It is submitted that the industry is a small scale orange category rice sheller and was granted consent to establish/NOC from the Board under the Water Act, 1974 and the Air Act, 1981 vide no. CTE/Fresh/MLK/2023/21757966 dated 28/04/2023 valid upto 27/04/2024 for manufacturing of Sorted Raw Rice with Dryer @ 2.0 TPH by processing of Paddy @ 3.0 TPH, as raw material under orange category.
Earlier, the industry was surprisingly visited by the officer of this office on 05.02.2024 and found operating its unit without obtaining consents to operate under both acts and violating the provisions of the Water Act, 1974 and the Air Act, 1981.
Accordingly, the industry was given personal hearing before the EE, RO, Sangrur on 15.02.2024 and it was decided as under:-
1. The industry shall apply for obtaining consent to operate under the Water Act, 1974 and the Air Act, 1981 within 7 days after the operation of OCMMS portal of the Board, failing which further action will be recommended under the said acts to higher authority of the Board.
2. Assistant Environmental Engineer-I, Regional Office, Sangrur shall visit the industry after a week to verify contentions made by the industry during hearing, collect air emission samples and submit fresh report in the matter.
Now, the industry has applied for obtaining fresh consents under the Water Act, 1974 and under the Air Act, 1981 for same production i.e. manufacturing of Sorted Raw Rice (with dryer) 2.0 TPH by processing of Paddy @ 3.0 TPH, as raw material.
The rice sheller has deposited Rs. 44,100/- (Rs. 42,000/- as consent fee + Rs. 2100/- penalty fee) vide no. 19922634 dated 18.03.2024 under the Water Act, 1974 and Rs. 44,600/- (Rs. 42,000/- as consent fee + Rs. 2100/- penalty fee + Rs. 500/- application fee) vide no. 746559803 dated 18.03.2024 under the Air Act, 1981. The industry has submitted the CA certificated for the value of fixed assets Rs. 131.49 Lacs as on 06.03.2024. The fee deposited by the industry is adequate upto 30.12.2028 under the Water Act, 1974 and the Air Act, 1981.
The industry has submitted an undertaking regarding the APCDs installed by the industry. The industry has also submitted approved building plan and compliance report of previous consent conditions earlier granted to it for setting up a rice sheller unit.
The industry has also submitted undertaking regarding movement area which is reproduced as under:-
“We, M/s Mahadev Rice Mill, Sukhewal Road, Village Bagrian, Tehsil Amargarh, District Malerkotla declared that NOC has been granted to our sheller. And, water & air consents after completing all the work as per the consent conditions except the stabilization of the movement area for vehicles from gate to husk area and rice room have been applied for. Now, we have been starting the work of stabilization after procuring the required material. So, it is requested to grant us consents as we are assuring that we would complete stabilization work of the movement area within two month, please. And, we are complying with the code of practices specified by the PPCB.”
To verify the compliance of consent conditions earlier granted to the rice sheller & the code of practice, the rice sheller was visited by undersigned on 28/03/2024 and it was observed as under : -
1. The industry was in operation during visit.
2. The industry has covered all the processing sheds.
3. The industry has now installed cyclone as APCD for shelling section as well as for dryer section and the same was having adequate stack height.
4. The industry has provided brick wall of 10 feet height in front of the discharge point of rice husk area and the length of aforesaid brick wall is 35' on each side of the rice husk discharge point. The industry has provided net of height 5 ft above this wall.
5. The industry has no source of trade effluent generation.
6. The industry has constructed septic tank for treatment of domestic effluent of the toilet section and disposal onto land for plantation.
7. The industry has planted sapling of trees along the boundary wall.
8. The industry has done the soil compaction and started the work for stabilizing the movement area of vehicles and representative informed that it will complete within two months.
In view of above, it is recommended that consent to operate granted under the Water Act, 1974 & the Air Act, 1981 may both be granted upto 30/09/2028 (upto cumulative period ) for manufacturing of Sorted Raw Rice (with dryer) @ 2.0 TPH by processing of Paddy @ 3.0 TPH, as raw material under orange category, with suitable conditions and special condition that the industry shall got analyzed its stack emission samples from Board’s lab and shall provide paved road on movement area of vehicles within one month and shall submit the report of the same in this office.
