The project proponent was issued show cause notice for violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 alongwith an opportunity of personal hearing before the Chief Environmental Engineer of the Board on 14.02.2024 and it was decided as under:
1. The Proposed Direction u/s 33-A Of The Water (Prevention And Control Of Pollution) Act, 1974 Shall Be Confirmed For Closure Of The Unit.
2. Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar Shall Keep The Strict Vigil On The Activities On The Industry W.R.T The Operation Of The Unit.
3. A Copy Of Directions To Be Issued U/S 33-A Of The Water (Prevention And Control Of Pollution) Act, 1974 Shall Be Confirmed For Closure Of The Unit To The Industry Be Sent To Excise And Taxation Officer-Cum-State Tax Officer, Mohali To Cancel GST Registration No. 03CVUPG4759B1ZI Issued To The Industry Namely M/S Gagandeep Industries, Plot No. 48, Vill. Bhagwanpur, Barwala Road, Tehsil Dera Bassi, Distt. SAS Nagar As The Industry Is Not Complying With The Environment Laws.
Accordingly, PSPCL authorities were directed to disconnect the electricity supply available with the industry vide ZO letter no. 12589-90 dated 06.03.2024 and this office letter no. 1082 dated 12.03.2024.
In compliance to the said directions, PSPCL has disconnected the electric supply available to the industry. A copy of TDCO no. 100020616041 dated 14.03.2023.
A compliance report in this regard was also sent to ZO on 18.03.2024 through e-office file no. 213215.
Present application:
Now, the industry has applied for obtaining ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for operation of the industrial unit engaged in Electroplating of NUT, Bolt & Screw @ 400 Kgs/day as products, along with requisite document.
The industry has deposited Rs. 3800/- vide R no. 622585987 dated 21.02.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 2200/- vide R. no. 719227040 dated 21.02.2024 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 30.06.2025 (Considering Penalty fee and NOC regularization fee) for both the Acts against the assets of Rs. 1.29 lakhs on 16.02.2024.
Manufacturing process:
Hardening Cleaning (caustic, acid) Washing Plating (zinc- acid plating) Passivation (Blue dip using trivalent) Washing Drying Packing.
Suitability of Site:
The industry has submitted a copy of land use classification letter issued by DTP SAS vide letter no. 222 dated 21.02.2024, wherein, it has mentioned as under:
“ਹਵਾਲੇ ਤਹਿਤ ਪ੍ਰਤੀ ਬੇਨਤੀ ਨਾਲ ਨੱਥੀ ਕੀਤੇ ਦਸਤਾਵੇਜ਼ਾਂ ਦੇ ਸਨਮੁੱਖ ਸੂਚਿਤ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਕਿ ਇਹ ਸਾਇਟ ਪਿੰਡ ਭਗਵਾਨਪੁਰ (ਹ.ਬ. ਨੰ. 199) ਤਹਿ. ਡੇਰਾਬੱਸੀ, ਜ਼ਿਲ੍ਹਾਂ ਐਸ.ਏ.ਐਸ ਨਗਰ ਦੇ ਖਸਰਾ ਨੰਬਰ 167/3 ਵਿੱਚੋ ਹਿੱਸਾ 06 ਬਿਸਵੇ 17 ਬਿਸਵਾਸੀ ਵਿੱਚ ਪੈਂਦੀ ਹੈ। ਇਸ ਦਫਤਰ ਵਿੱਚ ਉਪਲਬਧ ਡਰਾਇੰਗ Greater Mohali Area Development Regional Plan, Drg. No. 1900-DTP(S) ਮਿਤੀ 12.11.2008 ਦੇ ਅਨੁਸਾਰ ਇਹ ਰਕਬਾ F.E.Z ਅਧਿਨ ਪੈਂਦਾ ਹੈ। ਜੇਕਰ ਆਪ ਵੱਲੋ ਮੋਕੇ ਤੇ ਕੋਈ ਉਸਾਰੀ ਕੀਤੀ ਗਈ ਹੈ ਤਾਂ ਸਾਈਟ ਵਿੱਚ ਕਿਸੇ ਵੀ ਤਰ੍ਹਾਂ ਦੀ ਐਕਟੀਵੀਟੀ ਕਰਨ ਤੋ ਪਹਿਲਾ ਉਸ ਸਬੰਧੀ ਮੰਨਜੂਰੀ ਇਸ ਵਿਭਾਗ ਅਤੇ ਹੋਰ ਵਿਭਾਗਾ ਤੋਂ ਪ੍ਰਾਪਤ ਕਰਨ ਦੇ ਪਾੰਬਦ ਹੋਵੇਗੇ। ਉਪਰੋਕਤ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਆਪ ਵੱਲੋ ਪੇਸ਼ ਕੀਤੇ ਗਏ ਦਸਤਾਵੇਜਾਂ ਦੇ ਸਨਮੁੱਖ ਹੈ।
ਇਸ ਪੱਤਰ ਨੂੰ ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਦਾ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਸਰਟੀਫਿਕੈਂਟ ਹੀ ਸਮਝਿਆ ਜਾਵੇ। ਇਸ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਸੀ.ਐਲ.ਯੂ ਦੀ ਪ੍ਰਵਾਨਗੀ ਜਾ ਕਿਸੇ ਕਿਸਮ ਦਾ ਐਨ.ਓ.ਸੀ ਨਾ ਸਮਝਿਆ ਜਾਵੇ।”
