It is intimated that the project is a large-scale red category unit. Earlier, the project proponent was granted consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2022/18300392 dated 16.08.2022valid upto16.05.2023 for establishment of a Group Housing Project in total land area of 5.81 acres & having built up area 87336 sqm, consisting of 383 Flats & 11 shops with discharge of treated wastewater @ 86 KLD shall be reused for flushing purpose by providing dual plumbing system in the project. Treated wastewater @ 31 KLD shall to be used for plantation/ gardening purpose within its premises, in an area of 5,720 sqm. Treated wastewater @ 90 KLD shall be onto land for plantation as per Karnal Technology in the 2 Acres land bearing Khasra No. 465 & 466 adjoining the project, leased out from Sh. Harminder Singh S/o Sh. Santa Singh with subject to certain conditions and special condition as mentioned therein.
Thereafter, the project proponent was granted extension in the validity of ‘Consent to Establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Ext/SAS/2024/24826789 dated 12.03.2024 valid upto 11.03.2025 with subject to suitable conditions and special conditions mentioned therein.
The project proponent had obtained Environment Clearance vide no. F. No. 21-109/2020-IA-II dated 23.02.2021 for expansion of Group Housing Project namely “Uptown Skylla” with built up area of 87336 sqm having 383 flats and 11 no. shops at Zirakpur, Tehsil Derabassi, District SAS Nagar, Punjab by M/s Artique Infratech.
The project proponent has proposed a residential project consisting of 383 Flats and 11 shops in land area of 5.81 acres and having total built-up area of 87336 sqm. The project proponent has proposed the total water requirement is of 259 KLD out of which 173 KLD will be extracted as ground water and the remaining 86 KLD shall be used for flushing purpose for treated waste water, which shall be abstracted from the ground water by providing tubewell. The total wastewater generation from the project will be 207 KLD which will be treated in 2 STP of capacity 200 KLD and 110 KLD to be installed within the project premises. Green belt will be developed in an area of 5718 sqm.
There will be generation of domestic solid waste @ 770 Kg/day from the project activity. This will be collected from designated locations and segregated into inorganic and organic wastes. The company shall also provide mechanical composter for handling the organic solid waste. The in organic waste shall be sold to authorized vendors and managed as per provisions of Solid Waste Management Rules, 2016.
Thereafter, the project proponent has obtained amendment in Environmental Clearance under EIA notification dated 14.09.2006 vide no. SEIAA/MS/2023/218 dated 02.02.2023, as per which: -
“The case was considered by SEIAA in its 230th meeting held on 11.01.2023 wherein the project proponent informed that they were seeking amendment on account of decrease in the built-up area and increase in the number of flats from 383 to 387. The reason of the same was that the stilt area of 23794 sqm in the total built up area has been considered by mistake in the earlier EC granted to it. Further, as per the amendment proposal, 4 no. flats have been increased due to change in planning for construction of 4 no. flats instead of stilt parking in 2 towers.”

Now, the project proponent has applied for obtaining Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for development of 387 flats and 11 shops alongwith requisite documents and fee.
The project proponent has deposited Rs. 3,16,800/- vide R. No. 550000066 dated 21.03.2024 under Water Act, 1974 and Rs. 3,16,800/- vide R. No.
762050229 dated 21.03.2024 under Air Act, 1981, against the total cost of fixed assets is Rs. 95.45 crores. The consent fee deposited by the project proponent is adequate upto 31.03.2027 under both acts.
The site of the project was visited by officer of this office on 23.04.2024 and it was observed as under: -
1. The site falls at Ramgarh Bhudda Zirakpur, Derabassi, SAS Nagar.
2. The civil construction work is completed and the project is ready for possession. However no possession has taken place till date.
3. The project proponent has installed 2 STPs of capacities 200 KLD and 165 KLD based on MBBR technology and also submitted completion certificate for the same.
4. About210 KLD of effluent will be treated in the STP’s at full occupancy. The treated water @ 87 KLD will be used for flushing purpose and about 31 KLD for irrigation of green area and the rest @ 92 KLD will be discharged into MC sewer during summer season.
