The industry is an existing small scale green category unit and is in operation for manufacturing of PVC pipe by using PVC Resin, Calcium Carbonate and Chemicals as raw material under green category without obtaining consent to establish/NOC of the Board under the Water Act, 1974 and the Air Act, 1981.
Now, the industry has sought to obtain fresh consents under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of PVC Pipes @ 5.0 Metric Tonnes/Day by using PVC Resin, Calcium Carbonate and Chemicals @ 5.0 Metric Tonnes/Day as raw material under green category.
Now, the industry has deposited Rs. 33,600/- deposited vide UTR. No. N103232417066141 dated 13/04/2023 & Rs. 3,200/- vide no. N103232417076268 dated 13/04/2023 under the Water (Prevention & Control of Pollution) Act, 1974. And Rs. 33,600/- deposited vide UTR. No. N103232417054998 dated 13/04/2023 & Rs. 3,200/- vide no. N103232417069117 dated 13/04/2023 under the Air Act, 1981, against the fixed assets of Rs. 194.03 lacs as on 31.03.2023, as per CA certificate dated 02.03.2024.
The industry has also deposit Rs. 6,400/- vide no. N103232417063341 dated 13/04/2023 as NOC regularization fee, which is adequate.
The fee deposited by the industry is adequate upto 31.05.2026 under both the Acts, after deducting the penalty (200%, being late applied within the period of 1-2 years) by considering the date of commissioning as Sept. 2022.
The industry has provided following documents alongwith application: -
1. Tehsildar report, wherein it is mentioned there is no Lal Lakir/phirni of Village Kaheru, 15 pucca houses and Nagar council are existing within the radius of 100 mtr from the site of the industry.
2. Lease deed of land, which is valid upto 31.08.2036.
3. CA certificate mentioning value of gross fixed assets.
4. Partnership deed.
5. Manufacturing process
6. Electricity bill as proof of date of commissioning.
7. Change of land use certificate obtained from Senior Town Planner, Patiala vide its letter no. 2162 STP (P)/SP-327 dated 18.08.2021, which is reproduced as under: -
The above said documents has been verified and was found in order.
To verify the facts and submissions of the industry, it was visited by AEE of this office on 22.04.2024 and it was observed as under:-
1. The proposed site is located on Daulatpur Road, Village Kaheru, Tehsil Dhuri, Distt. Sangrur.
2. The proposed of the industry is located at a distance of more than 100 mtr from the Lal Lakir of Village Kaheru as reported by Tehsildar Dhuri. No 15 pucca houses are existing within the radius of 100 mtr from the proposed site of the industry. The proposed site of the industry falls outside the nearby Nagar Council as reported by Tehsildar Dhuri.
3. The industry was found in operation engaging in the manufacturing of PVC Pipes by using PVC Resin and Calcium carbonate.
4. The industry has installed one no. extruder for manufacturing of fresh pipe
5. No trade effluent is being generated from the process. The entire cooling water is being re-circulated back into the process.
6. The domestic effluent is being discharged onto land for plantation after passing through septic tank.
7. The industry has provided one no. DG set of capacity 180 KVA equipped with canopy and adequate stack height.
8. The industry has taken land on lease from M/s Jai Ambe industries. lease deed attached.
9. The competency to decide such cases lies with the Environmental Engineer, Regional office, sangrur.
In view of above, it is therefore, recommended that consents to operate granted under the Water Act, 1974 & the Air Act, 1981 may both be renewed to the industry, up to 31/12/2025 with suitable conditions as per policy of the Board and with following special conditions: -
1. The industry shall obtain the registration from the Board as required under the provisions of ‘The Plastic Waste Management Rules, 2016 within two months.
2. The project proponent shall use only virgin raw material (fresh PVC resin) and will not use any waste plastic for manufacturing of PVC pipes.
3. The project proponent shall be bound to comply with the provisions of sec.79 of the Pb. Regional & Town Planning & Development Act,1995 (amended in 2006),in case the site of the industry falls in non-confirming zone, while finalizing the master plan of Dhuri.
4. The industry will comply with the provisions of Plastic Waste Management Rules, 2016.
5. The industry will ensure not to use plastic carry bags in any form to manufacture its product and will ensure compliance of the notification issued by the Department of Local Govt., Punjab dated 18.02.2016, wherein manufacturing, stocking, distribution, re-cycling, selling and use of plastic carry bags is completely prohibited in the State of Punjab.
6. The industry shall comply with guidelines issued by the PPCB for such type of units.
7. The industry shall obtain necessary permission from concerned departments from time to time.
8. The industry shall not install any boiler/furnace in its premises without prior permission of the Board.
9. The industry shall not change/modernize its manufacturing process and shall not increase its production capacity without prior permission of the Board.
10. The industry shall maintain proper record of the products manufactured/sale along with the name of the firm to whom it has sold its material and submit to the Board on monthly basis.
11. The industry shall follow the Environment Laws framed for plastic manufacturing units and will be bound to close its operation, whenever, banned by the Govt./MoEF in future.
12. The project proponent shall not install any new submersible pump/tubewell/energized source for abstraction of ground water in its premises without permission of the CGWA.
13. The project proponent shall obtain permission for abstraction of ground water as per guidelines issued by the Central Ground Water Authority.
