It is submitted that the industry has applied for obtaining Consent to Establish (NOC) under the Water (Prevention & control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Ethyl Acetate @ 80 TPD, Methyl Acetate/Butyl Acetate/ Propyl Acetate @ 10TPD, Formaldehyde @ 80 TPD, Manufacturing and Formulations of various Retarders/Thinners/Reducers and IP Grade Organic Solvents @ 10 MTD, Hydrocarbom based industrial solvents, fuel oils and allied products @ 40 MTD by using Denatured Ethyl Alcohol/ Industrial Alcohol/ SDS @ 53.30 MTD, Acetic Acid @ 64 MTD, Methanol @ 42.32 MTD, Propanol @ 6.37 MTD, Butanol @ 5.88 MTD, Heavy petroleum products/ crude mixture of hydrocarbons @ 40 MTD, Organic Solvents like Isopropyl alcohol, Acetone, Denatured Ethyl Alcohol, Mix xylene etc. for blending/formulations @ 1.5 MTD as raw material alongwith requisite documents and fee.
NOC fee
The industry has deposited Rs. 22,100/- vide R. No. 746366887 dated 22.03.2024 including application form fee. The NOC fee deposited by the industry is adequate for one year, against the proposed cost of the project of Rs. 610.00 lacs.
Land document
The industry has submitted the lease deed executed on dated 29.02.2024 between Sh. Divyansh Jindal, Sh. Ayush Jindal both S/o Sh. Ashwani Kumar Jindal and Sh. Divyansh Jindal Designated partner and authorized person of M/s Hindco Solvochem LLP, which is valid upto 31.01.2025.
The industry has submitted the copy of sale deed issued on dated 21.12.2021 between Geeta Rani & Naresh Kumar (First Party) and Divyansh Jindal & Ayush Jindal (Second Party) for area of land 12.0 Bigha 4.0 Biswa.
The industry has submitted partnership deed executed on dated 01.12.2022 between Sh. Ayush Jindal, Sh. Ashwani Kumar, Sh. Divyansh Jindal.
Suitability of site
The project proponent has submitted copy of DTP letter no. 2240 dated 23.11.2022 as per which the site falls in industrial zone as per Land Use Plan, Lalru (copy enclosed). Further, as physically observed there is no village phirni/residential area/15 pucca houses within the 100 mtr boundary of the project and as such the site is suitable for setting up of the unit as per Board’s policy dated 30.04.2013.
Water Pollution
The total industrial Waste Water Generation will be 39 KLD, out of which 26 KLD shall be generated from Process, 1 KLD from Boiler, 10 KLD from Cooling Tower, 2KLD from other (washing, lab etc). The wastewater will be treated in ETP of capacity 50 KLD. The RO permeate will be recycled in utilities and the RO reject along with HTDS effluent will be evaporated. Thus, there will be a Zero Liquid Discharge (ZLD).
Domestic effluent of 1.5 KLD will be generated and it shall be treated in septic tank and treated sewage will be used in plantation. The arrangements made by the project proponent are adequate.
Air Pollution
The air pollution control arrangements proposed by the project are as under:-

Room
As per the above the pollution control arrangements proposed by the project proponent are adequate.
Applicability of EIA notification dated 14.09.2006:
The proposed product is covered under schedule 5(f) of EIA notification 2006 and the industry has already applied for Environment Clearance and public hearing has been given on 22.12.2023.
It is pertinent to mention here that during the public hearing the residents of the Village Jeoli, Derabassi showed resentment regarding setting up of the project and carried out continuous protest during the conduct of the public hearing. (copy of the representations submitted by them is also attached)
Further, during public hearing almost 50% of the people raised their hands in favour of the project and 50% of the people raised their hands against the project. The public hearing was attended by 75 persons. The minutes of the public hearing have also been sent to the competent authority. (copy attached)
Further, the project proponent has undertaken that they will start any construction work at site only after obtaining the Environment Clearance, meanwhile they have requested for grant of CTE.
It is also added here that as per the office Memorandum dated 21.11.2006 of the Ministry of Environment & Forest, there is no link of “consent to establish” (NOC) for the new industries is to be granted under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with the environmental clearance under the EIA notification dated 14.09.2006.
Visit
The site of the industry was visited by AEE of this office on 18.04.2024 and during visit, it was observed that:
1. The site is located in Village Jeoli, Derabassi, SAS Nagar.
2. The site is an empty plot and no construction work has been started.
Recommendations
Keeping in view of the above, it is recommended that “Consent to Establish” (NOC) under the Water (Prevention & control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted for one year subject to suitable conditions and additional conditions that:
1. The industry shall not start any construction activity without obtaining prior environmental clearance for the propose project.
2. The NOC/ CTE has been granted on the basis of information and undertaking filed by the project proponent and if, in future any information is found wrong, the Board has right to revoke the NOC/ CTE and take penal action against the project proponent and its responsible person. The Punjab Pollution Control Board shall not be responsible for any financial liability and /or any other liability of the project proponent due to grant of this consent to establish.
3. The industry shall apply for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 before commissioning of its unit.
4. The industry shall give complete drawing and design of ETP at the time of consent to operate.
5. The industry shall obtain change of land use for the concerned authority, if need be.
6. The project proponent shall submit approved building plan from the competent authority alongwith the applications for consent to operate.
7. The industry shall comply with the various by-laws of Master Plan, Derabassi.
8. The industry shall obtain permissions from other concern departments, if need be.
9. The industry shall not discharge the effluent into any drain/choe/nallah, in any case.
10. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
11. The industry shall ensure that the activity of unit does not create any nuisance in the surrounding areas and no public complaints are received.
12. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
13. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
