RO has reported that earlier, the industry was granted consent to operate under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/TRT/2023/21577925 dated 26/05/2023 valid up to 31/03/2024 and consent to operate under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/TRT/2023/21576906 dated 26/05/2023 dated 31/03/2024 under the name and stye of M/s GVK Power (goindwal Sahib) Limited, Kapurthala Road, Near Goindwal Sahib, Tarn Taran. Now, the industry has applied for fresh consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 under the name and style of M/s GVK Power (Goindwal Sahib) Limited. (Subsidiary of Guru Amar Das Thermal Power Limited (GATPL), PSPCL) Kapurthala road, Near Goindwal Sahib TARN TARAN with requisite documents. Detail of the case are us under: - 1. The industry has submitted CA certificate dated 31.12.2023, with value of gross fixed assets as Rs. 4460.14 Crores. The industry has deposited Rs. 1440000/- vide UTR No. IBKL240226676214 dated 26.02.2024 under Water Act, 1974, Rs. 1440500/- (including Rs. 500/- as application form fee) vide UTR No. IBKL240226676213 dated 26.02.2024 under Air Act 1981, Rs. 1400/- vide UTR No. N061242909398955 dated 01.03.2024 as NOC regularization fee., which it is adequate upto 31.03.2025 under both acts.
2. The industry has submitted compliance report of previous consent granted under both Acts.
3. The industry has submitted a copy of certified true copy of the extraction of resolution passed at the 08th meeting of monitoring committee of GVK Power Limited held on 22.12.2023. The relevant extract of the resolution submitted by the industry is given as under:- "RESOLVED THAT pursuant to (1) applicable provisions of the Companies Act, 2013, the Companies (Appointment and Qualification of Directors) Rules, 2014, the Companies (Meetings of Board and its Powers) Rules, 2014 and the other applicable laws for the time being in force, as may be amended from time to time; (ii) the Memorandum of Association and Articles of Association of GVK Power (Goindwal Sahib) Limited; (iii) Ministry of Corporate Affairs General Circular No. IBC/01/2017 dated 25 October, 2017; (iv) the terms of Resolution Plan dated June 28, 2023, as revised and updated on November 20, 2023 ("Resolution Plan"), submitted by the M/s Punjab State Power Corporation Limited ("Resolution Applicant") for the Company as approved by the Hon'ble National Company Law Tribunal Hyderabad Bench, vide it order dated December 22, 2023, ("Plan Approval Order"); (v) the consent letter in Form DIR-2 along with the statutory declarations required under the Companies Act, 2013, the Companies (Appointment and Qualification of Directors) Rules, 2014, the Companies (Meetings of Board and its Powers) Rules, 2014, Mr. Parmjeet Singh (DIN: 06473194), be and is hereby appointed as a director of the Company with Immediate effect i.e. effective from February 06, 2024."
4. The air emission and effluent samples of the industry were collected by the Board on 26.10.2023 and as per analysis report issued from Zonal Lab, Jalandhar vide 2958-60 dated 03.11.2023 the parameter of particulate matter of 02 no. boilers @ 865 TPH is 32 mg/nm3 each and as per effluent analysis report issued by the Zonal Lab Jalandhar vide letter no. 2987-89 dated 07.11.2023 the parameters i.e pH = 7.6, TSS BDL, TDS 332, COD 9, BOD & O&G is BDL at outlet of ETP. The parameters i.e pH = 8.0, TSS 13, TDS 217, COD 135, BOD 26 and O&G is BDL at outlet of STP. As per analysis reports the industry is complying with the standards prescribed by the Board. The industry has already been visited by officers of the Board 01.04.2024 and observed as under: -
1. The industry is Large Scale Red Category Unit.
2. During visit, it was observed that the industry was in operation with one no. boiler of capacity 864 TPH with coal as fuel. ESP has provided as APCD to both the plants with adequate stack height of approx. 275 meter from ground level. During visit representative of the industry informed that the industry is now taken over by PSPCL authorities and thus process of tendering regarding the procurement of bio-mass pellets (5 % of total coal consumption) to used in the boiler will be considered later on.
3. The STP installed by the industry for treatment of domestic effluent generated from residential colony was also in operation.
4. Effluent treatment plant installed by the industry for treatment/neutralization of reject water of DM plant (Demineralization plant) was in operation consisting of components, collection cum equalization tank – neutralization tank – aeration tank – filter – outlet.
5. The industry has already installed OCEMS and the same has been connected to the PPCB server.
6. The industry has maintained record of operation of STP, ETP as well as APCD.
7. The industry has developed adequate green belt in its premises.
8. The industry has submitted compliance of the condition of Environment Clearance granted to it and has submitted quarterly compliance regarding the fly ash & pond Ash disposal.
9. The industry is complying with provisions of Water Act, 1974 and Air Act, 1981. The industry falls in Red category in large-scale sector and competency to decide the case lies with Worthy Chairman of the Board.
RO has recommended that the consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry up to 31/03/2025 under the new name with usual conditions.
Keeping in view of above, it is recommended that the consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry up to 31/03/2025 under the new name with usual conditions.
