The kiln was granted consent to operate under the Air Act, 1981, based on natural draft technology vide no.R14BTICTOA1125555dt. 08.04.2014, with validity upto 30.09.2018, for operation of brick kiln with natural draft technology to manufacture bricks & tiles @ 30,000 nos./day, subject to the conditions mentioned therein on the name of M/s Shri Durga Ji Bricks Co Vill Kot Guru Ke Bathinda. Earlier, the brick kiln had applied for obtaining consent to operate under the Air Act, 1981 and new consent to operate under Water Act, 1974 under orange category as per the prevailing policy after converting the brick kiln on zig-zag technology to manufacture bricks & tiles @ 20,000 nos. / day on the new name and style of M/s Aasra Bricks Company, Vill. Kotguru, which was refused. Now, the industry has again applied for new consent to operate under the Air Act, 1981 and new consent to operate under Water Act, 1974 under orange category as per the prevailing policy after converting the brick kiln on zig-zag technology to manufacture bricks & tiles @ 20,000 nos. / day on the new name and style of M/s Aasra Bricks Company, Vill. Kotguru. Earlier, the BKO was being operated by M/s Shri Durga Ji Bricks Co Vill Kot Guru Ke Bathinda till cancellation of its license dated 20.09.2020 after which the brick kiln has been acquired by new firm in the name of M/s Aasra Bricks Company, Vill. Kotguru with new license. The new firm has now applied for obtaining new consent to operate under the Air Act, 1981 and new consent to operate under Water Act, 1974 under orange category as per the prevailing policy after converting the brick kiln on zig-zag technology to manufacture bricks & tiles @ 20,000 nos. / day. The new firm M/s Aasra Bricks Company, Vill. Kotguru has submitted the requisite documents, the details of the which is as under- The project proponent has submitted completion certificate from the service provider with completion of the new design dated 29.03.2023. The project proponent has submitted copy of coal register from the previous firm as per which the BKO has not been operated during 01.02.2019 till 20.09.2020. The brick kiln has submitted undertaking attested from CA and Self Attested (Old Firm) stating that the brick kiln has been operated with FCBTK technology upto 20.09.2020, however, has submitted notarized undertaking dated 14.03.2024 stating that the BKO has not been operated since 2018 till 20.09.2020. However, the actual meaning of the statement mentioned in the undertaking signed by CA that the brick kiln was operated with FCBTK technology upto 20.09.2020 means that the license of the BKO was valid and has not been converted to Zig-Zag Technology, however, the brick kiln has not been fired since year 2018. The PP has also submitted notarized copy of undertaking from the owner of the land dated 10.4.2024 stating that the BKO has not been operated from 20.9.2020 till 07.3.2023 as the BKO was not on lease with any-party nor was was operated by owner of land as per undertaking.
As such since the brick kiln has not been operated since 01.02.2019 with old technology, as such no EC has been deposited by the brick kiln.
The kiln has deposited consent fees of Rs. 14,500/- through online vide R.no. 251069656 dated 04.05.2023under Air Act, 1981 and Rs. 14,500/- through online vide R.no. 818513128 dated 04.05.2023 under Water Act, 1974 against the fixed assets of Rs. 45.47 lacs, which is adequate upto 30.09.2025.
The brick kiln was visited by the AEE of this office on 12.04.2024 and it was observed as under:
1. The kiln was not in operation during visit. 2. The kiln has converted its kiln to zig-zag technology as per design of CSIR- Central Building Research Institute, Roorkee. The CBRI, Roorkee has issued completion certificate dated 29.03.2023. 3. No fuel was found stored in the BKO. 4. The kiln has provided a ladder and a plat form with the stack for collection of emission sample. 5. The kiln has now stabilized the periphery road / movement area. 6. The kiln has provided plantation all along its boundary. 7. The industry does not generate any trade effluent. 8. The industry has provided the septic tank for the treatment of domestic effluent.
The kiln is complying with the code of practice prescribed by the Board for the brick kin in the state and also not complying with the directions issued by Govt./ PPCB from time to time. The industry is also not complying with the provisions of the Air Act, 1981 and Water Act, 1974.
Keeping in view of above, it is re commended that consent to operate under the Water Act, 1974 & Air Act, 1981 may be granted to the brick kiln for production of bricks & tiles @ 20,000 no./day under orange category for a period up to 30.09.2025, subject to the suitable conditions. |
