RO has reported that earlier, the industry was granted consent to operate under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/ASR/2021/15609553 dated 10/06/2021 valid up to 31/03/2024. And Under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/ASR/2021/15397390 dated 18/06/2021 dated 31/03/2024 It is further intimated that the industry was visited on 28.02.2023 by officer of this office and it was observed as under:-
1. The industry was in operation.
2. The ETP installed by the industry was also in operation at the time of visit and effluent was being discharged onto land for plantation after treatment.
3. The effluent samples of the industry were collected and as per the analysis report received from Zonal Lab, Jalandhar, the analyzed parameters i.e. BOD=130 mg/l & TSS=116 mg/l were found beyond the prescribed limits of the Board. Accordingly the industry was issued show cause notice to file reply in writing for revocation of consent to operate granted under Water (Prevention & Control of Pollution) Act, 1974 vide this office letter no. 1075-76 dated 24.04.2023. However, the Project Proponent has failed to take any cognizance of the notice and completely ignored the Show Cause Notice of the Board, as no reply has been received in this office so far. As the industry is violating various provisions of the Water (Prevention & Control of Pollution) Act, 1974. It has now been proposed to revoke ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act 1974 as amended in 1988 with an opportunity of personal hearing before Member Secretary of the Board on 17/10/2023. The representative of the industry submitted during hearing that due to some mechanical fault in the aerator which affects the treatment of effluent. The results of parameters i.e. BOD and TSS are slightly higher than the prescribed limits. The Board can visit any time to the industry to analyze the effluent samples. After hearing the officers of the Board, representative of the industry and facts on the record file, the Member Secretary of the Board decided as under:-
1. The industry shall comply with the CPCB guidelines for operation of biological components.
2. Regional Office shall visit the industry in the first week of November to check the maintenance and working of ETP as per CPCB guidelines, storage of molasses and plantation area.
3. Regional Office shall collect the effluent and emission samples after the start of crushing season. Now, the industry has applied for renewal of consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 with requisite documents. Detail of the case are us under: -
1. The industry has submitted CA certificate dated 10.01.2024, with value of gross fixed assets as Rs. 487.18 Lakhs. The industry has deposited Rs. 190800/- vide UTR No. N088242955871563 dated 28.03.2024 as consent fee under Water Act, 1974, Rs. 190800/- vide UTR No. N088242955861072 dated 28.03.2024 as consent fee under Air Act, 1981, which it is adequate upto 31.03.2027 under both acts.
2. The industry has submitted compliance report of previous consents granted under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
3. The air emission and effluent samples of the industry were collected by the Board on 09.02.2024 and as per analysis report issued from Zonal Lab, Jalandhar vide 466-68 dated 15.02.2024 the parameter of particulate matter of 02 no. boilers @ 32 TPH (common stack) is 90 mg/nm3 and as per effluent analysis report issued by the Zonal Lab Jalandhar vide letter no. 542-44 dated 19.02.2024 the parameters i.e pH = 7.6, TSS 32, TDS 616, COD 142, BOD 38 and O&G is 4.1. As per analysis reports the industry is complying with the standards prescribed by the Board. To verify the compliance the industry was visited by undersigned along with EE on 09/02/2024 and following observations were made: -
1. The industry was in operation and was engaged in production of sugar from sugarcane.
2. The industry has installed two no. boilers of capacity 32 TPH, both provided with wet scrubber as APCD separately and with common stack.
3. The industry has installed one no. D G set of capacity 300KVA, which is with canopy.
4. During visit the ETP installed by the industry was in operation and has installed EMF at the outlet of ETP.
5. The industry has developed approximately 13 acres of plantation area and treated water is being discharged onto land for plantation in that area. The condition of plantation area found good.
6. The industry has maintained record of generation/storage of molasses being generated from the process. The industry is complying with the condition of consent granted under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and also complying with the decisions of personal hearing dated 17.10.2023.
RO has recommended that renewal of consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry up to 31/03/2027 with usual conditions.
Keeping in view of above, it is recommended that renewal of consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry up to 31/03/2027 with usual conditions along with special conditions as under:-
(i) PP may also develop the vermicomposting/composting to manage the biodegradable solid waste.
PP shall not throw, burn or bury any solid wastes in open, outside premises or in drain / water bodies.
(ii) PP shall perform / promote its Corporate Environment Responsibility (CER) activities as well as
use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic (See attached
banner/circular).
(iii) PP shall ensure that there are no usages of single use plastic- thermocol disposable items such as
water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material
made of plastic-thermocol or any other non-biodegradable material in the premises.
(iv) The project proponent shall properly handle and manage the solid wastages as per the provisions
of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an
environmentally sound manner.
(v) The industry shall explore the possibility of usage of paddy straw @5-10% along with Bagasse as a fuel
in the boiler.
