It is submitted the that the industry has granted consent to operate under Air (Prevention & Control of Pollution) Act, 1981 vide no. G14ASRCTOA2080329 dated 14.11.2014 and consent to operate under Water (Prevention & Control of Pollution) Act, 1974 vide no. no G14ASRCTOW2080498 dated 14.11.2014, which were valid upto 31.12.2023.
Now the industry has applied for obtaining varied Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, under Green Category through OCMMS with required documents for production of Showles, Stoles and Mufflers (labeling + packing) @ 600000 Number/Year.
Detail of the case are as under: -
1. The unit has submitted latest CA Certificate having total value of fixed assets Rs. 290.80 Lakh as on 31.01.2024. Accordingly, it has deposited Rs. 43340/-(including Rs. 840/- as balance fee under Water Act, 1974 vide Receipt No. 441099256 dated 11.04.2024 and Rs. 42840/- (including Rs. 840/- as balance fee) as consent fee under Air (Prevention & Control of Pollution) Act, 1981, which is adequate up to 31/12/2028.
2. The unit has submit process flow chart which it is reproduced as under:-
Finishing Product – Checking – Cutting + Stiching – Labeling – Packing – Ready to dispatch
3. The unit has submitted compliance repot of previous consents granted under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
It is pertinent to mention here that Board issued order vide no. CEE(HQ)F.No. 957/2016/59 dated 2/2/2016 regarding to grant of auto renewal consent to establish/consent to operate to the Orange & Green category industries. Now in continuation to above orders Board has issued fresh orders vide no. 329 dated 14/9/2023 regarding to Auto generation of renewal of consent to establish / operate / Authorization of any category of Small-Scale industries / projects / Health Care Facilities (up to 50 beds) and Hazardous Waste generating industries.
It is further submitted that the unit falls in green category in Small Scale sector and competency to decide the case lies with Environmental Engineer of the Board.
In view of the above, may if approved, the consent to operate under the provisions of Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 may be granted to the unit under Green Category up to 31/12/2028 with usual terms and conditions along with following special conditions: -
1. The unit will comply with the conditions of consents granted to it.
2. The unit at any stage will not generate any emission and trade effluent from its premises. |
