It is submitted the that the industry has granted consent to operate under Air (Prevention & Control of Pollution) Act, 1981 vide no 121/RO/ASR/A/F dated 29.01.1999.
Now the industry has applied for obtaining varied Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, under Green Category through OCMMS with required documents for production of Box Stitching Machine @ 350 Number/year, Die Punching Machine @ 15 Number/Year, Rotary Machine @ 10 Number/year, Eccentric Slotter @ 10 Number/year and Auto Stitcher 5 Number/year.
Detail of the case are as under: -
1. The unit has submitted latest CA Certificate having total value of fixed assets Rs. 54.81 Lakh as on 19.03.2024. Accordingly, it has deposited Rs. 79500/- (including Rs. 49300/- as consent fee under Water Act, 1974, Rs. 20300/- penalty under Water Act, 1974, Rs. 2200/- as NOC regularization fee and Rs. 500/- as application form fee) vide UTR/Ref. No. 35844156981DC dated 03/04/2024 and Rs. 76800/- (including Rs. 20300/- penalty under Air Act, 1981, Rs. 7200/- balance fee under Air Act, 1981 and Rs. 49300/- as consent fee under Air Act, 1981), which is adequate up to 31/12/2035.
2. The unit has submitted registered deed, partnership deed and site plan etc.
It is pertinent to mention here that Board issued order vide no. CEE(HQ)F.No. 957/2016/59 dated 2/2/2016 regarding to grant of auto renewal consent to establish/consent to operate to the Orange & Green category industries. Now in continuation to above orders Board has issued fresh orders vide no. 329 dated 14/9/2023 regarding to Auto generation of renewal of consent to establish / operate / Authorization of any category of Small-Scale industries / projects / Health Care Facilities (up to 50 beds) and Hazardous Waste generating industries.
It is further submitted that the unit falls in green category in Small Scale sector and competency to decide the case lies with Environmental Engineer of the Board.
In view of the above, may if approved, the consent to operate under the provisions of Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 may be granted to the unit under Green Category up to 31/12/2033 with usual terms and conditions along with following special conditions: -
1. The unit will comply with the conditions of consents granted to it.
2. The unit at any stage will not generate any emission and trade effluent from its premises. |
