It is submitted that the industry was granted Consent to Establish/NOC vide no. CTE/Fresh/MNS/2023/21837798 dated 29.04.2023, which was valid upto 28.04.2024 for establishment of rice sheller unit of capacity 3 TPH of Raw rice/Sorted Rice with dryer, subject to the conditions mentioned therein.
Now, the industry has applied for obtaining fresh consent to operate under the Water Act, 1974 & the Air Act, 1981 through OCMMS for operation of rice sheller unit of capacity 3 TPH of Raw rice /Sorted Rice with Dryer under the Orange category as per the prevailing policy.
The industry has submitted principal approval regarding building plan from competent authority, Punjab, Compliance report of NOC conditions and completion of APCD’s installed.
The industry has also submitted the CA certificate dated 11.03.2024, wherein, the value of total fixed assets of the unit as on 11.03.2024 is Rs. 131.68 lakhs with value of plant & machinery is Rs. 89.35 lakhs. Accordingly, the industry has deposited consent fee of Rs. 42000/- vide R No. 269807554 dated 19.03.2024 under the Water Act, 1974 & Rs. 42500/- vide R No. 386940346 dated 19.03.2024 under the Air Act, 1981. As such, as per circular dated 29.10.2018, the fee deposited by the industry under both the Acts is adequate upto 30.09.2029.
Further, the industry was visited by the AEE on 01.04.2024 and Sh. Ram Singh, Partner was contacted. During visit, it was observed as under:
1. The industry was in operation.
2. The industry has installed cyclone separator as APCD with shelling section and paddy cleaning section of the drier with adequate stack height and sampling arrangement.
3. The industry has provided brick wall of 10' height with adequate length and further wind screen of 5' height has provided on the said wall.
4. The industry has provided plantation along its boundary wall.
5. The industry has provided septic tank for treatment of domestic effluent.
6. The industry has not stabilized the movement area for the movement of the vehicles.
From above, it is clear that the unit is complying with the code of practice stipulated for such units and provisions of the Water (Prevention & Control of Pollution) Act, 1974 and not complying with the provisions of the Air (Prevention & Control of Pollution) Act, 1981.
In view of above, it is recommended as under : -
1. Fresh consent to operate under the provisions of the Air (Prevention & Control of Pollution) Act, 1981 may be refused with an opportunity to show cause within 7 days.
2. Fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 for operation of rice sheller unit of capacity 3 TPH of Raw rice/Sorted Rice with Dryer may be granted to the unit upto 30.09.2029 with suitable conditions along with special conditions that:-
i) The industry will discharge only treated domestic effluent onto land for plantation / green belt.
ii) The industry shall not increase its existing land area without prior permission of the Board.
iii) The industry shall not increase its production capacity without the prior written permission/NOC of the Board.
