The industry was granted consent to establish under Water Act, 1974 and Air Act, 1981 vide no. CTE/Fresh/MNS/2022/19119563 dated 18.07.2022 valid upto 17.07.2023 for establishing mix board mill with production capacity @ Card Board/Mix Board @ 8 TPD by using raw material as Primary ETP sludge of pulp & paper mill @ 5 TPD, Paddy Straw @ 3.25 TPD, Jute Bags/Cow Dung @ 3.25 TPD, subject to the suitable conditions and special conditions : -
1) The industry will ensure compliance of standard operating procedures prescribed by CPCB for utilization of hazardous waste of category 32.3 i.e. primary ETP sludge of pulp and paper mill.
2) This consent to establish is issued from pollution angle and the project proponent shall obtain the statutory clearances/permissions from the other concerned departments, as required.
3) The industry shall re-circulate the entire effluent generated from the process and shall not in any case discharge its treated or untreated effluent.
Thereafter, the industry applied for obtaining fresh consent to operate under the Water Act, 1974 and Air Act, 1981 which was refused vide no. CTOW/Fresh/MNS/2024/24176188 and CTOA/Fresh/MNS/2024/24176069 both dated 13.03.2024 due to various observations mentioned therein.
The industry has deposited fees under Air Act, 1981 and Water Act, 1974 @ Rs. 9000/- vide 90682957 & 110941665 dated 08.02.2024 which is adequate upto 30.06.2025 after deducting penalty fee of Rs. 1800/- (50%) under each Act against the fixed assets of Rs. 47.68 lacs as per CA certificate dated 09.11.2023.
The industry has attached compliance of NOC conditions, site plan, manufacturing process, completion certificate and emergency response plan.
The industry was visited by officer of this office on 24.04.2024 and was found as under: -
i. The industry was in operation during visit and also utilising paper industry sludge without obtaining HWM authorisation/passbook for its utilisation.
ii. The industry has installed 2 no. Cardboard rolling machines that are in operation and in process of installation of 2 more such machines.
iii. The industry has made arrangement for recirculation of waste water generated from the process and to reuse the same back into process after collecting it in collection tank. However it has not installed the flow meters. Further, the purge water was also observed discharged outside the back boundary wall.
iv. The industry has made proper arrangement for storage of paper mill sludge and has constructed shed of dimensions 60 ft X 50 ft (check from the layout plan attached in documents) with brick cement mortar flooring.
v. The industry has provided boundary wall all along the premises.
vi. There is no source of air pollution in the industry.
vii. The industry has made plantation by planting new saplings along the boundary wall along two sides.
In view of above, it is clear that the industry has failed to comply with the conditions of consent to establish under the provisions of Water Act, 1974 and Air Act, 1981 granted to it. Further, The industry is also not complying with guidelines of SoP for use of paper mill sludge.
