The industry was given personal hearing before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 15.04.2024 w.r.t. show cause notice for refusal of 'Consent to Establish' (NOC) under the Water Act, 1974 and Air Act, 1981, wherein, it was decided that the Environmental Engineer, Regional Office shall verify submission made by industry and send fresh recommendations in the matter.
Submissions of the industry
Sh. Ved Parkash, Owner submitted during hearing that:
1. They have obtained approval from MC Maloudh for discharge MC sewerage vide no. 1086 dated 15.12.2023 and No objection certificate from Municipal Council Maloud vide no. 247 dated 02.04.2024.
2. Now, they have proposed STP of capacity 100 KLD and giving revised feasibility report.
3. They have submitted C.A certificate including capital investment of Land.
Point wise verification of submissions
1. The project proponent has also submitted Nagar Council, Maloudh letter no. 1086 dated 15.12.2023, which is reproduced as under:
“ਉਪੋਰਕਤ ਵਿਸ਼ੇ ਅਤੇ ਹਵਾਲੇ ਅਧੀਨ ਆਪ ਜੀ ਨੂੰ ਦੱਸਿਆ ਜਾਂਦਾ ਹੈ ਕਿ:
ਤੁਹਾਡੀ ਕਲੋਨੀ ਰਾਹੀਂ ਸਰਕਾਰ ਦੇ ਪੱਤਰ ਮੀਮੋ ਨੰ. 7277 ਮਿਤੀ 06/11/2023 ਰਾਹੀਂ ਪ੍ਰਵਾਨ ਹੈ।
ਤੁਹਾਨੂੰ ਨਿਯਮਾਂ ਅਨੁਸਾਰ ਐਸ.ਟੀ.ਪੀ. ਤੋਂ ਮੇਨ ਮੋਜੂਦਾ ਸੀਵਰ ਲਾਈਨ ਵਿੱਚ ਪਾਣੀ ਸੁੱਟਣ ਦੀ ਮੰਜ਼ੂਰੀ ਇਸ ਸ਼ਰਤ ਤੇ ਦਿੱਤੀ ਜਾਂਦੀ ਹੈ ਕਿ ਮੇਨ ਸੀਵਰ ਲਾਈਨ ਤੱਕ ਤੁਸੀਂ ਸੀਵਰੇਜ ਆਪਣੇ ਖਰਚੇ ਤੇ ਪਾਉਣ ਦੇ ਪਾਬੰਧ ਹੋਵੋਗੇ।
ਨਗਰ ਕੌਂਸਲ ਮਲੌਦ ਇਸ ਕਲੋਨੀ ਦੇ ਗਾਰਬੇਜ ਨੂੰ ਚੁੱਕ ਕੇ ਲੈਜਾਣ ਦੀ ਸਹਿਮਤੀ ਇਸ ਸ਼ਰਤ ਤੇ ਦਿੱਤੀ ਜਾਂਦੀ ਹੈ ਕਿ ਤੁਸੀਂ ਗਾਰਬੇਜ ਕੁਲੈਕਸ਼ਨ ਸੈਂਟਰ ਆਪਣੇ ਖਰਚੇ ਤੇ ਪੱਕਾ ਬਣਾਉਗੇ ਅਤੇ ਨਿਯਮਾਂ ਅਨੁਸਾਰ ਵੱਖ-ਵੱਖ ਸਮੇਂ ਨਿਰਧਾਰਤ ਫੀਸ ਐਗਰੀਮੈਂਟ ਕਰਕੇ ਜਮਾ ਕਰਵਾਉਣ ਦੇ ਪਾਬੰਧ ਹੋਵੋਗੇ। ਇਹ ਆਪ ਦੀ ਸੂਚਨਾ ਹਿੱਤ ਹੈ।”
2. As per revised feasibility report submitted by it, it has proposed STP of capacity 100 KLD. It is pertinent to mention here that the project proponent is required to install STP of capacity atleast 150 KLD at the site as per the calculation mentioned in earlier report.
3. The project proponent has not mentioned value of land in the CA certificate. However, it has mentioned the same in the project report i.e. Land amounting to Rs. 50 Lacs. It has submitted CA certificate for Rs. 129.16 lacs (excluding land value). If the land value may be added in the CA certificate than amount comes out to be 179.16 lacs i.e. between the slab of 1 crore to 2 crore.
Further, it has now proposed as under:
a. Total treated water = 92 KLD
b. 20 KLD of treated water will be used in plantation area of 1161.52 sq.mtr.
c. 20 KLD of treated water will be used in toilets of 132 houses and 22 no. shops.
d. Balance 47 KLD will be disposed off Municipal Council sewer.
Short comings in the case
1. The project proponent has not proposed Sewage Treatment Plant of adequate capacity.
2. The project proponent has not proposed adequate plantation area for disposal of treated water @ 20 KLD.
In view of above, it is recommended that ‘consent to establish'/ (NOC) applied the project proponent may be refused.
