Point-wise reply to the observations of zonal office is as under:
1. The industry has applied under orange Miscellaneous (S.No. 2999). As per revised Categorization of Industries framed by the Board on the directions issued by the CPCB dated 29.9.2016, there is no specific industry code for production of bio-diesel.
2. As per EIA notification dated 14.09.2006, production of bio-fuel intermediate and heavy hydrocarbons is not covered under said notification.
3. The production of bio-fuel intermediate and heavy hydrocarbons is not covered under first schedule of Factories Act, 1948
4. The PP has not submitted building plans approved by the Director of Factories or Competent Person.
Keeping the above, in view the application of the project proponent for obtaining fresh ‘Consent to Operate’ under the Water Act, 1974 for manufacturing of Bio-fuel Intermediate @ 20 TPD & Heavy Hydrocarbons (Green Furnace Oil) @ 10 TPD may be returned and PP may be requested to apply it again after obtaining approval of its building plans.
