Earlier the industry was visited by the AEE of RO on 19.10.2023 and it was observed that the industry was found non complying with provisions of the Water Act, 1974 and was operating its unit without valid consents of the Board…………………...
Thereafter, the directions u/s 33-A of the Water Act, 1974 vide no. 7981-84 dated 24.11.2023 was confirmed against the industry for its closure with directions of disconnection of electric supply available to the industry…………………….
The electric connection of the industry has been disconnected by the PSPCL Authority and the industry has submit TDCO no. vide 177 dated 18.03.2024…………………..
Now the industry has applied for Consent to Operate under the Water Act, 1974 and Air Act, 1981 through OCMMS for ED Coating of cycle parts @ 0.8 TPD……………..
The industry has deposited consent fee, which is adequate upto 31.03.2025……………….
The site of the industry falls in adjoining focal point phase-8 and it has submitted an undertaking that site falls in the industrial zone as per the Master Plan Ludhiana………………...
The industry was visited by the AEE of RO on 18.03.2024 and it was observed as under:-
1. The industry was not in operation.
2. The electric connection of the industry was found disconnected during the visit. The industry has also submitted TDCO no. vide 177 dated 18.03.2024.
3. The industry is engaged in process of phosphating of cycle parts.
4. The industry has made an agreement with the Ms JBR Technology Pvt. Ltd., Phase-8, Focal Point, Ludhiana for lifting of trade effluent @ 2000 Ltrs/month.
5. The industry has provided new water meter on the source of fresh water supply and it is maintaining proper record separate register and the record of water consumption in process as well as effluent lifted by CETP operator i.e. M/s JBR Technologies Pvt. Ltd., Phase-8, Focal Point, Ludhiana. The fresh water consumption and trade effluent lifting was found in consonance.
6. No bypass arrangement has been provided by the industry and only domestic effluent is discharged into MC sewer.
7. There is no any air polluting machinery i.e. fuel based boiler or furnace, installed in its premises.
8. The industry has submitted approved building plan approved by the Competent Person affiliated by the Director of Factories.
9. The industry is now complying with the provisions of the Consent to Operate under the Water Act, 1974 and Air Act, 1981.
Show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry with an opportunity of personal hearing before the Senior Environmental Engineer, Zonal Office-2, Ludhiana on 02.04.2024. Wherein it was decided as under:-
1. The industry shall submit the certificate regarding area classification from the concerned department, within 15 days.
2. Environmental Engineer, Regional Office-4 shall comment upon the suitability of the site of industry and submit subsequent recommendations for deciding Consent of the industry.
Regional Office reported that in compliance to the decisions of the personal hearing, the industry has now submitted a letter issued to it by the MC Ludhiana vide no.5432/ATP-B dated 04.04.2024 (copy attached) in which it has been mentioned that the site of the industry falls in the Industrial Mix Zone as per the provisions of the Master Plan Ludhiana. Hence, the site is suitable for the industry.
As proposed by Regional Office, may, if approved:-
1.Consent to Operate under the Air Act, 1981 may be granted upto six months to the industry with suitable conditions as per policy of the Board.
