RO has reported that subject cited industry has applied for obtaining fresh consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 with requisite documents under Voluntary Disclosure Scheme (VDS). Detail of the case are as under:-
1. The unit has submitted CA certificate dated 29.03.2024, in which the gross value of fixed assets of Rs. 24.62 Lakh as on 31.03.2023. Accordingly, it has deposited Rs. 21,600/- vide UTR No. N087242263793009 dated 27.03.2024 as consent fee, Rs. 12,600/- vide UTR No. N087242261076013 dated 27.03.2024 as Penalty under Water Act, 1974. The unit has also deposited Rs.21,600/- vide UTR No. N087242263632005 dated 27.03.2024 as consent fee, Rs. 12,600/- vide UTR No. N087242162865016 dated 27.03.2024 as Penalty and under Air Act, 1981. The unit has deposited Rs. 500/- vide UTR No. N087242261347010 dated 27.03.2024 as an application form fee.
2. The unit has deposited Rs. 10,000/- vide UTR No. N087242262167008 dated 27.03.2024 as VDS Fee under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 10,000/- vide UTR No. N087242261617009 dated 27.03.2024 as VDS Fee under Air (Prevention & Control of Pollution) Act, 1981 under Voluntary Disclosure Scheme (VDS).
3. The unit has submitted self-declaration/undertaking regarding sole proprietor of the unit is Varun Kapoor.
4. The unit has submitted bill/voucher bearing Invoice no. 40 dated 28/03/2018 of the ETP plant purchased by the unit. The unit has also submitted Dimensional Drawing of ETP issued by M/s Universal Enviro Engineers as per which the effluent will be 100% reused further in the process after treatment.
5. The unit has submitted Udyam Registration Certificate.
6. The unit has submitted VAT Registration Certificate as a proof of date of commissioning i.e. 26/05/2005.
7. The unit has submitted the copy of approved map issued by competent person approved under Punjab Factory Act, Punjab.
8. The unit has submitted manufacturing process flow chart showing different process for manufacturing of surgical cotton.
9. The unit has also submitted Registered Deed of the land and site plan of the industry.
10. The unit has submitted a request letter in which it has been stated that the industry falls in the revenue estate of Village Verka on the Khasra no. 1373 and the area falls under the cluster of industries as per Master Plan of Amritsar and the industry is in operation since 2005 i.e. prior to the notification of Master Plan of Amritsar (2010-31). It is pertinent to mention here that another unit namely M/s United Surgical Industries, Batala Road Bye Pass, Amritsar is also in operation just adjoining to the subject cited industry and Khasra No. of the land acquired by both industries i.e. 1373 is same. Further, as per record of this office M/s United Surgical Industries, Batala Road Bye Pass, Amritsar has submitted a report issued from DTP, Amritsar vide letter no. 2173 dated 05.12.2012 regarding area clarification and has intimated that the said khasra no. of the site falls under cluster of industrial units. The site falls under local planning area Amritsar. Therefore, submission of the industry regarding land use pattern of the industry can be considered. The site of the industry was visited on 12/04/2024 and observed as under: 1. The industry was in operation at the time of visit and was engaged in manufacturing of surgical cotton.
2. The industry has provided an ETP to treat its trade effluent and the treated trade effluent was being reused back into the process after treatment. The discharge of the domestic effluent after septic tank was onto land for plantation.
3. During visit it was observed that no treated effluent was being discharged from the process.
4. The industry has not installed any D.G. Set inside its premises. The industry was found complying with the norms of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The process of the industry falls under orange category in small-scale sector and competency to decide the case lies with Senior Environmental Engineer of the Board.
RO has recommended that the fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry up to 30/09/2028 with suitable terms & conditions along with special conditions that:- 1. The unit shall comply with all the guidelines issued by Punjab Pollution Control Board/Central Pollution Control Board. 2. The unit shall reuse its treated trade effluent back into the process after treatment and shall not discharge its effluent onto land for plantation.
Keeping in view of above, it is recommended that the fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry up to 30/09/2028 with suitable terms & conditions along with special conditions that:-
1. The unit shall comply with all the guidelines issued by Punjab Pollution Control Board/Central Pollution Control Board.
2. The unit shall reuse its treated trade effluent back into the process after treatment and shall not discharge its effluent onto land for plantation.
3. The industry shall not discharge its effluent in any case, if the industry will discharge its effluent then analyze its effluent samples from Board's lab.
