Discussed, it is submitted that the project is a medium scale orange category (2099: Building and construction projects <= 20,000 sq. m built up area) unit and the project proponent has applied for Consent to establishment/NOC through OCCMMS for 130 no. flats and discharge of domestic effluent @ 70 KLD through STP (35 KLD treated water discharge into sewer). The project proponent has submitted project report and as per project report the treated waste water @ 29 KLD for flushing purpose, 6 KLD for green area purpose and 35 KLD into sewer.
The project proponent has deposited fee of amounting to Rs. 24000/- vide R.no. 14383286 dated 23.09.2023 as NOC regularization fee, which is adequate upto one year.
The project was visited by the undersigned on 18.04.2024 and it was observed as under:-
1. The project is located backside GNE College and within MC limits.
2. The project proponent has constructed 90 flats and rest construction was going on.
3. The project proponent has proposed to install STP of capacity 100 KLD based on MBBR Technology and as per project report 70 KLD waste water will be generated from the project and will be treated in STP of 100 KLD capacity and treated waste water @ 35 KLD will be discharge into sewer, 29 KLD for flushing purpose and 6 KLD for green area purpose.
4. The project proponent has now submitted the CLU granted by Assistant Town Planner, MC, Ludhiana vide no. 589/org-C/O dated 20.03.2018 for group ho using use and as per CLU the site falls in residential zone. The project proponent has also submitted approved site plan from M.C. Ludhiana and as per the site plan the total covered area of flats are 155414.92 sq ft. (14438.5185294 sqm). The built-up area of project is less than 20000 sqm and is not covered under EC.
5. The project proponent has submitted permission vide no. 288/XEN-c/o&m dated 26.02.2024 regarding disposal of treated waste water of STP into MC sewer.
6. The project proponent has proposed to installed mechanical Bio-composter for managing Municipal Solid waste as per SWM Rules, 2016.
7. There is no air polluting industry i.e. brick kiln, rice sheller, stone crusher, saila plant, cement plant, grinding unit, hot mix plant, Jaggery unit, CBWTF falling within a radius of 500 mtr from the boundary of the proposed site. There is no MAH industry located within a distance of 250 mtr from the proposed site. However, there is one marriage palace and hotel within the radius of 50 mtr. The marriage palace i.e. M/s Gillz Garden has been granted consent to operate under Water Act, 1974, which is valid upto 30.06.2027 and Air Act, 1974 which is valid upto 11.12.2028 and hotel i.e. Eastern Count has been granted NOC upto 25.12.2023. Further as per CLU site falls under Residential Zone and the site is suitable for establishment for group housing project.
In view above it is recommended that the Consent to establish/NOC may be granted to the project proponent for one year for 130 no. flats and treated waste water @ 35 KLD will be discharge into sewer, 29 KLD for flushing purpose and 6 KLD for green area purpose of with suitable and special conditions that: -
1. The project proponent shall ensure not to increase the built-up area beyond 20000 sq meter without obtaining Environment Clearance failing which legal action/suitable action will be initiated against the project proponent.
2. The project proponent will utilize treated waste water @ 35 KLD will be discharge into sewer, 29 KLD for flushing purpose and 6 KLD for green area purpose..
3. The project proponent shall install STP of capacity 100 KLD and shall comply with the standards prescribed by the MoEF & CC/Board for all the STPs and the project proponent shall maintain the record of fresh water and the treated effluent utilized in green area and treated effluent discharged into MC sewer on regular basis.
4. The project proponent shall not commission its expansion project without making adequate arrangements for the scientific mode of disposal of treated wastewater to be generated from the project.
5. The project proponent will develop the project on its own risk & cost in regard to disposal arrangement.
6. The promoter company shall also explore the possibility of using treated domestic effluent for useful purposes such as construction work, sprinkling on dusty patches/roads, use in nearby construction activities, etc.
7. The industry shall obtain the necessary clearance for the abstraction of groundwater from the Punjab Water Regulation & Development Authority (PWRDA).
8. The promoter company shall ensure compliance with the Solid Waste Management Rules, 2016, and being the bulk waste generator shall ensure segregation of solid waste at source, facilitate collection of segregated waste in separate streams, handover recyclable material to either the authorized waste pickers or the authorized recyclers as prescribed in Solid Waste Management Rules, 2016.
9. The bio-degradable waste shall be processed, treated, and disposed of through a mechanical composter of capacity 130 kg/day. The residual waste shall be given to the waste collectors or agency as directed by the local body.
10. The promoter company shall not consume any fuel except HSD for DG set, for burning purposes without the prior written permission of the Board.
11. The project proponent shall install the smog gun to control the dust emission to be generated from the construction activities of the project.
12. The project proponent shall not discharge any domestic effluent (treated or untreated) into choe/ drain /river or in any inland surface water at any time or any other unauthorized place by any unauthorized means and shall explore the possibility of reduction of quantum of abstraction of groundwater by reusing the treated wastewater in the various activities.
13. The project proponent shall provide a permanent pipeline from the project site to green belt/onto land for the plantation area
14. The project proponent shall maintain the plantation area as well as a permanent pipeline network for uniform distribution of wastewater in the entire plantation area, so that no stagnation of wastewater occurs inside, outside, or in the plantation area at any time.
15. The project proponent shall install a water meter on the freshwater supply and all proposed modes of disposal.
16. The industry shall ensure compliance with provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986, and or any other environment law applicable to him and rules, circulars issued by the Board from time to time.
17. The project proponent shall do construction in accordance with the approved layout plan and shall comply with the conditions of the CLU Granted to it.
18. The project proponent shall perform / promote its Corporate Environment Responsibility (CER) activities as well as the use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic.
19. The project proponent shall ensure that there are no usages of single-use plastic- thermocol disposable items such as water bottles/water pouches/water cups, plates, forks, spoons, straws etc., and single use decorating material.
20. The project proponent shall provide a buffer zone of green belt (dense populated trees with pleasant fragrance) around the sewage treatment plant, so as to reduce the effect of odour problem on the nearby residential area.
21. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016. The project proponent shall develop its residential complex as well as construct flats strictly in accordance with the layout/ building plans approved/ to be approved by the Competent Authority.
22. In case of any violation action u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 will be initiated for closure of the project proponent without further notice.
