It is submitted that Project Proponent has proposed to establish a residential colony namely M/s Jindal Builders, in the Hadbast No 204, Tehsil Nabha, District Patiala in an area measuring 7.78 acres OR 62 kanal 6 marla (31514.89 mtr).
The project proponent has therefore entered into a partnership deed under the name and style of M/s Jindal Builders, Nabha vides deed agreement dated 06.07.2021, between the following partners:
1. Sh. Ashok Kumar S/o Sh. Brij Lal (50%)
2. Sh. Dikshant Jindal S/o Sh. Ashok Kumar (50%)
Thereafter, M/s Jindal Builders through its partner Sh. Ashok Kumar vide deed dated 21.07.2021 has entered into Joint Development Agreement with the following owners of the land for development:
1. Sh. Dhiraj Jindal S/o Sh. Sudarshan Jindal (25%)
2. Sh. Sudarshan Lal Jindal S/o Sh. Baldev Krishan Jindal (25%)
3. Sh. Vivek Jindal S/o Raj Kumar Jindal (25%)
4. Sh. Raj Kumar Jindal S/o Baldev Krishan Jindal (25%)
Subsequently, M/s Jindal Builders through its partner Sh. Ashok Kumar Jindal has executed General Power of Attorney to the above mentioned developers vide deed agreement dated 23.07.2021.
Moreover, Sh. Ashok Kumar S/o Sh. Brij Lal has been nominated as authorized signature of M/s Jindal Builders, which co-owner and General Power of Attorney above 4 members as per GPA registered vide no. 2021-22/77/4/47 dated 23.07.2021.
Further, the project proponent has also obtained change of land use CLU for developments of a residential plotted colony in an area of 62 kanal 6 marla (31514.89 mtr) from office of Local Govt. Punjab PB/CLU/PTA/NABHA/1311 dated 10-01-2022. In the said CLU letter it is mentioned that the proposed land falls in the residential as per the Draft Master Plan of Nabha (2007-2021).
Accordingly, the PP has applied for obtaining consent to establish of the Board (NOC) for establishment of a residential project under the provisions of the Water (Prevention & Control of Pollution) Act 1974 & under the Air (Prevention & Control of Pollution) Act 1981 against proposed cost of the project amounting to Rs. 758 lacs. The project proponent has deposited Rs. 21600/- vide online receipt no. 688658389 dated 01.03.2024, which is adequate as per the Policy of the Board dated 29/10/2018 for one year.
It is pertinent to mention here that there will be 73 residential plots, 13 commercial plots, 22 EWS plots, 1 park having area 1587 sqm, 1 garbage collection area & 1 electric substation. Accordingly, as per the National Building Codes, the PP has calculated total calculated total water requirement (by taking per capita demand @ 135 Ltr/person for residential plots and 45 ltr/person for commercial plots) @ 176.5 KLD and accordingly, total waste water generation will be 141 KLD approx.
The proposed site of the colony has been visited by the AEE of this office on 23/04/2024. During visit, it was observed as under:
1. The site of the proposed residential colony is located within MC limit of Nabha adjacent to PUDA approved Hira Enclave.
2. The promoter has provided the boundary wall around the proposed colony.
3. The promoter has provided sewer network inside the proposed colony.
4. The work of providing metal roads, street lighting was found under process.
5. The promoter yet to provide water works tank for supply of fresh water.
6. There is no high tension wire passing over proposed land.
7. No rice sheller/ saila plant, stone crusher, brick/cement plant/ cement grinding/hot mix plants was observed within 100 mtrs radius of the proposed site.
8. No MAH unit was found within the radius of 250 mtr of the proposed site.
9. The project proponent has proposed to provide composting pit for decomposition of organic waste. The recyclable material will be lifted through authorized recycler.
Further, the Project Proponent submitted a copy of proposed layout plan of residential colony, in which site of proposed STP is duly marked.
