The project proponent was issued show cause notice with personal hearing before Senior Environmental Engineer on 26.04.2024 and as per the reply the project proponent has obtained final completion certificate from the concerned authority (Copy attached). The project proponent has permission from MC, Mullanpur regarding untreated effluent into MC sewer.
The project proponent is out of station during hearing and requested to consider the reply and request for grant of consent.
The subject cited is a construction project having plotting and commercial shops. The project is categorized in small scale orange category ………………………..
Earlier the project proponent was issued show cause notice u/s33-A of the Water Act,1974 and u/s 31-A of the Air Act,1981 with an opportunity of personal hearing before the CEE-Ludhiana on 03.01.2024 in which it was decided as under:-
1. The project proponent shall apply for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 alongwith all requisite documents, within 15 days.
2. Environmental Engineer, Regional Office-4, Ludhiana shall visit the site and process the consent applications on merit and submit report alongwith conclusive recommendations within next 07 days
The project proponent has applied for fresh Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for Plotted site for residential @ 80 nos. and SCO's Occupied @ 25……………………
The project proponent has deposited consent fee, which is adequate upto 30.09.2029………………………….
The project proponent has submitted approved layout plan from STP, Ludhiana vide no. STP/F-2/LDH/76 dated 11.05.2023 with total area of 33.34 acres. As per the approved layout plan, the total proposed area of project is 33.34 acres (less than 50 ha). The project has been developed in a plotting manner with commercial shops at it front. After considering the FAR of residential plots and floor area of shops the gross built-up area after the completion of the construction of all residential houses, may come out to be (92828.53 sqm) 111022 sq. yards which is greater than 20000 sq meter. As per the schedule of the EIA notification 2006, at point 8 (b) the township and area development projects covering an area ≥ 50 ha and or built up area ≥1,50,000 sq mtrs requires Environment Clearance from the concerned authority. But as per the MoEF vide its letter no 205 dated 15.04.2019 it is clarified that the projects with a land area of less than 50 ha but a built-up area of more than 20,000 Sqm may be appraised as per provisions of Schedule 8(a) of the EIA Notification2006 as amended from time to time. The Board vide its letter no. 10949 dated 09.05.2023 has sought a clarification from the Joint Director MoEF, Chandigarh on this ambiguity and the reply of the same is awaited……………………….
The project proponent has applied partial consent for 25% occupancy for 60 KLD discharge into the MC Sewer of Mullanpur town……………..
The project proponent has submitted a letter approved by the Nagar Council, Mullanpur Dakha vide no. 363 dated 12.03.2024 regarding its sewer connectivity with terminal STP of STP mullanpur and the solid waste lifting, the contents of letter are reproduced as below:- "ਸਿੰਗਲਾ ਇਨਕਲੇਵ ਜੋ ਕਿ ਰਾਏਕੋਟ ਰੋਡ, ਮੁਲਾਪੁਰ ਉਪਰ ਸਥਿਤ ਹੈ ਦੇ ਸੀਵਰੇਜ ਕੁਨੇਕਸ਼ਨ ਅਤੇ ਸਾਲਿਡ ਵੇਸਟ ਚੁੱਕਣ ਸਬੰਧੀ ਪੁੱਛਿਆ ਗਿਆ ਹੈ। ਆਪ ਦੱਸਿਆ ਜਾਂਦਾ ਹੈ ਕਿ ਸਿੰਗਲਾ ਇਨਕਲੇਵ ਕਲੋਨੀ ਦਾ ਸੀਵਰੇਜ ਨਗਰ ਕੋਸਲ ਮੁਲਾਪੁਰ ਦਾਖਾ ਦੇ ਸੀਵਰੇਜ ਨਾਲ ਲਗਦਾ ਹੈ ਅਤੇ ਉਪਰੋਕਤ ਕਲੋਨੀ ਦਾ ਅਨ-ਟਰੀਟਡ ਪਾਣੀ ਲੈਣ ਲਈ ਨਗਰ ਕੋਂਸਲ ਮੁਲਾਪੁਰ ਦਾਖਾ ਦਾ ਐਸ.ਟੀ.ਪੀ. ਸਮਰੱਥ ਹੈ।ਆਪ ਜੀ ਨੂੰ ਦੱਸਿਆ ਜਾਂਦਾ ਹੈ ਕਿ ਸਿੰਗਲਾ ਇਨਕਲੇਵ ਕਲੋਨੀ ਦਾ ਸੋਲਿਡ ਵੇਸਟ /ਕੂੜਾ ਨਗਰ ਕੋਂਸਲ ਮੁਲਾਪੁਰ ਦਾਖਾ ਵੱਲੋਂ ਚੁੱਕਿਆ ਜਾਂਦਾ ਹੈ।" It is an already existed old project and it has already been granted permission by the MC Mullanpur to discharge its untreated sewage into its sewer leading to terminal STP of MC Mullanpur. Further the EO, Nagar Council, Mullanpur in the said letter has informed that the STP is sufficient to handle the untreated discharge from the colony…………………………..
