File Note: METRO MILK PRODUCTS: The Regional Office has submitted report in lieu to the application filed by the project proponent. Upon perusal of the report sent by RO, the following points were observed: • The industry is a large scale unit and engaged in the process of manufacturing of milk products by processing milk at site. • Earlier, the industry was granted Consent To Operate under the Water (Prevention and Control of Pollution) Act, 1974 vide no. CTOW/Varied/JAL/2019/10748792 dated 10.09.2019 valid upto 31.03.2024 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/JAL/2019/10748741 dated 10.09.2019 valid upto 31.03.2024, for production of Milk Products Like Powder, Ghee, Dahi & Paneer @ 110 Kilo ltr/day using Whole Milk @ 110 kilo/liters day as raw material and discharge of treated trade effluent after ETP @ 200 KLD & domestice effluent @ 1.5 KLD into PSIEC Sewer, subject to certain conditions as mentioned therein. • Now, the industry has applied for varied consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for meagre enhancement in production of Milk Products Like Powder, Ghee, Dahi & Paneer @ 115 Kilo ltr/day using Whole Milk @ 115 kilo/liters day as raw material and with same generation & discharge of treated trade effluent @ 200 KLD into MC Sewer, alongwith requisite document & fees. • The industry has deposited Rs. 282000/- vide R.No. 540615945 dated 19.03.2024 under Water (Prevention and Control of Pollution) Act, 1974, Rs. 282000/- vide R.No. 888123551 dated 19.03.2024 under Air (Prevention & Control of Pollution) Act, 1981 and Rs. 14400/- vide R.No. 540615945 dated 19.03.2024 towards NOC regularization fees (for enhancement in cost of assets from Rs. 24.02 Crore to Rs. 26.35 Crore); the RO has calculated the adequacy of the fees upto 31.03.2029 against the cost of fixed assets of Rs. 26.35 Crore. • The industry was visited by officers of Regional Office on 03.04.2023 & observed as under:- 1. The industry was in operation during the visit. 2. The industry has installed ETP of capacity consisting of screening → oil & grease trap → collection tank → anaerobic reactor (1no.) → MBBR reactor (1 no.) → aeration tank (1 no.) → tube settler (1 no.) → treated effluent storage tank → sand filter → carbon filter and sludge drying beds and same was in operation. 3. Treated trade effluent was being discharged into sewer. 4. Treated trade effluent samples collected on 23.10.2023 and as per analysis report all parameters were with prescribed limit of the Board. 5. OCEMS is installed at ETP outlet and it is connected to Board’s website. 6. The industry has installed boiler of capacity 08 TPH and 05 TPH with trima cyclones as APCD. Wood is used as fuel. Only one boiler of capacity 05 TPH was in operation during the visit and clear emissions were observed. 7. Emission samples were collected on 23.10.2023 and SPM levels were within prescribed limits of the Board. 8. The industry has increased production by increasing working hours. 9. The industry falls in designated Industrial area i.e Sport & Surgical Complex, Jalandhar. • The RO has recommended that varied consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry upto 31.03.2029 with suitable conditions. It is brought out that the last CTO under the Water Act, 1974 was granted to the unit subject to the following additional conditions that: 1) The industry shall install Online Continuous Effluent Monitoring System with final outlet of ETP within one month and shall connect with the server of the PPCB as well as CPCB within one month. 2) The industry shall obtain permission from PSIEC for discharge into the sewer. In this regard, as reported by RO it has already installed OCEMS at outlet of ETP & connected to PPCB server but the industry has not submitted any permission letter from PSIEC for discharge of its treated effluent into their sewerage network. However, it was noted that the industry was commissioned in Jan/ 1993 (as mentioned in application form) and long since ben granted consents by the Board for discharge of its treated effluent into PSIEC sewer after treatment through in-house ETP installed by it. Moreover, the unit has installed OCEMS at outlet of ETP for effective surveillance of maintainence of discharge standards & operation of its ETP. Also, the prescribed discharge standards for such units after ETP are stringent than the values of untreated domestic effluent which is being discharged into PSIEC sewer by the industrial units. In consideration of the above facts and the report/ recommendations sent by RO; if approved, the varied Consent to Operate under the Water Act, 1974 and