Sir the point wise reply to the observations of the competent authority is as under:- (copy also enclosed)
1. Observation: - Whether the project proponent has obtained consent to establish (NOC) before establishment of the project. If yes, mention the details, thereof and if no, it is required to comment on the suitability of the site.
Reply: As per record, the Project proponent had established its unit without obtaining prior NOC/CTE of the Board. Now, the PP has submitted a copy of CLU for an area of 8.55 Acres vide memo no. 2769 dated 16/11/2021 in the revenue estate of Village Ghaggar Sarai, Tehsil Rajpura, Distt. Patiala (H.B.No. 82). The site is falls in mixed land use zone as notified Master Plan of Rajpura and the unit is permissible under this land zone as mentioned in the CLU.
2. Observation: - Regional Office has not commented on the Proof of date commissioning of the project to check the adequacy of consents fee.
Reply: - The PP in its application form has mentioned the date of commissioning as April, 2023 and has submitted an invoice dated 18 April, 2023 regarding rent bill raised to M/s HUL.
3. Observation: - As per the report of the Regional Office, SEIAA has already issued notice to issue directions u/s 5 of EPA and further action is under process. When the project under violations of the conditions of the Environment Clearance, whether the Board can grant the consents to project.
Reply: - As submitted earlier by the undersigned, the establishment was issued show cause notice by SEIAA, Punjab to suspend the Environmental Clearance granted to the project and to issue directions u/s 5 of EPA Act, 1986 alongwith opportunity of personal hearing before Chairman, SEIAA on 03.01.2024. Thereafter, another show cause notice was issued to the establishment vide SEIAA letter no. MS-987 dated 05.03.2024. (Copies enclosed).
The project proponent has submitted a copy of compliance report of the decisions taken by the Chairman, SEIAA, Punjab in personal hearing held on 03.01.2024 and a reply is a copy of reply w.r.t show cause notice dated 05.03.2024 as issued by SEIAA is also submitted by the PP.
On perusal of the reply it is found that the PP is yet not complied with the conditions of the Environment clearance obtained by it such as amount to be spent under its CER activities and providing adequate green area etc.
• Based on the observations of the competent authority, if approved, the application of the PP may be returned with the advice to prioritize concluding the pending matters with SEIAA, Punjab. Furthermore, the PP should direct to submit a point-wise compliance report of the Environmental Clearance (EC) conditions, particularly focusing on the allocation of funds for Corporate Environmental Responsibility (CER) activities and the establishment of adequate green areas.
