It is submitted that the industry is a large scale red category unit and engaged in production of Skimmed Milk Powder @ 25 MTD, Frozen Fruits/Vegetables @ 48 MTD, Pure Ghee @ 15 MTD, Dairy Products @ 16 MTD, Development of Mega Food Industrial Park @ 221213 Sq.m, Electric Power @ 4 MW, Grain Silos @ 4 number, Pasteurized/Flavored Milk @ 85 KLD and R.O Drinking Water @ 100 KLD as products by using Fresh Milk @ 400 KLD, Fruits & Vegetables @ 130 MTD, Cotton/Mustered Sticks/Rice Husk/Wood Chips/Other Bio Mass @ 141 MTD and Water @ 120 KLD as raw material.
The industry was issued show cause notice for refusal of 'consents to operate' under the provisions of Water Act, 1974 & Air Act, 1981 with an opportunity of personal hearing before Hon’ble Chairman of the Board on 11.09.2023, wherein it was decided that:-
1. The industry shall provide sludge filter presses for drying of sludge (in the rainy season), within a period of one month.
2. The industry shall provide compost pits for in-house management of solid waste in compliance to Solid Waste Management Rules, 2016, within one month.
3. Consents to operate under the provisions of the Water Act, 1974 & Air Act, 1981 be granted to the industry upto 31.03.2024 as per the adequacy of consent fees deposited by the industry, subject to the condition that the industry shall ensure the compliance w.r.t. the decision no. 1 & 2 above, within the stipulated time period.
4. Environmental Engineer, Regional Office, Faridkot shall visit the industry, verify the compliance made by it w.r.t. decision no. 1 & 2 above after one month and submit report/recommendations in the matter.
Accordingly, the industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/FZL/2023/21826623 dated 29.10.2023 and the Air Act, 1981 vide no. CTOA/Renewal/FZL/2023/21826612 dated 09.10.2023 with validity upto 31.03.2024, subject to the suitable conditions mentioned therein.
Now, the industry has applied for renewal in validity of consent to operate under the Water Act, 1974 and the Air Act, 1981. Details of the case are as under:-
• The industry has submitted CA certificate showing the value of its gross fixed assets as Rs. 1781.42 Lakhs as on 26.03.2024. The industry has failed to link the consent to operate fee with the application form.
• The industry has submitted sample analysis report from M/s PBTI, Mohali from outlet of ETP dated 28.03.2024. As per analysis report, the results of parameters pH : 8.05, TSS : 19 mg/l, TDS : 917 mg/l, BOD: 6.9 mg/l, COD : 60 mg/l and Oil & Grease : BDL are within the prescribed standards.
To check the compliance the industry was visited by undersigned (AEE) alongwith Environmental Engineer of Regional Office on 05.04.2024 and it was observed as under:-
1) The unit M/s International Mega Food Park Limited was not in operation for any activity due to the legal matter.
2) The sister concern unit M/s Schreiber Dynamix Dairies Pvt. Ltd. was in operation for manufacturing of fruit juice and effluent generated in the process was being forwarded to the common ETP, maintained and looked after by M/s International Mega Food Park Limited.
3) Effluent Treatment Plant was in operation with components collection tank-> Equalization tank-> Oil & Grease trap-> chemical dosing (with poly- not in operation) -> Primary clarifier-> MBBR tank-> Secondary clarifier (under maintenance) -> Sludge drying beds with filter press-> ACF and GCF-> Outlet.
4) The industry has installed sludge drying press and same was not in operation. As per representative the press is operation-able and will be mostly utilized in rainy season. As of now sun drying of sludge was going on.
5) Housekeeping around the ETP was very poor and shrubs in large quantity was found grown in and around ETP.
6) The industry has installed flow meters at the outlet of ETP however flow mater has not been provided at the water intake borewells (02 nos.). As such, water / effluent balance cannot be checked.
7) The industry has developed plantation in its premises of about 7 acres, however stagnation of effluent was observed in the front part of plantation. Cleaning / maintenance of plantation and scientific development of plantation in the area is required.
8) The industry has not developed vermin-composting or in-situ remediation for treatment of bio-degradable solid waste generated from its premises. As per representative, there has been very less generation of solid waste from the premises. As such, they have not adopted in-situ remediation till date.
9) STP installed by the industry was not in operation. As per representative, due to low quantity of domestic effluent they have diverted their domestic effluent into the ETP for treatment.
10) A large scrapyard, mostly consisting of plastic waste was found near the ETP. As per representative, M/s Scriber Dynamix has been storing their plastic waste at this area from where it is lifted to the authorized vendors. However, the industry failed to submit any documentary proof regarding the same.
11) The industry was guided to link the consent fee with the online application however same has not been linked till date.
The industry is not complying with the provisions of the Water Act, 1974 and the Air Act, 1981.
It is therefore recommended that consent to operate applied by the industry under the Water Act, 1974 and the Air Act, 1981 may be refused.
