Discussed with CEE(P) sir alongwith your goodself and it is submitted that the subject cited industry is engaged in manufacturing Malt & Malt Clums by using wheat and Barley as raw material. The industry undertakes following manufacturing activity Barley Screening – Steeping – Germination – Kilning – screening – Polishing – packing (Barley Malt).
As per the Environment (Protection) Rules, 1986, general discharge standards are applicable and the industry has to achieve prescribed discharge standards of BOD less than 100 mg/ltr for discharge onto land for plantation.
The industry was given personal hearing before the Chief Environmental Engineer (P) on 07.12.2023 wherein it was decided that the industry shall ensure to meet with the discharge standards of BOD less than 30 mg/ltr in future. However, it is pertinent to mention here that to stringent the discharge standards against the standards prescribed under Environment (Protection) Rules, 1986 by the CPCB for any industrial unit, the prior approval of the Board / Government is required.
Further, the industry has also given its representation vide its letter dated 19.02.2024 and has requested that the treated effluent is supposed to be discharged onto land for watering of plantation area, for which applicable discharge limit regarding BOD is 100 mg/l. Though, their ETP is designed to achieve BOD less than 30 mg/l, but, occasionally due to seasonal variation affecting micro-biological activity and loading variation, at times, the BOD levels may exceed 30 mg/l. Therefore, they have requested not to impose the BOD limit of 30 mg/l and allow them to comply by the applicable standards as prescribed by the CPCB".
In view of the above mentioned facts, the following action may be taken: -
1. The industry may be directed to achieve the general discharge standards as prescribed under the Environment (Protection) Rules, 1986 at all the time in supersession of the decision no. 1 of the personal hearing given by the CEE(P) to the industry on 07.12.2023 (Copy of the proceedings of the hearing dated 07.12.2023 is attached herewith).
2. Consent to operate under the Water Act, 1974 may be granted to the industry upto 30.09.2024, with the usual conditions and special conditions as mentioned in the note of undersigned dated 10.04.2024.