Lastly the MC Mullanpur was given personal hearing before the Chairman of the Board on 11.03.2024 in which it was decided as under:-
1. Consents to operate under Water (Prevention & Control of Pollution) Act, 1974 be granted to the Municipal Corporation, Ludhiana for one year with suitable conditions.
2. The Municipal Corporation, Ludhiana shall deposit sample testing fees to the Board, immediately.
3. Environmental Compensation be imposed on the Municipal Corporation, Ludhiana for degrading the Environment.
4. Environmental Engineer, Regional Office-4, Ludhiana shall calculate the amount of Environmental Compensation (EC) to be imposed to the Municipal Corporation, Ludhiana for the said violations upto 31.12.2023.
5. The Municipal Corporation, Ludhiana shall make connectivity of its OCEMS with online dashboard of CPCB/PPCB server, within 01 month and maintain the record of the same.
6. Environmental Engineer, Regional Office-4, Ludhiana shall visit the Municipal Corporation, Ludhiana to verify the contentions of the Municipal Corporation, Ludhiana and submit the report alongwith recommendations, within 01 month.
RO reported that the action against MC Mullanpur is being dealt separately and its regular monitoring is being done by the Regional Office………………………..
The site of the project proponent was visited by the AEE of RO on 04.04.2024 and it was observed as under:-
1. The project is located in MC Mullanpur.
2. The residential and commercial project has been commissioned. Around 15 houses and approx. 20 shops have been commissioned.
3. There is no Maximum Hazard (MAH) industry at radial distance of 250 meters from the site of the boundary of the project.
4. There is no air polluting industries, rice shellers, brick kiln and stone crushers at distance of 100 meters from the boundary of the project.
5. The project site is suitable as per Govt. notification vide no. 3/6/07/STE (4)/2274 dated 25.07.2008 submitted as per earlier recommendations, please.
6. The effluent generated from the colony is being discharged into the MC Mullanpur sewer.
7. The Solid waste generated from the colony is also being lifted by the MC Mullanpur.
As proposed by Regional Office, may, if approved:
1. The partial consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the project for one year with suitable conditions as per the Board's policy and subjected to the following special conditions:-
a. The project proponent treat its present effluent in the capital before final disposal.
b. Before obtaining final consent to operate at its full occupancy, the project proponent shall provide adequate sewerage treatment plant before disposal of its effluent.
c. The project proponent must shall obtain the Environmental clearance in accordance with the EIA notification of 2006 and its any subsequent amendments, as directed by the Ministry of Environment, Forest and Climate Change (MoEFCC), in future, if Board's get the confirmation of the same from MoEFCC.
d. The project proponent shall obtain permission from CGWA for abstraction of ground water (if required) and shall comply with the guidelines issued by it from time to time.
e. The project proponent and its occupants shall fulfill its responsibility as a bulk waste generator and shall comply with the provisions of Solid waste management Rules, 2016.
f. The project proponent shall ensure compliance to the comprehensive guidelines for the regulation of noise/ sound pollution caused by use of loud speakers, public address system etc. issued by Punjab Government, Deptt. of Science, Technology & Environment vide notification no. 3/100/2013-STP(4)/145 dated 26.02.2014.
g. The Consent is being issued to the project proponent based upon the undertakings/documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
h. The project proponent must obtain all the necessary permissions and regulatory clearances from the relevant departments and agencies of the state government, in accordance with the project's specific guidelines as per the per state government laws.
i. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the promoter.
j. The STP Mullanpur is being regularly monitored by the Board and in case of its non-compliance. The project proponent may shall also be liable to take all adequate measures to achieve environmental standards.
k. Also in future if any stage the STP Mullanpur regularly fails to achieve the desired standards prescribed by the Board, then the project proponent shall be liable to install and operate its own treatment plant so as to achieve the desired environmental standards as per the MoEF&CC/PPCB.
l. If at any stage the STP Mullanpur regularly fails to achieve the desired standards prescribed by the Board, then this consent to operate under the Water Act,1974 shall be deemed cancelled and the Board shall not be responsible for any financial liability arising due to cancellation of this consent to operate. In such case, the project proponent shall apply for fresh consent to operate under the Water Act,1974 along with their adequate capacity STP and concrete proof for alternate modes of disposal of treated effluent like availability of adequate land for utilizing treated effluents for plantation or to adopt other environmentally sound effluent disposal arrangements.
m. The project proponent shall not discharge any domestic effluent (treated or untreated) into choe / drain /river or in any inland surface water at any time or any other unauthorized place by any unauthorized means. In case of any violation action u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 will be initiated for closure of the project proponent without further notice.
