File Note: The industry was issued notice u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of personal hearing before Chief Environmental Engineer (B) on 20.02.2024 wherein it was decided as under: (i) The brick kiln will apply for obtaining consents to operate under the provisions of Water Act, 1974 & Air Act, 1981, within 7 days. (ii) The brick kiln will not use any agro waste / bio-mass residue as fuel in loose form in compliance to the Board's office memo dated 22.11.2022 and will get the loose bio-mass / agricultural waste stored in its premises lifted, if any, within 10 days. (iii) The brick kiln will ensure to replace atleast 20% coal with the paddy straw pallets in compliance to the notification dated 04.11.2022 issued by the Govt. of Punjab, Department of Science, Technology & Environment. (iv) The brick kiln will make an agreement with the paddy straw based pallet manufacturing unit(s) regarding procurement of paddy straw pallets and will submit the said agreement to the Regional Office, Bathinda of the Board, within 10 days (v) The Environmental Engineer, Regional Office, Bathinda shall visit the brick kiln immediately and process the applications to be applied under Water Act, 1974 & Air Act, 1981 on merits. During visit on 19.3.2019 the BKO was being fired using coal as fuel and no unauthorized fuel was observed at site. The PP has not started using pallets as replacement (20%) with coal to fire the BKO. The BKO has submitted undertaking stating as under: 1. That I am Prop. of M/s Sangam Bricks Company, Village Faridkot Kotli, Distt. Bathinda. 2. That the entries made in the coal register are true and correct and may be taken as a documentary evidence. 3. That the brick kiln was operated with FCBTK technology in the month of April, 2019 to July, 2019 and thereafter the kiln has not been operated till adoption of induced draught Zig Zag technology. 4. That I am depositing the EC of Rs. 1,00,000/- for the month from April, 2019 to July, 2019 and requested to exempt the EC for last 5 months (August, 2019 to December, 2019) because I have operated the brick kiln on 16.12.2019 with induced draught zig-zag technology due to that the team of CSIR-Central Building Research Institute, Roorkee was already visited the brick kiln but the completion certificate have been issued by the CSIR-Central Building Research Institute, Roorkee via drawing no. 19/443 on 30.12.2019. 5. That the brick kiln has been operated by using only coal as a fuel for its operation and no other fuel was used for its operation. 6. The brick kiln has provided adequate sampling facilities to facilitate emission sampling with ladder. The brick kiln has submitted copy of coal register as proof of actual operation of the brick kiln without adopting induced draught zig-zag technology / actual consumption of coal during the period 01.01.2019 to 31.12.2019. As per the coal register the BKO has been operated from April to July 2019 and thereafter re-commissioned from 16.12.2019 however the completion certificate has been issued w.e.f 30.12.2019 for which the PP has submitted that the BKO has been operated with FCBTK technology from April 2019 till July 2019 i.e. 4 months and thereafter re-fired the BKO in Dec 2019 with induced draft technology after verification by service provider. Accordingly, the brick kiln has also deposited Environmental Compensation of Rs. 1,00,000/- through offline in this vide R.no. 11/5508dated 15.03.2024 for period (April2019 tilll July 2019). Considering the above undertaking by the rep of BKO the EC deposited is adequate as the PP cannot convert the BKO in 15 days and get the completion certificate issued. Keeping in view of above, it is recommended that consent to operate under the Water Act, 1974 & Air Act, 1981 may be granted to the brick kiln for production of bricks & tiles @ 30,000 no./day under orange category for a period up to 30.09.2025, subject to the suitable conditions along with the following specific conditions: - a) The Brick Kiln shall replace at least 20 % coal with paddy straw pellets as per directions issued by the Government vide notification dated 4.11.2022 and shall submit agreement with the pallets manufacturing unit within 7 days. b)This consent is granted subject to the orders passed by the Hon'ble High Court for the States of Punjab & Haryana/ Hon'ble National Green Tribunal or Other Judicial Authority in the cases pending or being filed with regard to the operation of brick kilns in the State. c)This consent is granted subject to the performance evaluation of new technology adopted by the brick kilns. d)The BKO will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as raw material for the manufacture of bricks and submit the same, within two months. e)The industry shall comply with code of practice for brick kiln and shall achieve the prescribed standard notified by MOEF & CC. f)The industry shall not generate/ discharge any trade effluent and shall discharge only Domestic Effluent onto land for plantation after passing through septic tank.