the Air Act, 1981 for meagre enhancement in production of Milk Products Like Powder, Ghee, Dahi & Paneer @ 115 Kilo ltr/day using Whole Milk @ 115 kilo/liters day as raw material and with same generation & discharge of treated trade effluent @ 200 KLD into MC Sewer, be granted to the unit upto 31.03.2029, subject to suitable conditions and the following additional conditions that: CONDITIONS PROPOSED UNDER WATER ACT, 1974: 1. This consent is valid for operation of unit production of Milk Products Like Powder, Ghee, Dahi & Paneer @ 115 Kilo ltr/day using Whole Milk @ 115 kilo/liters day as raw material with trade effluent generation limited to 200 KLD, only. 2. The industry shall only manufacture the products and limit their quantities, for which it has been granted consent to operate from the Board. It shall not manufacture any other product without the prior written permission of the Board/ Competent Authority. 1. The industry will not exceed the generation of trade effluent of more than 200 KLD from its process sections (from core & non-core activities). Further, the industry shall immediately provide separate EMF on the line carrying untreated effluent from the process section(s) to the inlet of ETP installed by it, for assessment of the effluent generated from its premises. 2. The treated effluent after ETP alongwith domestic effluent shall only be discharged into PSIEC Sewer and it shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any effluent in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 3. The industry shall obtain clarification from the PSIEC to the effect if the unit can discharge its treated trade effluent into their sewerage network within one month and submit to the Regional Office of the Board. In case, the PSIEC clarifies that unit cannot be allowed to discharge its treated trade effluent into their sewerage network; then this ‘Consent to Operate’ shall be deemed cancelled and the Board shall not be responsible for any financial liability arising due to cancellation of this consent. In such case, the industry shall apply for fresh ‘Consent to Operate’ under the Water Act, 1974 alongwith concrete proof for alternate modes of disposal of treated effluent like availability of adequate land for utilizing treated effluents for plantation or to adopt other environmentally sound effluent disposal arrangements. 4. The industry shall adopt water conservation methods to reduce consumption of fresh water in process and in turn minimize the wastewater generation. 5. The industry shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water, if applicable. 6. The industry shall ensure that due to operation of the unit at the site, no nuisance for general public is created at any time and no public complaints are received. 7. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 8. The industry shall comply with the provisions of Solid Waste Management Rules, 2016. 9. The industry shall not throw / burn or burry any solid wastes in open outside premises or in drain / water bodies. 10. The industry shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic. 11. The industry shall ensure that there are no usages of single use plastic-thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocal or any other non-biodegradable material in the premises. 12. The industry shall obtain the authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. 13. The establishment shall obtain all the statuary approvals/clearances from the concerned departments. 14. The consent is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 15. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent. CONDITIONS PROPOSED UNDER AIR ACT, 1981: 1. This consent is valid for operation of unit production of Milk Products Like Powder, Ghee, Dahi & Paneer @ 115 Kilo ltr/day using Whole Milk @ 115 kilo/liters day as raw material with trade effluent generation limited to 200 KLD, only. 2. The industry shall only manufacture the products and limit their quantities, for which it has been granted consent to operate from the Board. The industry shall utilize only Wood/ Bio-Briquettes in its boiler furnace of capacity 8 TPH & 5 TPH (one operational at a time) and HSD in the DG Set(s) and shall not use any unauthorized fuel, low grade/ wapsi fuel and municipal solid waste, plastics, rubber or industrial waste in its furnaces. 4. The industry shall explore the possibility to use paddy straw as fuel in the boiler furnace(s). 5. The industry shall ensure that due to operation of the unit at the site, no nuisance for general public is created at any time and no public complaints are received. 6.
