It is submitted that the subject cited industry is a medium scale induction furnace unit and was granted consent to operate under the Water Act, 1974 vide no. CTOW/Varied/FGS/2023/21944670 dated 19/06/2023 valid upto 26/10/2023 and under the Air Act, 1981 vide no. CTOA/Varied/FGS/2023/21944667 dated 19/06/2023 valid upto 31/12/2023 for the manufacturing of MS Billets and Castings @ 84 MTD or Round, Square, Flats and Angles @ 84 MTD or ERW Pipe Plan @ 80 MTD.
Show cause notice was issued to the industry after hearing the officer of the Board and representative of the industry, Chief Environmental Engineer (B) Patiala decided that:
1. To improve the efficiency of bag house of the existing APCD, the industry shall up-grade its bag filters in the bag house in the existing APCD as per the specifications given below within one month and shall get it verified/ certified from PSCST, Chandigarh.

2. The industry shall submit the proposal regarding control of Secondary Emissions generated from the process within one month after consultation with the PSCST, Chandigarh.
3. The industry shall submit a bank guarantee amounting to Rs. 2.0 lakh within 7 days as an assurance to comply with the Environmental Laws and Environmental Engineer, Regional Office, Fatehgarh Sahib shall encash 50% of the above said bank guarantee.
4. The industry shall use good quality raw material free from dust and oil.
5. The industry shall develop the adequate green area all around the boundary wall and shall stabilize all of its movement area within the premises of the industry as well as approach around the industry, so as to minimize the dust emissions within one month.
6. A team of the officers shall be constituted by CEE(B) to surprisingly visit the industry to verify the conditions imposed in Environmental Clearance, other compliance of Environmental Laws immediately after one month and shall submit report/ recommendations, thereafter.
7. Environmental Engineer, Regional Office, Fatehgarh Sahib shall verify the compliance of the decisions of the hearing and submit the report/ recommendations after one month.
Now, the industry has applied for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air Act, 1981 with requisite documents through OCMMS under orange category. The industry has deposited consent fee of Rs. 26400/- vide UTR no. 32093526721DC dated 05/05/2023 under the Water consent fee and Rs. 122400/- vide UTR no. 32093538711DC dated 05/05/2023 under Air consent fee against the un-depreciated fixed assets of Rs. 1757.26 Lacs as on 31/12/2023 as per CA certificate dated 05/01/2024, which is adequate upto 31/01/2026 under the Air Act as per Board's Office Order dated 29/10/2018 after deducting 10% penalty charges. The industry has also deposited NOC regularization fee of Rs. 18000/- vide UTR no. 32093511431DC dated 05/05/2023.
To verify the contents of application and compliance of proceedings the industry was visited by AEE on 29/03/2024 During the visit, it was observed as under:
1. The industry has installed induction furnace of capacity 7 TPH along with CCM and rolling mill and the industry has installed ERW pipe plant after rolling mill to manufacture ERW Pipe @ 80 MTD. The induction was not in operation during the visit due to its maintenance
2. The industry has installed spark arrestor followed by bag filter as APCD along with side hood as per design PSCST and the industry has installed energy meter on its APCD and its reading was 451943.
3. The industry has installed U-tube manometers with all the compartments of APCD and was found maintaining proper record of the same.
4. The industry has installed water meter on its submersible and its reading was 94239 KL.
5. The stack emission sample report from Board’s Lab on 29/08/2023 and as per the analysis results, the concentration of SPM is found to be 32 mg/Nm3, which is within the permissible limits laid down by the Board.
6. The industry has installed 2 nos. DG sets of capacities 125 and 250 KVA, which are equipped with canopy and stack of adequate height.
7. No water will be used in the process; therefore, there will be no generation of trade effluent. Whole of the cooling water, will be re-circulated.
8. Domestic effluent being generated by the industry is discharged onto land for plantation after passing through septic tank.
9. The industry has applied PTEE Treatment: full bath PTEE finish 650 bags on its APCD.
10. Sh. Ashok Sharma, representative of industry was informed he approached to PSCST, Chandigarh and they searching design for control of secondary emission generated from the industry approached to PSCST, Chandigarh and they searching design for control of secondary emission generated from the industry.
11. The industry has submitted 02 no. of bank guarantees for Rs. 1.0 Lakh each vide. No. 0450NDDG00000624 dated 29/01/2024 and 0450NDDG00000724 dated 29/01/2024 both are valid upto 25/01/2025 and the 0450NDDG00000624 dated 29/01/2024 was enchased as per order of Competent Authority vide letter no. 3119 dated 15/03/2024.
12. The industry has installed shredder for segregation and sizing before its feeding into crucible.
13. The industry has planted the plants around the boundary walls and the industry has advised to more plantation.
14. Sh. Ashok Sharma, representative of industry was informed that the team of officers from Head Office Patiala was also visited on 20/03/2024.
The industry falls in industrial zone as per Master Plan of Mandi Gobindgarh.
Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021 decided as under:
"The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries."
PWRDA vide notification dated 27.01.2023 (attached herewith) has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month.
In the subject cited case, the industry has mentioned ground water extraction @ 13 KLD. Considering 30 working days per month, ground water extraction will be 390 KL/month, which is more than 300 KL/month. It industry has applied for permission from PWRDA.
It is therefore recommended that 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of MS Billets (with CCM) and Castings @ 84 MTD or Round, Square, Flats and Angles (Rolling mill unit) @ 84 MTD or ERW Pipes @ 80 MTD may be granted upto 30/09/2025 with suitable conditions and special conditions that:
1. The industry shall obtain necessary clearance for Abstraction of Ground Water from the Punjab Water Regulation and Development Authority (PWRDA).
2. The industry shall comply with the guidelines/SOPs provided by PSCST, Chandigarh in the effective operation of APCD.
3. The industry shall not dispose off its Hazardous waste to any unauthorized vendor.
4. The industry shall execute annual maintenance contract (AMC) for APCD from the repute agency and submit the report in this regard.
5. The industry shall not use any scrap containing Hazardous waste like shockers containing waste oil.
6. The industry will get its building plans approved from competent authorities if there is further change in the building plan, within one month.
7. The industry shall not throw, burn or burry any solid wastes in open, outside premises or in drain / water bodies.
8. The industry shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic, through their Corporate Environment Responsibility (CER) activities.
9. The industry shall ensure that there are no usages of single use plastic-thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocal or any other non-biodegradable material in the premises.
10. The industry shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner.
