File Note: Earlier, the stone crusher was visited by the officer of this office on 12/05/2022 and it was found that the stone crusher was not complying with the code of practice prescribed by the Board for the stone crushers and the conditions of the consent to operate granted under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 to it. Accordingly, show cause notice for revocation of the consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was issued to industry along with opportunity of personal hearing before the Environmental Engineer on 25/05/2022. Neither any one from the stone crusher attended the hearing nor any reply was received from the stone crusher. Further opportunities of hearing were given to the stone crusher on 07/06/2022, 21/06/2022 & 28/06/2022. The representatives of the stone crusher again failed to attend the hearing. Accordingly, the consents to operate granted to the stone crusher were revoked vide this office letter no. 1558 dated 01/07/2022. Thereafter, the industry was given personal hearing before the Chief Environmental Engineer at Jalandhar on 07.10.2022, in reference to Notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act 1974 as amended in 1988 & u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987 and whereas it was decided as under:- 1. The industry shall not operate the plant & machinery without making complete compliance of code of practice prescribed for stone crushers and getting consents to operate under Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act, 1981. 2. The Regional Office, Batala shall seal the plant & machinery of stone crusher, immediately. 3. The Environmental Engineer, Regional Office, Batala shall verify the status, point wise compliance of code of practice prescribed for stone crushers after receiving consent applications of stone crusher and submit report along with recommendations accordingly. Thereafter, the stone crusher applied for obtaining consent to operate under Water (Prevention& control of Pollution) Act, 1974 & Air (Prevention & control of Pollution) Act, 1981 was granted to the stone crusher vide No. CTOW/Renewal/PKT/2023/20861051 & CTOA/Renewal/PKT/2023/20861046 dated 09/02/2023, which were valid upto 08/08/2023 for the production of Washed Crushed Bajri @ 16500 CFT/Day, Crushed Bajri @ 2500 CFT/Day, Rori @ 1500 CFT/Day & Gole Bajri @ 2000 CFT/Day by using River Bed Material @ 22500 CFT/day and directions were issued to de-seal the stone crusher for six month period. The industry was visited by AEE on 04/08/2023 and the stone crusher was de-sealed. Thereafter, the stone crusher again applied for obtaining consent to operate under Water (Prevention& control of Pollution) Act, 1974 & Air (Prevention & control of Pollution) Act, 1981 and was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOW/Renewal/PKT/2023/19168829 dated 02/09/2023 and CTOA/Renewal/PKT/2023/19168816 dated 02/09/2023 for a short term period upto 01/03/2024 and a stone crusher was de-sealed for short period. The industry earlier applied for varied CTO, but same was returned by the Board. Now, the industry has applied for varied obtaining of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 through OCMMS in a totally paperless manner by uploading necessary documents as PDF for the operation of the stone crusher for the production of Washed Crushed Bajri @16500 CFT/Day, Crushed Bajri @ 2500 CFT/Day, Rori @ 1500 CFT/Day, Gole Bajri @ 2000 CFT/Day by using River Bed Material @ 22500 CFT/Day as raw material respectively. The industry has already deposited Rs. 54,000/- vide UTR No. 283219723 dated 13/01/2023 & Rs. 54,500/- vide UTR No. 47838942 dated 13/01/2023 under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 including NOC regularization fee and Rs. 500/- as Application fee and same are adequate for a period upto 30/09/2027 under both Acts. The industry has also submitted request letter dated 12/04/2024 informing that the stone crusher is not in operation from last since six months due to shortage of raw material. The industry was earlier visited by AEE of this office on 01/03/2024 and compliance of code of practice as observed during visit:- 1. The stone crusher was not in operation. 2. The stone crusher has covered the dust emitting points like Jaws/rotopactor. 3. During visit, it was found that the recirculation tanks have been cleared and pump and motor have been provided for recirculation. 4. The stone crusher has provided conventional chutes to the end of the conveyor belts. 5. The stone crusher has provided water sprinklers at the boundary of the industry. 6. The stone crusher has provided green belt along the boundary, however same needs to be enhanced. (Agenda Note is also attached herewith). In view of above, it is recommended that :- 1. The Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be granted to the stone crusher for a period upto 30/09/2024 with the suitable condition. 2. The stone crusher may be further de-sealed upto 30/09/2024.
