File Note: The Project Proponent has applied for consent to establish under the provisions of Water Act, 1974 & Air Act, 1981 for establishment of a Residential colony – M/s Hans Enclave, Near Saffron Hotel and Restaurant, Mansa Road, Bhikhi,Distt. Mansa in an area 82 Kanals 10 Marlas (10.3125 acres) having 102 No. Residential Plots, 17 Commercial Plots, 1 no. EWS and 1 no. school in the revenue estate of Bhikhi, Distt. Mansa in the name of Sh. Chander Parkash, Partner. The detail of the case is as under:- The Project Proponent has submitted the project report for the development of residential colony consisting of 102 No. Residential Plots, 17 Commercial Plots, 1 no. EWS and 1 no. school including the cost of land of Rs. 443 lacs. The Project Proponent has deposited the NOC fees Rs. 11300/- vide R No. 814224167 dated 04.04.2024 which is adequate for a period of 1 year. The Project Proponent has also submitted Land use classification, Partnership deed dt. 17.08.2022, Feasibility report, Revenue record of 82 Kanals 10 Marlas (Registries of 82 Kanal 10 Marlas in the favour of M/s partners of the promoter company i.e M/s SK Real Estate, Sunam). The Project Proponent has submitted the copy of land use classification issued to M/s SK Real Estate, Sunam vide no. 207 DTP (M)/SB-133 m dated 22.03.2024 for establishment of a residential colony in the name of M/s Hansa Enclave village Bhikhi Tehsil & Distt. Mansa for developing land as residential project in an area of 10.3125 acres situated in Hadbast No. 20 for land bearing khasra Nos. 155//20/2 (2-14.34), 12/2 (7-4), 18/2 (0-0.66), 19 min (1-18), 19 min (0-1), 6 (7-0), 7 (7-11), 8 (7-11), 13/1 (6-4.5), 1/2 (6-16), 2/1 (6-4), 9 (7-5), 12/1 (0-8), 20/1/2 (2-5), 10/1 (7-8), 11/2 (7-8), 127//22/1 (1-18), 1393 (1-17), 455/2 (0-16.5) i.e. total area of 82 Kanal 10 Marlas. As per the classification the site is in the mix land use Zone outside MC/NP limit. The Project Proponent has submitted partnership deed dated 17.08.2022 having Sh. Sanjeev Kumar, Sh. Rattan Kumar, Sh. Dhanvesh Singla and Sh. Chander Parkash as Partners. As per the feasibility report attached by the Project Proponent the total effluent generation from the project will be 66 KLD considering total population after full development of area. The colony has submitted the feasibility report regarding installation of STP of capacity 80 KLD of MBBR technology (STP will include collection pit, screening, oil & grease removal, aeration tanks, secondary clarifier, multimedia tanks and sludge drying beds. - Outlet) for treatment of the domestic effluent generated from the project. The Project Proponent has proposed that it will utilize the 30.7 KLD of treated waste water for buffer green area of 0.38 acres (to be left towards the boundary located near to the rice mill as per conceptual plan and undertaking), 28.72 KLD will be utilized in dual plumbing and remaining 5.6 KLD within the internal parks and lawns of the project. The Project Proponent has considered a population of 5 per plot instead of 15 persons per plot which has lead to reduction in effluent load of 110 KLD. The colony has given a reply to the clarification that it will obtain revised CTE if there is any increase in population per plot scanerio which cannot be considered. Further, the project proponent has proposed in the feasibility report that the Bio-degradable wastes will be treated using mechanical composter. The Project Proponent has not submitted approved layout plan and has requested to allow the NOC based on the conceptual layout plan. The Project Proponent has attached the undertaking w.r.t. to the green buffer area vide which it has undertaken that the colony will provide a green buffer area towards the rice mill i.e. 15 meter wide at the boundary wall of the project under the khasra no 155//21/1,155//20/2,155//19 MIN,,155//19 MIN,455//2/0,155//18,155//13 & the registry for the same of area is attached with application. It is further informed that the EC will not be applicable as for plotting scheme it is applicable on area of more than 50 hectares and the area of the project is only 10.3125 acres as per classification of area document issued to the project. The site of the colony was earlier visited by the officer of this office on 16.04.2024 and Sh. Chander Parkash, Partner was contacted and it was observed as under: - 1. The colony is situated along the mansa to bhikhi road on the right side adjoining to the hotel saffron. The project boundary is only at a 4 feet distance from the hotel cum restaurant boundary. 2. The hotel cum restaurant has obtained the consent to operate from the Board under the Water Act, 1974 and Air Act, 1981 which was valid upto 31.03.2021. The hotel has been issued a show cause notice for obtaining renewal of consent within 7 days. 3. The colony is still in construction phase and only the boundary wall has been provided. 4. Further, there is no MAH unit within 250 m reach of the site of the colony and no air polluting industry within 100 m of the site of the colony. However, there is a rice mill at an approximate distance of 140 meter towards the back boundary of the project. 5. The electricity wires probably a 11 KVA line is also crossing the site of the proposed residential colony. As such, the site of the colony is suitable as per land use classification obtained from establishment of the residential colony. However, the colony has failed to submit proper feasibility report, layout plan and further the electric wires are also crossing the site. Keeping in view of above, it is recommended that show cause notice under the Water Act, 1974 and Air Act, 1981 for refusal of Consent to Establish (NOC) may be issued to the colony alongwith an opportunity of personal hearing.
