It is submitted that the industry is a small scale orange category rice sheller and was granted consent to establish/NOC from the Board under the Water Act, 1974 and the Air Act, 1981 vide no. CTE/Fresh/BAR/2023/22384034 dated 21/06/2023 valid upto 20/06/2024 for manufacturing of Sorted Raw Rice with Dryer @ 3.0 TPH by processing of Paddy @ 4.5 TPH, as raw material under orange category with certain conditions mentioned therein and special conditions as under:-
1. The industry shall comply with the terms and conditions mentioned in the DTP certificates issued vide letter no. 353 DTP (Barnala) RSB-I dated 09/06/2023 and vide letter no. 389 DTP (Barnala)/RSB-1 dated 16.06.2023 by the Competent Authority.
2. The industry shall install pollution control devices chimneys in South-East corner of Khasra no. 255//9 min, which falls outside 500 mtr from proposed National Highway, as shown in the aks sajra copy counter signed by DTP Barnala.
3. After installation of machinery and air pollution control devices chimneys, the industry shall get verified distances of air pollution control devices chimneys from proposed Bathinda-Ludhiana Greenfield Highway from DTP, Barnala and submit report to the Board before applying consent to operate under the Water Act, 1974 and the Air Act, 1981. In case, the air pollution control devices chimneys fall within 500 mtr of proposed Bathinda-Ludhiana Greenfield Highway, then consents to operate will not be granted and the Punjab Pollution Control Board will not be responsible for expenditure incurred by the project proponent for establishment of its unit.
4. The industry shall be bound to shift the High Tension 11 KV wire before construction of rice sheller.
Earlier, the industry was given personal hearing before EE, RO, Sangrur on 12.02.2024 w.r.t. show cause notice issued for violating the provisions of the Water Act, 1974 and the Air Act, 1981. The proceedings of the same have been conveyed to the rice sheller vide letter no. 645 dated 21.02.2024 and the decisions of the hearing are as under:-
1. The industry shall apply for consent to operate under the Water Act, 1974 and the Air Act, 1981 within 07 days after OCMMS portal of the Board gets operational, failing which further action u/s 31-A of the Air Act, 1981 will be recommended to higher authorities of the Board.
2. Assistant Environmental Engineer-I, Regional Office, Sangrur shall visit the industry after a week to verify contentions made by the industry during hearing, collect air emission samples and submit fresh report in the matter including comments regarding shifting of HT wire.
Now, the industry has applied for obtaining fresh consents under the Water Act, 1974 and under the Air Act, 1981 for same production i.e. manufacturing of Sorted Raw Rice with Dryer @ 3.0 TPH by processing of Paddy @ 4.5 TPH, as raw material.
The rice sheller has deposited Rs. 44,100/- (Rs. 42,000/- as consent fee + Rs. 2100/- as penalty fee) vide no. 809462702 dated 08.03.2024 under the Water Act, 1974 and Rs. 44,600/- (Rs. 42,000/- as consent fee + Rs. 2100/- as penalty fee + Rs. 500/- as application fee) vide no. 680239183 dated 08.03.2024 under the Air Act, 1981. The industry has submitted the CA certificated for the value of fixed assets Rs. 130.24 Lacs as on 29.02.2024. The fee deposited by the industry is adequate upto 30.09.2028 under the Water Act, 1974 and the Air Act, 1981.
The industry has submitted an undertaking regarding the APCDs installed by the industry. The industry has also submitted compliance report of previous consent conditions earlier granted to it for setting up a rice sheller unit.
The industry has submitted approved building plan duly approved by Competent Person approved by Director of Factories, Punjab.
The industry has submitted DTP certificate vide memo no. 215 DTP(Barnala)/RSB-1 dated 10.04.2024 regarding installation of air pollution control devices stacks of dryer section and shelling section at more than 500 mtr distance from the alignment of proposed Bathinda-Ludhiana Greenfield Highway (NH 754 AD).
To verify the compliance of consent conditions earlier granted to the rice sheller & the code of practice, the rice sheller was visited by undersigned on 19/04/2024 and it was observed as under : -
1. The industry was in operation during visit.
2. The industry has covered all the processing sheds.
3. The industry has installed one shelling section, one dryer with individual cyclone as APCD and one sortex machine.
4. The industry has installed cyclone as APCD for shelling section as well as for dryer section at more than the distance of 500 mtr from from proposed Bathinda-Ludhiana Greenfield Highway and the same were having adequate stack height. During visit, no scientific staff was available, hence, sampling could not be carried out.
5. The industry has provided brick wall of 10 feet height in front of the discharge point of rice husk area and the length of aforesaid brick wall is 35' on each side of the rice husk discharge point. The industry has provided jali of height 5 ft above this wall.
6. The industry has no source of trade effluent generation.
7. The industry has constructed septic tank for treatment of domestic effluent of the toilet section and disposal onto land for plantation.
8. The industry has planted sapling of trees along the boundary wall.
9. The soil compaction has been done at site and industry has just started the work for stabilizing the movement area of vehicles and representative informed that it will complete within two month.
10. The industry has now removed High Tension 11 KV wire from its premises.
In view of above, it is recommended that consent to operate granted under the Water Act, 1974 & the Air Act, 1981 may both be granted upto 30/09/2028 (upto adequacy of fee) for manufacturing of Sorted Raw Rice with Dryer @ 3.0 TPH by processing of Paddy @ 4.5 TPH, as raw material under orange category, with suitable conditions and special condition that the industry shall got analyzed its stack emission samples from Board’s lab within one month and shall provide paved road on movement area of vehicles within two month and shall submit the report of the same in this office.
