It is submitted that the subject cited industry is a small scale orange category unit and applied for obtaining fresh consent to operate under the Water Act, 1974 and Air Act, 1981 with requisite documents. The industry has deposited consent fee against the un-depreciated fixed assets of Rs. 22.62 Lacs as on 25/03/2024 as per CA Certificate dated 27/03/2024, which is adequate upto 30/09/2030 under Water Act, 1974 and Air Act, 1981, as per Board's Office Order dated 07/08/2020 after deducting NOC Regularization fee (under VDS scheme).
The industry was visited by the undersigned on 02.04.2024 and it was observed as under:
1. The industry was in operation.
2. The industry is engaged in manufacturing of Nuts & Bolts for Auto / Agriculture/ Construction @ 1.75 TPD by using raw material as MS Rounds @ 2 TPD.
3. The manufacturing process is Raw material Cutting on power press – Facing & Chamfering on Turning Machine – Reducing – Edge heating on furnace – Head forging on friction forging – Trimming/Flash cutting on Power press – Under cut on SPM – Grinding on Centerless – Threading on Hydraulic machine.
4. It has installed 1 no. FO based forging furnace, cutting machine, automatic addas, reducing machine, header, grinder, power presses and friction screw machines.
5. Domestic effluent generated by the industry is discharged into sewer.
6. The industry has not installed any DG set.
7. The industry is located in the Industrial Focal Point, Ludhiana as per Master Plan of Ludhiana.
8. The industry has submitted building plan dated 04.03.2024 prepared by Sh. Lokinder Bansal approved Architect from Director of Factories, Punjab.
Applicability of Factories Act, 1948:
As per policy of the Board, it is clearly mentioned that the Punjab Pollution Control Board will decide the applications for consent to establish (NOC) of all industries to be set up in designated/ approved areas such as Industrial Area/ Industrial Estate / Industrial Focal Point/ Approved Industrial Park / Industrial Zone of the Master Plan. However, the Site Clearance u/s 41 (A) of the Factories Act, 1948 will not be necessary for grant of consent to establish/ operate/ authorization by the Board. It is submitted that the subject cited industry is located in Industrial zone as per Master Plan (2010-2031) of Ludhiana. Therefore, there is no requirement of Site Clearance u/s 41 (A) of the Factories Act, 1948.
Applicability of EIA notification dated 14/09/2006
Not applicable.
In the subject cited case, the industry has mentioned ground water extraction @ 2.0 KLD. Considering 25 working days per month, ground water extraction will be 50 KL/month, which is less than 300 KL/month.
The industry has submitted compliance of NOC conditions and undersigned has verified the same (attached herewith).
It is therefore recommended that 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30/09/2030 with suitable conditions as per policy of the Board.
