The hotel cum banquet hall has applied for obtaining Consent to Establish (NOC) from pollution angle under the Water Act, 1974 and Air Act, 1981 for establishment of Hotel cum banquet hall of capacity @ 300 Persons in one function and 25 no. rooms through OCMMS. The details of the case is as under:-
The PP has obtained area classification letter from STP, Bathinda vide memo no. 167-STP(B)/H2BP-M dated 03.02.2023 and as per the letter the site falls in the revenue estate of village Malakpur, Tehsil & District Mansa, Hadbast No. 56, Khasra no. 10//13 (6-8), 14 (8-0), 15 min (7-16), 16 min (1-1), 17 min (1-1), 18 min (1-2) having total land area 25 Kanal 8 Marlas. Further, the site falls in the notified Master Plan of Mansa where the establishment of hotel is permitted vide above letter.
The hotel cum banquet hall has deposited NOC fee of Rs. 18000/- vide online R. no. 128890647 dated 18.03.2023 for the project cost of Rs. 581.80 lakhs as per project report, which is adequate for one year under orange category.
The hotel cum banquet hall has attached the lease deed dated 30.11.2022 valid for 25 years i.e. upto 29.11.2047 in the name of M/s Glittering Waves Hotel.
The hotel cum banquet hall has attached the approved layout plan by Senior Town Planner, Bathinda vide no. 212-218-M2BP-m dated 09.02.2023.
The hotel cum banquet hall has proposed STP of capacity 20 KLD for treatment of domestic effluent to be generated form toilet section and also proposed oil & grease trap and septic tank for effluent to be generated from the kitchen section.
The hotel cum banquet hall has proposed the treated waste water will be discharged onto land for plantation along the boundaries (500 ft in length on 2 sides and multiple rows of plantation being developed along the lawn area alongwith 0.5 acre of lawn area which will be adequate for disposal of 15 KLD treated wastewater.
The project proponent has also proposed to dispose off kitchen as per provisions of Solid Waste Management Rules, 2016 by providing compost pits and dry waste will be lifted to the authorized recycler.
Accordingly the site of the hotel cum banquet hall was visited by AEE of this office on 04.04.2024 and during visit it was observed as under : -
1. The hotel cum banquet hall falls on the right hand side of Mansa-Barnala Road, Mansa and was not in operation.
2. The project proponent has started construction activity of the rooms and the banquet hall alongwith 6 no. rooms and office has been constructed. Further, 10 no. rooms are under construction on the first floor.
3. There is no high tension wires crossing through the project site.
4. The hotel cum banquet hall has installed suction hoods in the kitchen area and the installation of STP was also in progress.
The PP has obtained classification letter from STP, Bathinda vide which the site falls in the notified Master Plan of Mansa where the establishment of hotel is permitted. Thus, the site is suitable as per the policy of the Board.
The Project falls under the orange category having Hotel cum marriage palaces, 2038-Hotels (< 3 star) or hotels having > 20 rooms and less than 100 rooms or having waste water generation > 10 KLD and less than 100 KLD, thus the competency to decide the application lies with the Senior Environmental Engineer, Zonal Office, Bathinda.
Recommendations:
Keeping in view of above, it is recommended that Consent to establish (NOC) from pollution under the provisions of the Water Act, 1974 and Air Act, 1981 may be granted for the establishment of the Hotel cum banquet hall of capacity @ 300 Persons in one function and 25 no. rooms subject to certain conditions and following special condition that the hotel cum banquet hall shall apply for consent to operate under the Water Act, 1974 and Air Act, 1981 as per policy of the Board.
