RO has reported that the subject cited industry is newly identified and was visited surprisingly on 20.12.2023 by the undersigned and it was observed as under:
1. The unit was in operation at the time of visit and was engaged in process of weaving and printing of cotton fabric. However, process of table printing was not operational at the time of visit.
2. The unit has installed weaving machines, table printing and fabric bleaching machinery. 3. The unit has installed ETP to treat effluent being generated from the process and same was not operational at the time of visit.
4. The unit has installed 01 no. boiler of unknown capacity and wood was in use as fuel.
5. No effluent was being discharged at the time of visit therefore effluent sample were not collected. However, the industry has installed a private sewer which was leading to Tung Dhab Drain to discharging effluent into drain. As per record of this office the unit has not obtained NOC/Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. It was recommended to Zonal Office, Amritsar to initiate action u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 and 33-A of Water (Prevention & Control of Pollution) Act, 1974 against the unit. On the basis of violation observed show cause notice for violation of provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry vide Zonal Office, Amritsar letter no. 925-26 dated 14.03.2024 with an opportunity of personal hearing before Senior Environmental Engineer, Zonal Office, Amritsar on 28.03.2024 conveyed to the industry vide Zonal Office letter no. 1100-01 dated 04/04/2024, in which it was decided as under:-
1. The industry shall apply for Consent to Establish (NOC)/Consent to Operate under Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act, 1981 along with complete documents through online system within 15-days.
2. The Regional Office shall process consent applications of the industry on merits.
3. The industry shall not discharge effluent into Tung Dhab Drain in any case. As per compliance of the decisions of the personal hearing, the unit has applied for obtaining fresh consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 (under Red category) for Yarn/Textile processing involving any effluent/emission generating processes including bleaching, dyeing, printing and coloring with requisite documents. Detail of the case are as under: - 1) The unit has submitted CA certificate dated 01.03.2024, in which the gross value of fixed assets of Rs. 403.27 Lakh as on 01.03.2024. Accordingly, it has deposited Rs. 2,16,000/- vide Receipt No. 146000639 dated 27/03/2024 (Rs. 1,44,000/- as Consent fee and Rs. 72,000/- as Penalty fee) under Air Act, 1981 and Rs. 2,30,900/- vide Receipt No. 390441251 dated 27/03/2024 (Rs. 1,44,000/- as Consent fee, Rs. 72,000/- as Penalty fee, Rs. 14,400/- as NOC Regularization fee and Rs. 500/- as an application form fee) under Water Act, 1974, which it is adequate up to 30.06.2028 under both Acts.
2) The unit has submitted self-declaration/undertaking regarding sole proprietor of the unit is Sunita Khanna.
3) The unit has submitted classification certificate vide ADA, Amritsar office letter no. ADA/PUDA/ASR/2021/4133 dated 23/03/2021 vide which no objection has been granted to the owner of the industrial plant.
4) The unit has submitted completion certificate of ETP of capacity 25 KLD issued by M/s Universal Enviro Engineers based on MBBR technology issued vide Ref.No. Univ/Gen/CC/59 dated 01/03/2024. The unit has also submitted Dimensional Drawing of ETP.
5) The unit has submitted manufacturing process flow chart showing different process for yarn and fabric.
6) The unit has also submitted the copy of approved map issued by competent person approved under Punjab Factory Act vide letter no. 1/729094/2023.
7) The unit has submitted 03 no. registered deeds of the land showing the ownership of the proprietor i.e. Sunita Khanna.
8) The unit has also submitted an agreement with the owner of the land bearing khasra no. 83/19/2 near Village Pandori Lubana for the discharge of treated trade effluent for plantation.
9) The unit has also submitted a request letter for grant of consent to operate in which it is stated that “earlier our unit was into weaving work from 26-07-2016 with production of Woven Fabric @ 1000 meter/day. Further, we started with printing of cloth @ production capacity: Printed Cloth @ 900 meter/day and brought machinery and installed ETP and APCD for the same. The commissioning date for printing process was Sept 2019.” The unit was again visited by AEE of this office on 16/04/2024 and observed as under:
1. The unit was in operation at the time of visit and was engaged in process of weaving and printing of cotton fabric. However, process of table printing was not operational at the time of visit.
2. The unit has installed weaving machines, table printing and fabric bleaching machinery. 3. The unit has installed ETP to treat effluent being generated from the process. The industry has provided approx. 0.5 acre land within its premises for discharging treated effluent after ETP. Eucalyptus tree have been planted by the industry in plantation area with karnal Technology.
4. The unit has installed 02 no. boilers of capacity 3 TPH & 1 TPH and was using wood/agro waste @ 1500 Kg/day & 500 Kg/day as fuel respectively. 5. As earlier observed during last visit, the industry has now plugged the arrangement which was earlier provided for discharging effluent directly into Tung Dhab drain. The process of the industry falls in Red category in small-scale sector and competency to decide the case lies with The Senior Environmental Engineer of the Board.
RO has recommended that the fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 be granted to the industry up to 30/06/2028 with usual terms & conditions as per the policy of the Board along with special conditions that: a) The unit shall comply all the guidelines issued by Punjab Pollution Control Board/CPCB. b) The unit shall get air emission and effluent analysis from the Board’s Lab within 02 month period. c) The unit shall discharge its treated trade effluent onto land for plantation as proposed in the application form only and shall not discharge its effluent into Tung Dhab Drain.
Keeping in view of above, it is recommended that the fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 be granted to the industry up to 30/06/2028 with usual terms & conditions as per the policy of the Board along with special conditions that:
a) The unit shall comply all the guidelines issued by Punjab Pollution Control Board/CPCB.
b) The unit shall get air emission analysis from the Board’s Lab within 02 month period.
c) The industry shall not throw burn or burry any solid wastes in open outside premises or in drain / water bodies.
d) The industry shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic.
e) The industry shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises.
f) The industry shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner.
