It is submitted that the industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/LDH1/2018/7964181 dated 08/08/2018 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH1/2018/7964360 dated 08/08/2018 both valid upto 30/06/2023 for the manufacturing of Drawing of MS Round @ 4 Metric Tonnes/Day.
Earlier, the industry was engaged in pickling process. But, now is engaged in manufacturing of Nuts @ 200 kgs/day. It has sold its Jindi/Pickling machinery. It has submitted as undertaking regarding the same, which is reproduced as under:
“Due to financial crisis, we have close down our water pollution process in the month of March, 2023 and also cancelled agreement with re-processor. Further, we have installed old heating furnace of capacity 250 Kgs, Power presses, header, Lathe machine to manufacture Nut @ 200 Kgs/day.”
Therefore, the subject cited industry has applied for obtaining varied 'Consent to Operate' under the Water Act, 1974 and Air Act, 1981 with requisite documents under orange category. The industry has deposited consent fee against the un-depreciated fixed assets of Rs. 6.96 Lacs as on 31/03/2023 as per CA Certificate dated 23/02/2024, which is adequate upto 30/09/2028 under the both acts, as per Board's Office Order dated 29/10/2018 after deducting NOC regularization fee and penalty charges 100 %.
The industry was visited by undersigned on 05.04.2024 and it was observed as under:
1. The industry was in operation & engaged in the production of Nut @ 200 Kgs/day by using raw material as MS Pipe / Bar @ 210 Kgs/day.
2. The industry has installed 1 no. FO based heating furnace of capacity 250 kgs with adequate stack height, Power press, header, Lathe machine.
3. There is no generation of trade effluent and domestic effluent is being discharged into sewer.
4. It has not installed any boiler, furnace or DG set.
5. The industry is complying with all the provisions of Water Act, 1974 & Air Act 1981.
In the subject cited case, the industry has mentioned ground water extraction @ 0.5 KLD. Considering 25 working days per month, ground water extraction will be 12.5 KL/month, which is less than 300 KL/month.
It is therefore recommended that 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30/09/2028 with suitable conditions as per policy of the Board.
