It is submitted that industry was afforded an opportunity of personal hearing before the Senior Environmental Engineer of the Board on 27.03.2024 wherein it was decided as under : -
1. The industry shall not procure and process any waste as prescribed in Schedule-I appended to the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 till it gets the certificate of registration / passbook as recycler /re-processor from the Board.
2. The industry shall apply for obtaining authorization alongwith registration/ passbook under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 at the earliest.
3. Environmental Engineer, Regional Office, Bathinda shall visit the industry, verify the submission of the representative of the industry and process the application applied by the industry under the Water Act, 1974 & Air Act, 1981, on merits.
In compliance of the decisions of the personal hearing, the industry was visited on 24.04.24 and it was observed as under:
1. The industry was not in operation.
2. The industry has installed flow meter at the pipeline for monitoring of recirculation of water.
3. The industry has provided fresh plantation along the boundary walls.
From above, it is clear that the industry has removed the previous in completions and is also not in operation.
Therefore, it is, recommended that show cause notice under the Water Act, 1974 and Air Act, 1981 issued to the industry may be dropped and fresh consent may be granted for a period of 6 months subject to the suitable conditions along with special conditions as under : -
1. The industry shall not procure and process any waste as prescribed in Schedule-I appended to the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 till it gets the certificate of registration / passbook as recycler /re-processor from the Board.
2. The industry shall apply for obtaining authorization alongwith registration/ passbook under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 at the earliest.
