Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 15.04.2024 w.r.t. show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 to M/s Magma Bikes, Hadbast No. 235-236, Opp. Osho Forge, Village Ramgarh, Uchi Mangli, Rich Mound, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a small scale red category unit and was established without obtaining consent to establish (NOC) from the Board.
As per the map of Master Plan Ludhiana, the location of the said industry seems to fall in mixed land use area, where only green category units are allowed, a fresh connection under the name of M/s Magma Bikes was issued on 30.09.2022 which serves as a proof of the date of commissioning to be Sep 2022. Further as per the documents submitted by M/s Magma bikes, the unit has been purchased through auction by them from the Bank.
The industry was show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 15.04.2024.
Sh. Vipan Kumar, Authorization person of the industry attended the hearing and requested for another date of hearing.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that another opportunity of personal hearing may be given to the industry.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
