is submitted that the pp was given personal hearing before the CEE, Ludhiana on 02.04.2024, wherein it was decided as under:- 1. Case be referred to RO-4, Ludhiana for commenting on the site suitablility and subsequent recommendations for deciding consent application of the marriage palace. The project proponent has submitted a DTP letter no. 3188 dated 11.10.2012 mentioning that the site falls under LPA Ahmedgarh, Master Plan of the same has yet to be approved. It is pertinent to mention here that section 79 of The Punjab Regional and Town Planning and Development Act, 1995 is reproduced as under: - After the coming into operation of any Master Plan in any area, no person shall use or permit to be used any land or carry out any development in that area otherwise than in conformity with such Master Plan. Provided that the Competent Authority may allow the continuance of any use of any land, for a period not exceeding ten years, upon such terms and conditions as may be provided by regulations made in this behalf for the purpose and to the extent, for and to which it was being used on the date on which such a Master Plan came into operation. Further, Govt of Punjab, Department of Legal and Legislative Affairs vide its notification no. 34-Leg/2016 dated 21.10.2016 has done following amendments which is reproduced as under: - In the Punjab Regional and Town Planning and Development Act, 199, in section 79, in the provisions thereunder, for the words “ten years”, the words “fifteen years” shall be substituted.
As such, as per above notifications, the site is suitable to operate a marriage palace as the industry shall be allowed to operate for minimum 15 years from the date of notification of Master Plan of Ahmedgarh, which is yet to be notified/prepared.
In view of the above, CTO may be granted as recommended above please. |
