Sir, the PP was issued show cause notice for refusal of 'Consent to Establish' (NOC) with an opportunity of personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 19.03.2024 wherein it was decided as under :-
1. The industry shall develop adequate green area for disposal of domestic effluent of 30 KLD within premises, within 15 days.
2. The industry shall develop adequate plantation area for disposal of remaining domestic effluent of 105 KLD in adjacent land and intimate its distance and mode of disposal, within 15 days.
3. The industry shall submit revised site plan by showing distance of high tension wire from the colony, within 15 days.
4. The industry shall submit its own proposal to dispose off the Municipal Solid Waste Generation from the project as bulk generator, within 15 days.
5. The Environmental Engineer, Regional Office-1, Ludhiana shall verify submission made by the industry and send further recommendations in the matter.
The RO has visited the site on 16.04.2024 and submitted the point-wise compliance of the above said decisions as under :-
1. Green area was being developed by the PP.
2. The PP has his own land just back side the project in which mango trees have been planted and will be sufficient to dispose of the treated domestic effluent.
3. As per site plan submitted by the PP, the distance from the Boundary Wall of the Colony to High Tension Wire is 21 Feet. Although, distance of High Tension Wires from the plots is also mentioned on the plan which is 75 Feet and 92 Feet from the foundation of Pole of HT Wires. During visit, it has been observed that HT Wires are appox. 16’ away from the Boundary Wall of the Colony.
4. The PP has proposes to provide pits and Mechanical Composters to handle the Municipal Solid Waste generated from the Project.
RO recommended that Consent to establish (NOC) under the provisions of the Water Act, 1974 & the Air Act, 1981 may be Granted to the Project Proponent with usual conditions and with the special condition that:- 1. The PP shall provide the STPs to treat the domestic effluent simultaneously with the project. 2. The PP will develop the adequate plantation area simultaneously with the project to dispose of the treated domestic effluent. 3. The PP will always keep reserve the plantation area in his adjoining land to dispose off the treated domestic effluent of 105 KLD. 4. The PP shall left the land as non-construction zone near HT Wires as per Directions/Notifications issued by Govt/PSPCL authorities from time to time. 5. The PP shall provide the vermi composting pits and Mechanical Composters to handle the Municipal Solid Waste.
In view of the above, it is recommended that Consent to establish (NOC) under the provisions of the Water Act, 1974 & the Air Act, 1981 may be Granted to the Project Proponent with usual conditions and with the special condition as proposed by RO, please.
