The industry is a small scale orange category unit. Earlier, the industry was visited by the officer of the Board on 14.12.2023 and it was observed as under: -
1. The unit namely M/s Sunrise Polymers, Khasra no. 1014/106/4, Village Bhagwanpur, Derabassi is engaged in manufacturing of dana and carry bags from waste plastic.
2. The industry has installed 01 no. extruder and 02 no. of blower machines for making of carry bags. The industry has not installed any APCD with the extruder machines, so as to control the emissions beings generated from these machines.
3. During visit, a total of 14 bags weighing approx. 202.6 kgs of plastic carry bags were uncovered and subsequently confiscated by this office.
4. The industry is operating without obtaining consent to operate under Water Act, 1974 and Air Act, 1981.
Thereafter, the industry was given hearing before the Chief Environmental Engineer (P) of the Board on 14.02.2024 and it was decided as under:-
1. The proposed direction u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 shall be confirmed for closure of the unit.
2. Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar shall keep the strict vigil on the activities on the industry w.r.t the operation of the unit.
Thereafter, the industry was issued directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 to the PSPCL authorities vide Boards letter no. 1080 dated 12.03.2024, as per which:-
“That the authorities concerned shall disconnect the electricity supply available subject cited industry with immediate effect.”
Accordingly, the electric connection of the industry was disconnected vide TDCO no. 100024574142 dated 14.03.2024.
Thereafter, the industry had applied for obtaining consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, which was returned by the competent authority and it was decided that: -
1) RO be asked to return the case to the industry.
2) The industry be asked to submit bank guarantee amounting to Rs. 2.0 Lakhs as an assurance to comply with Environmental Laws.
3) EC amounting to Rs. 2.0 Lakhs be imposed on the industry for degradation of the environment by the industry.
Now, the industry has again applied for obtaining fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Plastic Granules @ 700 Kgs/day, Plastic Packing Material @ 200 Kgs/day by using Plastic Polythene Sheets @ 750 Kgs/day, Plastic Virgin Granules @ 200 Kgs/day as raw material alongwith requisite documents and fee.
The industry has already deposited consent fee of Rs. 5,500/- vide UTR. No. UCBAH24080156582 dated 20.03.2024 under Water Act, 1974 and Rs. 6,000/-vide UTR. No. UCBAH24080156697 dated 20.03.2024 under Air Act, 1981 including application form fee and Rs. 1,100/- vide UTR. No. UCBAH24080155087 dated 20.03.2024 as NOC fee, against the gross value of fixed assets is Rs. 9.82 lacs. The consent fee deposited by the industry is adequate upto 30.09.2026 under both acts after adjusting NOC fee.
The industry has submitted the GST registration certificate vide no. 03DERPB7012F1ZW in the name is M/s Sunrise Polymers through its Prop. Sh. Anshul Bansal issued on dated 24.11.2022.
The industry has submitted the rent agreement executed on dated 15.03.2024 between Sh. Vaibhav Goel S/o Sh. Ashok Kumar Goel and M/s Sunrise Polymers through its Prop. Sh. Anshul Bansal S/o Sh. Pawan Kumar for Khasra No. 1014/106/04, Khewat No. 144/106, Khatuni No. 206, Vill. Rampur Saini, Bhagwanpur, SAS Nagar, which is valid upto 14.02.2025.
The site falls in FEZ zone as per Master Plan Derabassi and the operation of green category industry can be regularized.
The industry was visited by AEE of this office on 02.04.2024 and it was observed as under:
1. The industry is engaged in business of manufacturing of Plastic Granules and Plastic Packing Material.
2. The manufacturing process of the industry is as under:-
For Plastic Granules- Raw Material (Polythen Sheet UD/PP. Fabric)—Aglo (Crush)—Dana Machine (Extruder)—Dana Cutting—Finish Goods (Dana)
For Plastic LDPE Bags- Virgin Plastic Granules LDP/LLDP—Melting (Extruder)—Tube (Roll)—Cutting—Finished Goods
3. There is no source of trade effluent and domestic effluent is being discharged onto land for plantation passing through septic tank.
4. The industry has installed extruder machine with wet scrubber as APCD followed by stack of adequate height.
5. The industry has not installed any D.G set.
6. The industry has submitted site plan approved by Er. Lokinder Bansal Competent Person from Director of Factories, Punjab on dated 04.03.2024.
‘The industry has now deposited Environmental Compensation of Rs. 50,000/- and has submitted request letter to deposit the rest amount in quarterly installments. The industry has also submitted that his financial condition is very bad and request to waive off the condition of the Bank Guarantee of Rs. 2.0 lacs.’
Sir, it is submitted that it is micro scale unit and has only provided one no. extruder and one no. blow moulding machine. As such, this office is of the view that the request of the industry may be considered and short term consents may be granted to it. The cheque of Rs. 50,000/- submitted by the industry has been kept in safe custody for approval of the competent authority.
In view of above, it is recommended that:-
1. The request of the industry may be placed upon the competent authority for waiving of the Bank Guarantee and allowing the industry to submit its Environmental Compensation in four quarterly installments.
2. Consequent upon decision no. 1, Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 may be issued for restoration of electric connection of the industry for six months.
3. The Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted for six months with subject to suitable conditions and special conditions that: -
a. The industry will not manufactured plastic carry bags or any other SUP item in future.
b. The industry shall only use virgin plastic granules as raw material in the process.
c. The industry shall obtain registration under EPR as per Plastic Rules, 2016 within one month.
d. The industry shall not deal with any entity without obtaining EPR registration under the Plastic Waste Management Rules, 2016 as amended from time to time.
e. The industry shall not carry out any activity in its premise, which can change the category of unit from Orange to Red, without prior permission from PPCB.
f. The project proponent shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
g. The industry shall ensure that the activity of unit does not create any nuisance in the surrounding areas and no public complaints are received.
h. The Consent is being issued to the industry based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
i. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
j. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and / or any other environmental law applicable to the industry and Rules, Circulars & Directions issued by the Board from time to time, at all times.