As such, the site of the industry is located in F.E.Z Zone. Thus, the site of the unit is suitable.
The industry vide online reply dated 04.04.2024 has uploaded a copy of rent deed dated 20.12.2023 executed between Sh. Joga Singh and M/s Gagandeep Industries, for khasra no. 167/3 which is valid upto 19.11.2024.
The industry has also submitted a copy of building plan signed by Er. Sushil Kumar Garg, Competent Person of Director of Factories of Punjab.
The industry has submitted a copy of agreement executed with M/s Bantech Water Pvt. Ltd., Kurali vide dated 23.03.2024 for lifting trade effluent @ 2000 ltr.
Visit:
Accordingly, the industry was visited by AEE of this office on 28.03.2024 and during visit, it was observed as under:
1. The industry was not in operation during the visit and the electric connection was found to be disconnected.
2. The industry will be carrying out electroplating of NUT, Bolt & Screw @ 400 Kgs/day.
3. The industry has now installed environmental data board at its entrance.
4. The industry has installed one no. tubewell in its premise and flow meter is yet to be installed with the same.
5. The industry has constructed septic tank in its premises, after passing through which, domestic effluent shall be discharged onto land for plantation along the boundary wall.
6. The industry has installed 01 no. HCL dipping tank and 04 no. barrels & 01 no. tank for zinc plating of screws/fasteners of different sizes.
7. The industry has constructed 01 no. of underground storage tanks of capacity 4000 ltr. each for storage of trade effluent being generated from the process.
8. The industry has now made an agreement with the operator of CETP- M/s Bantech Water Pvt. Ltd., Kurali vide dated 23.03.2024 for lifting trade effluent @ 2000 ltr. the representative of the industry informed that they have now made an agreement with M/s Bantech and shall now get the trade effluent lifted from the operator of the said CETP only.
9. The industry has now cleaned the entire premises of the unit and no stagnation of wastewater was found in the open area.
10. The industry has not installed any DG set in its premises.
From above, it is clear that the industry has now complied with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Recommendations:
In view of above, if may approved, following actions may be taken:
A. The industry may be granted ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, for six months with usual conditions & with following special conditions:
1. The industry shall maintain proper record of generated, collection and disposal of trade effluent at the site, at all times.
2. The industry shall get its trade effluent lifted from the operator of authorized CETP only under proper manifest system.
3. The industry shall not discharge the effluent into any drain/choe/nallah, in any case.
4. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
5. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
6. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
7. The ‘consent to operate’ is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
8. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
B. PSPCL may be directed to temporarily restore the electric connection of the industry for six months.
