The Following were present: On behalf of Punjab Pollution Control Board Er. Pardeep Balu, Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana On behalf of the industry Sh. Ashok Gupta, Representative The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry was found violating during visit in Giaspura Gas Leak Case. The Board has issued directions for closure of the industry and Environmental Compensation of Rs. 1.50 Lacs was imposed on the industry. The electric connection available to the industry has been disconnected. But the industry has not deposited Environmental Compensation of Rs. 1.50 Lacs. The industry had earlier applied for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 two times but the application was returned being incomplete due to non-deposition of EC. The industry has now again applied for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974. The industry has not deposited Environmental Compensation of Rs. 1.50 Lacs earlier imposed on it. The industry was issued show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 with hearing before the Senior Environmental Engineer of the Board on 19.03.2024. But, no one from industry attended the hearing. The industry was issued show cause notice for revocation / cancellation of consent to operate granted under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 05.04.2024. Sh. Ashok Gupta, Representative of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that lifting water to JBR attracts a lower payment obligation as compared to not lifting. JBR levies a minimum charge for not lifting the committed water. The said unit is not connected to the sewer line by any means. The storage tank is more than 2000 litres. The unit is a very small unit and he requested to give time to present records of the industry. They did not lift waters in April 2023, because of lack of work. They have removed Electroplating plant, closed wet operations, removed machinery from the premises and reapplied for consent under green category. He submitted that they we are not in the financial condition to pay off the EC of Rs. 1.50 L. He requested to reconsider its position and to cancel the EC imposed, process their file and issue orders for reconnection of our electricity supply. He further submitted that the Board has snatched our right to a fair earning, respectable life and a decent fodder and has destroyed our name in the market. After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:- 1. The industry is again requested to deposit Environmental Compensation of Rs. 1.50 Lacs earlier imposed on it by Competent Authority of the Board, immediately. 2. The Environmental Engineer Regional Office shall pursue the industry to deposit Environmental Compensation of Rs. 1.50 Lacs earlier imposed on it and send further recommendations in the matter after 07 days.
