Sub: Proceeding of the personal hearing given before the Chief Environmental Engineer, Ludhiana on 28.03.2024 w.r.t show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 to M/s Shri Balaji Multimetals Private Limited, Village - Tibba, Sahnewal Dehlon Road, Ludhiana.

The Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry has applied for Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of alloys and non-alloys flat, square angle, round & hexa, etc @ 222 MT/Day using Steel Ingot for rolling purchased from outside @ 150 MT/Day, Steel scrap / Sponge iron and Ferro Alloys 92 MT/Day.
The industry was visited by officers of the Board on 18.01.2024 and observed as under:-
1. The Steel Rolling mill was in operation.
2. The rolling process for manufacturing of M.S.F round was in operation using Steel Ingots as raw material.
3. The industry has installed Reverberatory Heating Furnace in which coal was being used as fuel.
4. The industry has installed a induction furnace of 8 TPH capacity,
As per Completion certificate issued by the Punjab State Council for Science & Technology vide letter no. PSCST/TFD/393 dated 14.09.2023, the installed induction furnace is of 8 TPH capacity and it seems that production capacity will be 8 x 16 heat x 300 days = 38400 Ton/year which cover under Environmental Clearance. So, it seems that the industry is covered under EIA notification for Environmental Clearance.
In view of above, show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 was issued to industry with hearing before the CEE, Ludhiana on 28.03.2024.
Sh. Vaneet Gupta, Director of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that only 2799 KVA of power load will be able to achieve from the 8 TPH furnace equal to that of 7 TPH furnace as per the certificate from furnace supplier attached herewith. Hence, by operating the plant for 300 working days in a year, the maximum production from 8 TPH furnace @ 12 heats/day will be 28,800 TPA which does not qualify for prior Environment Clearance. However, proposal for Environmental Clearance of Rolling Mill will be submitted shortly.
After hearing the industry, officer of the Board and considering background of the case and material facts on the record, the Chief Environmental Engineer of the Board decided as under:-
1. The industry shall not operate the induction furnace of 8 TPH capacity without obtaining prior Environment Clearance as required under EIA Notification, 2006.
2. The industry shall either apply for Environment Clearance as required under EIA Notification, 2006 or shall obtain exemption letter from SEIAA, within one month.
3. The matter may be referred to Head Office to obtain legal opinion that whether consent to operate at the reduced capacity can be granted in this case, due to non-obtaining of Environment Clearance as required under EIA Notification, 2006.
