Now, the outlet of the ETP has been connected to the plantation area along the boundary of the premises and onto the lawn area developed inside the premises, which is adequate.
3) The project proponent has now provided one no. compost pit for treatment of bio-degradable generated for the premises. Non-bio will be handed over to the MC authorities.
Considering the commissioning of the industry from 01.04.2016, fee deposited by the industry is valid upto 30.09.2026 after deducting penalty as applicable.
In view of above, the industry is now complying with the provisions of the Water Act, 1974 and the Air Act, 1981 as well as decisions of the personal hearing. It is therefore recommended that consent to operate may be granted to the industry upto 30.09.2026, subject to the suitable conditions alongwith the following specific:-
1) The project proponent shall submit analysis report from the outlet of the ETP.
2) The project proponent shall install the flow meter at the source of fresh water as well as onto the outlet of ETP and shall make daily record regarding the same.
