It is intimated that the industry is small scale red category unit and was earlier granted consent to operates under Water Act, 1974 and under Air Act, 1981 both valid upto 30/06/2028 for Phosphating on wire rod @ 20 T/day wire drawing on job basis @ 24.5 T/day.
Now, the industry has applied for varied of consent to operate under Water Act, 1974 & Air Act, 1981 for increased production of Phosphating on wire rod from 20 TPD to 40 TPD.
The industry has increased production from earlier granted consent without obtaining 'Consent to Establish' (NOC for expansion) as required under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The industry has signed fresh agreement with CETP (M/s Fertichem Plant Shakti Agro Pvt. LTd., Village Raiyan, Ludhiana) @ 30000 Ltr/month for lifting of trade effluent generated from process for HCL related effluent, which has been increased from 5000 Ltr/month without NOC of the Board and agreement with re-processors (M/s SKIFAC Pvt. Ltd.,) @ 40000 Ltr/month for lifting of spent acid generated from process related to H2SO4. The industry has completely replaced the HCL with sulphuric acid and has cancelled the agreement made with CETP operator earlier.
The industry has not submited the cancellation of old agreements made with M/s Krishna Agro Chem and M/s JBR Technologies Ltd. Ludhiana .
The industry has not submitted acid purchase bills as the industry is using sulphuric acid as raw material.
The industry has not submitted the compliance report of NOC conditions in annotated form if would has been obtained by the industry
In view of above, it is recommended that show cause notice for refusal of consent to operate under the Water Act, 1974 & Air Act, 1981 may be issued to the industry with hearing at ZO level, please.
