Subject: - Proceedings of the personal hearing given before the Senior Environmental Engineer (ZP-1) on 03.04.2024 w.r.t show cause notice for refusal of the consent to establish (NOC) applied by the industry under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981.

At the outset, Environmental Engineer, ZP-1 brought out that: -
The industry has applied for obtaining consent to establish / (NOC) from Pollution Angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Recycled Plastic Board @ 13 Metric Ton/Day by using Rigid Plastic @ 1.0 Metric Ton/Day, Flexible Plastic @ 7.0 Ton/Day and Multilayered Plastic @ 2.0 Metric Ton/Day, as raw material alongwith requisite documents and fee.
The project site was visited by officer Regional Office, Patiala on 20.03.2024 and contacted Sh. Rajinder Kumar and Sh. Jaswant representatives at site. During visit, it was observed as under: -
1. The project falls in Focal Point, Patiala.
2. The building of the unit has already been constructed. Machinery such as hot & cold press, frames, thermopack / boiler were under construction / installation.
3. It was observed that the thermopack alongwith stack is being installed in an adjoining land beyond the boundary of C-16 and not in the location shown in the site plan. The total width of the plot has shown in the site plan is 59 feet whereas, the project proponent has included adjoining land beyond 59 feet width and said land is not part of the NOC application. Also, the raw material and plastic waste was found lying stored in the adjoining area with seems to be part of the unit but no mention is there in the application from.
The industry has installed building and is in the process of installing plant and machinery without obtaining NOC from the Board. Further, it has made addition in the land area by including adjoining industrial land which is not part of the application and not shown in the site plan submitted along the application.
The industry is not complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 intentionally and deliberately.
It has been proposed to refuse the consent to establish (NOC) applied by the industry under the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 after affording an opportunity of show cause cum personal hearing.
Therefore, show cause notice for refusal of the consent to establish (NOC) applied by the industry under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 issued to the industry vide Board's letter no. 12943 dated 26/03/2024 with an opportunity to appear in person before the Senior Environmental Engineer of the Board in his office Punjab Pollution Control Board, Vatavarn Bhawan, Nabha Road, Patiala on 03.04.2024 at 11.00 AM.
The representative of the industry attended the hearing submitted that the industry has already applied to convert the activity to manufacture plastic board items in the existing plot to GMDIC, Patiala. He further informed that the similar practice is with the other plots in the Focal Point that GMDIC converts the one business activity to the other on the request of the plot owner. He informed that the thermopack installed in the adjoining land shall be shifted in its premises for which consent to establish (NOC) has been applied and will carry out any activity within the boundary of the plot only. He submitted its written reply during the hearing which was taken on the record.
After hearing the officer of the Board, representative of industry and material facts on the record, the Senior Environmental Engineer (ZP-1) decided as under: -
1. The industry shall get its change in nature of business certificate from the Competent Authority and submit to the Board at the time for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981.
2. The industry shall carry out its activity within its premises for which it has applied for obtaining consent to establish / NOC to the Board.
3. The industry shall not operate its unit without obtaining consents to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 of the Board.
4. The industry shall surrender its NOC, if fails to obtain the certificate as mentioned at sr. no. 1 from the Competent Authority and the Board shall not responsible for any kind of financial loss to be incurred to the industry.
5. Environmental Engineer, Regional Office, Patiala shall comment on the reply submitted by the industry, send its recommendations to decide the application, within 07 days.
6. Further action shall be taken after the report from the Regional Office, Patiala.
If approved, proceedings may be conveyed to the industry as well as Environmental Engineer, Regional Office, Patiala for compliance. |