5. The MC sewer has been laid down for the project and the same was also telephonically confirmed from EO, Zirakpur.
6. The project proponent has provided provisions for dual plumbing arrangements in its flats.
7. The project proponent has provided 6 no. of Rain water harvesting pits inside the premises of the project.
8. The project proponent has installed 4 nos. D.G sets of capacity 1x500 KVA & 3x300 KVA, all are equipped with canopies and adequate stack height.
9. The project proponent is in process of installing mechanical composter of capacity 300 Kg/day for composting of wet waste.
10. The project is complying with the conditions of Environmental clearance granted to it.
11. The project proponent has submitted certificate from municipal councilor and Govt. School, Vill. Ramgarh Budhah regarding plantation of trees, providing washrooms in school, providing water cooler etc., in compliance of the conditions of the Environmental clearance.
12. The project proponent has submitted compliance of the EC conditions and the project is complying with the conditions of EC granted to it.
Further, the project proponent has been issued a letter by MC Zirakpur vide letter no. 448 dated 17.04.2018, wherein, it has been mentioned as under:
‘ਸਰਕਾਰ ਵੱਲੋਂ ਨਿਰਧਾਰਤ ਸਾਰੇ ਚਾਰਜਿਜ ਨਗਰ ਕੌਸਲ, ਜੀਰਕਪੁਰ ਵਿਖੇ ਜਮ੍ਹਾਂ ਕਰਵਾਉਣ ਉਪਰੰਤ ਅਤੇ ਰੁਲਾਂ ਅਨੁਸਾਰ ਨਕਸਾ ਮੰਨਜੂਰੀ ਉਪਰੰਤ ਕੰਪਲੀਸ਼ਨ ਤੋਂ ਬਾਅਦ ਫਰਮ ਆਪਣੇ ਖਰਚੇ ਤੇ 143 ਕੇ.ਐਲ.ਡੀ ਫਰੀਟਡ ਸੀਵਰੇਜ ਨਗਰ ਕੌਸਲ, ਜੀਰਕਪੁਰ ਵਿਖੇ ਬਨਦੇ ਚਾਰਜਿਜ ਭਰਵਾਉਣ ਉਪਰੰਤ ਨਗਰ ਕੌਸਲ ਦੇ ਮੇਨ ਸੀਵਰ ਨਾਲ ਜੋੜਿਆ ਜਾ ਸਕਦਾ ਹੈ ਇਹ ਸਰਟੀਫਿਕੇਟ ਪ੍ਰਤੀ ਬੇਨਤੀ ਅਨੁਸਾਰ ਜਾਰੀ ਕੀਤਾ ਜਾਂਦਾ ਹੈ।’
The PP has obtained permission from MC Zirakpur for discharge of treated sewage vide no. 448 dated 17.4.2018, which is well before the directions issued to MC Zirakpur by the Board on 15.6.2022. Also decided in the review meeting of this office on 13.7.2023, the permissions may be given to such projects, which are having permission from MC regarding connectivity of MC sewer before 15.6.22.
In view of the above, it is recommended that the Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.03.2027 with subject to the suitable conditions and additional conditions that: -
1. The project proponent shall submit effluent analysis results from Boards lab within one month.
2. The project proponent shall operate its STP’s regularly & efficiently and shall maintain operational record of the same on daily basis.
3. The project proponent shall obtain permission from PWRDA for abstraction of ground water within one month.
4. The project proponent shall maintain separate record regarding treated water being generated from the project and being re-utilized in green area and flushing.
5. The project proponent shall comply with conditions mentioned in the Environmental Clearance granted to it by the Competent Authority.
6. The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be collected.
7. The project proponent shall not discharge any treated/ untreated wastewater into sewer/ drain/ choe under any circumstances.
8. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.
9. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.
10. The industry shall ensure that the activity of unit does not create any nuisance in the surrounding areas and no public complaints are received.
11. The Consent is being issued to the industry based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
12. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
13. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and / or any other environmental law applicable to the industry and Rules, Circulars & Directions issued by the Board from time to time, at all times.
