File Note: It is submitted that the industry is a large-scale Induction Furnace unit under Orange category. The industry was earlier granted 'consent to operate' under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/LDHKH/2023/23810110 dated 25/10/2023, which was valid upto 31/03/2024 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDHKH/2024/24399632 dated 01/01/2024, which is valid upto 30/09/2024 for manufacturing of Steel Ingots/Billets @ 140 MT/Day with CCM plant subject to the suitable and additional conditions mentioned therein. Now, the industry has applied for obtaining renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 alongwith requisite documents and consent fee. The industry has submitted the CA certificate dated 29/08/2023, wherein, the total value of fixed assets of the industry is Rs. 1148.06 lakhs with value of plant & machinery is Rs. 1000.75 lakhs. As per the record file, the fee deposited by the industry under the Water Act, 1974 and the Air Act, 1981 was adequate upto 30/09/2029 as per Board's Office Order dated 29/10/2018. To verify the contents of the application, the industry was visited by the Er. Sanatpreet Singh, AEE (OS) on 15/03/2024 and Sh. Rajinder Kumar Singhi, Partner was contacted. During visit, it was observed as under: 1. The industry was in operation and engaged in the business of manufacturing of Steel Ingots/Billets @ 140 MTD. 2. The industry has installed 1 no. induction furnace of capacity 10 TPH and CCM. 3. The industry has installed spark arrestor followed by bag filter houses as APCD to control the air emissions from the furnace as per design evolved by PSCST, Chandigarh. 4. The industry has only developed green area in an area 235.23 sqm. out of required 2788.10 Sqm. Due to non-availability of vacant land, it has purchased new land having area 6 Kanal 11.66 Marla for developing green area. It has only developed 15% green area in the new land purchased by the industry. 5. The industry has also submitted the amended Environmental Clearance Vide No. SEIAA/MS/2023/ 707 dated 26/04/2023 regarding green area changes and addition of land. It is submitted that the Govt. of India, Ministry of Jal Shakti, Deptt. of Water Resources RD&GR Central Ground Water Authority, New Delhi has issued directions u/s 5 of Environment (Protection) Act, 1986 vide letter no. CGWA- 21/6/2020-CGWA-101 dated 06/04/2022 “that it shall be mandatory for the Project Proponent abstracting ground water to obtain NOC from CGWA or the concerned State/ UT Ground Water Authority as the case made be in the compliance condition in consent to operate and consent to establish issued by the State Pollution Control Board.” Accordingly, the Board vide letter no. 1955-57 dated 18/01/2023 has informed all the officers of the Board in continuation to earlier circular no. CEE(HQ)/2018/7956-84 dated 03/03/2018 and 768-97 dated 13/01/2021 to ensure the compliance of the said directions. PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month. In the subject cited case, the industry has mentioned ground water extraction @ 7.0 KLD. Considering 30 working days per month, ground water extraction will be 210 KL/month, which is less than 300 KL/month. As such, the industry does not require permission from PWRDA. In view of facts mentioned above, if approved, it is recommended that consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 may be renewed to the industry upto 30/09/2024 for manufacturing of Steel Ingots/Billets @ 140 MT/Day subject to the suitable conditions and additional conditions as under: 1. This consent is granted for manufacturing of Steel Ingots/Billets @ 140 MT/Day. 2. The industry shall comply with all the conditions of Environmental Clearance already granted to it under EIA Notification, 2006. 3. The industry shall develop 33% plantation area and submit report to Regional Office Fatehgarh Sahib. 4. The industry shall comply with the provisions for abstraction of ground water of the Punjab Water Regulation and Development Authority (PWRDA). 5. The industry will not generate and discharge any trade effluent without obtaining prior written permission of the Board. 6. The industry shall ensure that there is no public nuisance in the area, due to activities of the industry. 7.
