A. It is submitted that the industry is medium scale red category unit and earlier the industry was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/LDH4/2024/24033441 dated 25.01.2024, upto 31.03.2024 for production of Finishing Of Fabric @ 14 Metric Tonnes/Day Dyeing Of Pc/Cotton @ 12.3 Metric Tonnes/Day and for discharge of trade effluent @ 1275 KLD and domestic effluent @ 25 KLD into CETP 40 MLD (Focal Point Module).
B. Consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 was granted vide no. CTOA/Renewal/LDH4/2023/21472511 dated 25.04.2023, upto 31.03.2027 for pet coke/rice husk as fuel in its one boiler of capacity 8.8 TPH attached with twin cyclone followed by double stage alkali scrubber as APCD and 03 DG sets of capacities (1x400 KVA, 1x320 KVA & 1x220 KVA) provided with acoustic enclosure alongwith adequate stack height.
C. Now, the industry has applied for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 through OCMMS.
D. The industry has already deposited consent fee Rs. 1,80,000/- vide R.No. N118221934256584 dated 28.04.2022 under Water Act, 1974 against gross value of fixed assets Rs. 1272.77 Lacs and plant & machinery of Rs. 753.22 Lacs as on 30.09.2023. Now, after deducting the penalty fee for late application it is adequate upto 30.06.2026.
E. The industry was given personal hearing before the Chairman of the Board on 12.01.2024 for refusal of consent to operate under the Water Act,1974 in which it was decided that:-
1. Consent to operate under the Water Act,1974 may be granted to the industry upto 31.03.2024 subject to usual conditions.
2. Environmental Engineer,RO-4,Ludhiana shall visit tp carry out re-samplimg and submit report/recommendations accordingly.
F. The industry was visited by the AEE this office on 29.02.2024 and it was observed that:-
1. The industry was in operation during the visit.
2. The industry is engaged in finishing & dyeing of PC/Cotton fabric.
3. The industry has obtained shares of 1300 KLD for CETP 40 MLD.
4. The industry has installed 23 soft flow machines of capacities (02x600 Kg, 03x400 Kg, 05x300 Kg, 09x250 Kg, 03x100 Kg & 02x15 Kg) for dyeing purposes.
5. The industry has not submitted undertaking regarding the source of supply and disposal of effluent into PDA sewer and dismantled M.C. sewer connection.
6. The industry has installed a digital flow meter at the source of water supply and final outlet leading to CETP. The industry has installed SCADA system for connectivity with CETP server.
7. The industry has made arrangement for recovery & reuse of cooling water and steam condensate. The cooling water is reused in the process and steam condensate is being reused as boiler feed water.
8. It is pertinent to mention here that the untreated dyeing effluent samples from the industry was lastly collected on 29.02.2024 and per the analysis repot ph=9.5 and TDS= 6031 mg/l. The TDS is found to be beyond on higher side as per the inlet designed parameters of the CETP, which may effect its overall performance.
9. Also the PDA (Focal Point Module), 40 MLD was issued notice u/s 33-A of the Water Act, 1974 with the opportunity of personal hearing on 09.08.2023, wherein it was decided that all the members unit shall get a third party audit from an institute of repute (IOR) and submit certificate regarding the sources of abstraction of water, numbers of outlet for disposal of effluent and capacity of machinery viz-a-viz shares obtained by it, within one month. The industry has not carried out third-party audits from the Institute of Repute (IOR) till date.
10. Further, it is intimated that the inlet and outlet parameters of the CETP 40 MLD are being monitored monthly by the Board and the TDS parameter is continuously found beyond the design parameters of CETP at the inlet as well as outlet.
11. The industry has installed one boilers of capacity 8.8 TPH with twin cyclone separator followed by two stage alkali scrubber as APCD and adequate stack height.
12. The stack emission sample were lastly collected by the Board on 28.02.2024 for porthole of the stack of boiler 8 TPH after APCD and as per the analysis report received from Zonal Lab., Ludhiana vide letter endst no. 739-41 dated 04.03.2024, concentration of SPM is found to be 288 mg/Nm3 against the prescribed limit 500 mg/Nm3, which is within the prescribed limit of the Board.
13. The industry has installed 03 D.G sets of capacities one of 320 KVA, 220 KVA, these are kept in acoustic enclosure and one of 400 KVA equipped with canopy and these are provided adequate stack height.
14. The industry has submitted letter from PDA wherein it has been mentioned that the PDA certificate that subject cited unit is our member. Their Demat account is opened and transfer of the shares under process.
15. The industry has submitted layout plan regarding the pipeline, source of water abstraction and disposal of effluent into PDA. It also contains the details of sewer connection disconnected with MCL prior to the PDA sewer line, which was checked during visit and it was found disconnected.
16. The industry has submitted a certificate from MCL vide letter no. 1308 dated 11.09.2023, wherein it has been mentioned that there is no active sewer connection of the industry with the MCL and all the sewer connection are closed.
In view of above, it is proposed that the industry may be issued SCN for refusal of Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 .
