RO has reported that the hotel has applied for fresh consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 for operation of HOTEL @ 33 Rooms Detail of the case are as under: -
1. The hotel has submitted CA Certificate dated 29.03.2024 having gross value of fixed assets of Rs. 771.22 lakhs as on 29/03/2024. Accordingly, it has deposited Rs 90000/- vide Receipt No. 168816198 dated 11.04.2024 as consent fee under Water Act, 1974 and Rs. 90500/- (including Rs. 500/- as application form fee) vide Receipt No. 931323670 dated 11.04.2024 as consent fee under Air Act, 1981, which it is adequate upto 30/06/2029 under both acts.
2. The hotel has submitted wastewater treatment detail which it is reproduced as under: - Untreated Sewage – O & G Trap (Installed) – MC sewer leading to Terminal STP
3. The industry has submitted partnership deed dated 01.08.2020 showing the name of the partner namely Mrs Shruti Arora and Sh. Rajesh Arora.
4. The industry has submitted copy of approval of building plan from Office of Improvement Trust, Amritsar issued vide letter no. 277 dated 08.04.2019 in which it has mentioned that completion/addition/alteration plan of SCO No. 59 has been approved vide letter no. AIT/Engineer/5574 dated 15.07.2010 and the total approved covered area of the SCO No. 59 located at District Shopping Complex is 14701.50 square feet. It is pertinent to mention here that Board issued order vide no. CEE(HQ)F.No. 957/2016/59 dated 2/2/2016 regarding to grant of auto renewal consent to establish/consent to operate to the Orange & Green category industries. Now in continuation to above orders Board has issued fresh orders vide no. 329 dated 14/9/2023 regarding to Auto generation of renewal of consent to establish / operate / Authorization of any category of Small-Scale industries / projects / Health Care Facilities (up to 50 beds) and Hazardous Waste generating industries. The hotel falls in orange category in small scale sector and competency to decide the case lies with Senior Environmental Engineer of the Board.
RO has recommended that fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry upto 30.06.2029 with suitable terms and conditions and special condition that: - 1. This consent is only valid for the area and building plan approved by the Office of Improvement Trust, Amritsar vide letter no. 277 dated 08.04.2019.
Keeping in view of above, it is recommended that fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry upto 30.06.2029 with suitable terms and conditions and special condition as under:-
1. The project proponent shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner.
2. The Project Proponent shall develop the vermi-composting/composting to manage the bio-degradable solid wastes.
3. The project proponent shall not throw burn or burry any solid wastes in open outside premises or in drain / water bodies.
4. The project proponent shall ensure that there are no usages of single use plastic - thermocol disposable items such as water bottles / water pouches / water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises.
5. The project proponent shall not use or allow to use single use plastic (SUP) items in the premises as same are banned from 01/07/2022 as per the Notification of Govt. of India as well as Punjab.
6. This consent is only valid for the area and building plan approved by the Office of Improvement Trust, Amritsar vide letter no. 277 dated 08.04.2019.