However, as per Board’s notification no. 315 dated 3/7/2018; following guidelines are notified for construction projects:
“If the residential colony/commercial complex/construction project is proposed to be established within the municipal limits of a City/Town of the State and it proposes to discharge its entire sewage into the municipal sewer, then the promoter of the residential colony shall install adequate and appropriate individual sewage treatment plant. The project proponent shall make arrangements to re-use the treated effluent for flushing purposes and/or for watering of green areas in the project premises. Only the surplus treated waste water shall be discharged into the MC sewer.”
Accordingly, the project proponent has submitted feasibility report from M/s Advanced Environmental Consultants, Dhuri, Sangrur. According to which, the total wastewater to be generated from the colony will be treated through its proposed STP of capacity 170 KLD. Out of the treated wastewater, 50 KLD will be reutilized under green area as well as for flushing and floor cleaning. The remaining 90 KLD will be discharged into MC sewer, leading to terminal STP Nabha of capacity 12 MLD.
In this regard, the PP has submitted letter issued by Executive Officer, Municipal Council, Nabha vide its letter no. 217GD dated 03.05.2023 regarding comments for approval of the layout plan for proposed town planning scheme. In the said letter, it has been mentioned that the sewerage line of MC, Nabha is passing in front of the proposed residential project and MC, Nabha has no objection to issue sewerage and water supply connection to the said project.
The PP has also submitted revenue certificate issued by Tehsildar Nabha dated 20.02.2024, in which, it has been mentioned that there is no rice sheller, stone crusher, brick/cement plant/ cement grinding/hot mix plants within 100 mtrs and no MAH unit within 250 mtr radius of the proposed site.
Moreover, as per Department of Science, Technology & Environment and Non- Conventional Energy, Govt. of Punjab vide order no. 3/6/07/STE(4)/3770 dated 30/10/2009, the statutory master plan has been notified under the Punjab Regional and Town Planning and Development Act, 1995 (Amended) 2006, mixed land use or any other development/ construction which comes up as per the earmarked zone, in case of new residential/ commercial, there is no need to keep any additional distance from the existing industry from the environment point of view because these factors have already been considered while earmarking the use of land for different categories in the Master Plan, as per notification no. 6312 dated 11th August, 2009 issued by Department of Housing and Urban Development.
Thus, as per the CLU and Tehsildar report, the site of proposed colony is suitable as per sitting guidelines prescribed by the Board/ Govt and also with Deptt of Science Technology, Environment & Non- Conventional Energy Govt. of Punjab’s Order No. 3/6/07/STE(4)/3770 dated 30.10.2009.
Moreover, the proposed project is a residential colony and only plots will be sold by the promoter. The total area of the project is 7.78 acres (62 kanal 6 marla) with proposed built up area of 40016 sqm approx., which is very much less than 50 Hectare (120 Acres). Hence the project does not cover under the ambit of under EIA notification dated 14/9/2006.
The competency for grant of NOC to such units lies with the Senior Environmental Engineer being Small Scale, orange category unit.
In view of the above, it is recommended that the project proponent may be granted NOC from pollution for setting of residential colony having 73 residential plots, 13 commercial plots, 22 EWS plots, 1 park having area 1587 sqmtr, 1 garbage collection area & 1 electric substation for total area of 62 kanal 6 marla with suitable conditions as per policy of the Board and some special conditions that:-
1. The PP shall be bound to install sewage treatment plant (STP) of adequate capacity for treatment of entire wastewater.
2. The PP shall be bound to make arrangements to re-use the treated effluent for flushing purposes and/or for watering of green areas in the project premises. Only the surplus treated waste water shall be discharged into the MC sewer
3. The PP shall comply with all the terms & conditions of the CLU obtained from office of Local Govt. Punjab, vide memo no. PB/CLU/PTA/NABHA/1311 dated 10-01-2022 for the land measuring 62 kanal 6 marla (7.78 acres), in true letter and spirit.
5. The project Promoter shall provide provisions of dual plumbing for utilization of partial treated waste water in flushing purpose.
6. The PP shall obtain necessary permissions from the concerned departments. |
