File Note: The project proponent was granted Consent to Establish under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Ext/SAS/2022/19326713 dated 12.09.2022 valid till 31.03.2024 for development of residential plotted project namely M.K Residency having residential plots @ 119 number, EWS plots @ 30 number and Shop @ 01 number and community centre @ 01 number under orange category subject with special condition as under: “The project proponent shall develop the plantation area of 1.8952 acres as per Karnal Technology immediately” Now, the project proponent has applied for extension of Consent to Establish under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 under red category along with requisite documents. The project proponent has submitted CA certificate with the value of project cost is Rs 24.28 crore. The project proponent has deposited Rs. 49,700/- vide R no. 707638029 dated 10.04.2024 as NOC fee, which is valid for 2 year. Earlier the promoter company has submitted a copy of the CLU issued to it by the Department of Town & Country Planning, vide no. PBIP/CAPA(HUD)/2019/155 dated 13/05/2019 for residential purpose (plotted) under Affordable Colony Policy 2018 in the total land area of 8.75 acres falling in the revenue estate of Village Tangori, Banur-Landran Road, Distt. SAS Nagar. Further, it has submitted revised CLU issued by the Department of Town & Country Planning, vide no. PBIP/CAPA(HUD)/2020/2013 dated 16/09/2020, mentioning the above area for CLU for Residential Purpose (Plotted Colony under Affordable Colony Policy 2018). The promoter company has submitted a copy of the layout plan of the project approved by the Department of Housing & Urban Development vide no. LDC/PBIP/CAPA(HUD)/2021/30 dated 09/03/2021. Further, it has submitted copy of the approved sewerage layout plan, storm layout plan, fresh water supply plan and treated water supply plan approved by the Divisional Engineer PH-1, GMADA. As per the feasibility report submitted with the earlier NOC application, the total area of the project is 35,409.99 sq.m (8.75 acres) and total estimated population for the project comes out 2,252 persons. Total water demand of project will be 284 KLD, out of which, fresh water requirement will be 189 KLD which will be provided through borewell. About 227 KLD of waste water will be generated from the project after full occupancy which will be treated in proposed STP of capacity 250 KLD based on MBBR Technology. Treated wastewater will be utilized for flushing purposes @ 95 KLD, for green area development @ 5.5 KLD during summer, 2 KLD during winter & 0.5 KLD during monsoon and excess onto area @1.8952 acres reserved under Karnal Technology within project premises. The site was visited by the undersigned on 19.04.2024 and contacted Sh. Himanshu Gupta, Project promoter. During visit it was observed as under: 1. The proposed site is situated on Jhansa/ Tangori Road adjacent to another project of the same project proponent i.e. M/s MK Technology Park. Both the projects have common entry gate. 2. The project proponent has developed roads, laid sewer network, storm network, water supply network within the project. The project proponent has provided boundary wall around some sides of the project. 3. No construction of any residential house has been started at the project. 4. The project proponent has reserved the plantation area for Karnal Technology @ 1.8952 acre. 5. As per the boundary limits shown by the representative of the promoter company during visit, there is no MAH industry within a radius of 250 m from the boundary of the proposed site of the project. There is no rice sheller/ saila plant/ stone crushing/ screening cum washing unit/hot mix plant/cement unit etc. within a radius of 100 m from the boundary of the project. However, there exists one abundant brick kiln near to the proposed site and the condition of the same seem that it had not been operated since decades as only the kiln remains and the Bhanda of the brick kiln had been decade with time. 6. Also, one storm water choe is traversing near adjacent to the site of the project which falls under Attawachoe which further leads to river Ghaggar. 7. GMADA has yet not laid sewer in the area. 8. No borewell has been presently constructed in the project. In view of above, it is recommended that extension of ‘consent to establish’ under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the project proponent for 2 years subject to same conditions as mentioned in the previous NOC granted to it and with certain conditions.
