The construction project is covered under small scale orange category as per investment. The project proponent has applied for 'Consent to establish' (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through OCMMS……………….
The project proponent has submitted layout plan approved by the Senior Town Planner, Ludhiana vide no. 220 STP(L)/LA-23 dated 12.02.2024, as per which the proposal site has total area of 19.4062 acres for setting up of residential colony namely "Anand Enclave Block-E". It is a residential colony with plotting only and the project as per proposal is not covered under the EIA notification 2006.
The project proponent has deposited NOC fee, which is adequate for one year…………………...
The site of the proposed project was visited by the AEE of RO on 27.03.2024 and it was observed as under:-
1. The project is located at Village Lalton Kalan, Pakhowal Road, Ludhiana.
2. The project shall have 188 residential plots in a 19.4062 acres.
3. As per the approved layout plan, the total proposed area of project is 19.4062 acres (less than 50 ha). The project is being developed in a plotting manner and after considering the FAR the gross built-up area after the completion of the construction of all residential houses, may come out to be 82736.475 sqm.
4. As per the schedule of the EIA notification 2006, at point 8 (b) the township and area development projects covering an area ≥ 50 ha and or built up area ≥1,50,000 sq mtrs requires Environment Clearance from the concerned authority. But as per the MoEF vide its letter no 205 dated 15.04.2019 it is clarified that the projects with a land area of less than 50 ha but a built-up area of more than 20,000 Sqm may be appraised as per provisions of Schedule 8(a) of the EIA Notification2006 as amended from time to time. The Board vide its letter no. 10949 dated 09.05.2023 has sought a clarification from the Joint Director MoEF, Chandigarh on this ambiguity and the reply of the same is awaited.
5. The fresh water requirement of the project shall be met through tubewell, the total proposed fresh water requirement of the project will be 150 KLD. The total sewage generation from the project shall be 140 KLD.
6. As per the feasibility report submitted by the project proponent, the project proponent has proposed to install STP of capacity 150 KLD for treatment of domestic effluent to be generated from the project. The components of the proposed STP shall be screen chamber, Oil & grease chamber, sewage collection tank, MBBR reactor I&II, secondary tube settler, filter feed tank, pressure sand filters, activated carbon filter, Hypo dosing system and sludge handling system. The STP is principally adequate.
7. The project proponent has proposed to develop green area @ 8745.34 sq Yard (1.80 acres). Around 140 KLD of sewage after its full completion and occupancy , out of which it shall be utilising around 50 KLD for back flushing and rest 90 around KLD shall be used for irrigation in an green area of 1.8 acres. The treated effluent will be used for Flushing Purpose and and excess treated water for onto land for Green Area. The green area is principally adequate.
8. The construction status of the project is as below:
a. The project proponent has provided boundary wall along the project site.
b. The work regarding leveling of roads etc. was being carried out.
c. No occupancy has been taken place at site and no house has been constructed till date.
d. As per the boundary limits site shown by the representative of the promoter company during the visit, there is no MAH industry/cement plant/ grinding unit/ rice sheller/ saila plan/ stone crushing/ screening cum washing unit/ hot mix plant/ brick kiln within a radius of 500 m from the boundary of the proposed site of the project. As such, the site of the project is conforming to the sitting guidelines laid down by the Govt. of Punjab, Department of Science Technology and Environment vide order dated 25.07.2008 as amended on 30.10.2009.
9. About 326 kg/day of solid waste will be generated after the full occupancy of project. It has proposed to composte the solid waste through the use of Mechanical Composter. Further, it has proposed that the recyclable waste shall be sold to resellers and the Inert waste shall be dumped to authorized MC dumping site.
10. The project proponent has proposed to install a 01 no. D.G. set of capacity 1000 KVA equipped with canopy and adequate stack height.
11. The project is fulfilling the sitting guidelines laid down by the Govt. of Punjab, Department of Science Technology and Environment vide order dated 25.07.2008 as amended on 30.10.2009 for construction projects.
As proposed by Regional Office, may, if approved:
1. Consent to Establish (NOC) under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted for one year to the subject cited project with suitable conditions and special conditions that:-
a. The Consent to Establish (NOC) is granted to the project proponent for the layout plan approved by the Senior Town Planner, Ludhiana vide no. 220 STP(L)/LA-23 dated 12.02.2024, as per which the proposal site has total area of 19.4062 acres for setting up of residential colony namely "Anand Enclave Block-E".
b. The project proponent shall obtained Environmental clearance from the SEEIA/MoEF&CC as and when required before commencing the construction.
c. The project proponent shall obtain permission from CGWA for abstraction of ground water (if required) and shall comply with the guidelines issued by it from time to time.
d. The project proponent shall develop adequate green area for utilization of treated effluent as per the Karnal Technology.
e. The project proponent shall comply with the provisions of Solid waste management Rules, 2016.
f. The project proponent shall comply with the provisions of the Noise Pollution (Regulation & Control) Rules 2000.
g. The project proponent shall ensure compliance to the comprehensive guidelines for the regulation of noise/ sound pollution caused by use of loud speakers, public address system etc. issued by Punjab Government, Deptt. of Science, Technology & Environment vide notification no. 3/100/2013-STP(4)/145 dated 26.02.2014.
h. The industry shall obtain permission from the concerned Department(s) and shall comply with the conditions of relevant permissions obtained by it from other related Departments (if any).
i. The Consent to establish is being issued to the project proponent based upon the undertakings/documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/ project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
j. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the promoter.
